187비자는 RSMS (Regional Sponsored Migration Scheme) 비자라고 해서 지방에 있는 사업장에서 자격있는 피고용주를 고용하려고 할 때 정부가 비자를 승인해 주는 것을 말합니다.

• RSMS 비자 (187)의 경우는 크게 2가지 stream 이 있습니다.
  첫째 TRT 라고 해서 Temporary Residence Transition stream이 있습니다. TSS 비자(482) 를 소지하고 4년중 3년을  일한 경우 (nomination 신청전) 같은 직업군으로 신청하는 경우 /  457 비자를 가지고 일한 분들로서 최소한 3년중에 2년간 요리사로 일을 한 경우에 신청자격중에 하나를 만족하게 됩니다. (457 비자 경우는 시간이 흐를 수록 사라질 정만) 
• 둘째 DE라고 하여 Direct Entry stream 이 있습니다. (호주에서 일한 경력이 없거나 있어서 짧은 기간인 경우 그러나 최소 3년 경력을 해외에서 가지고 있는 경우

그 어떤 경우가 되었든 아래 조건을 만족해야 합니다.

• have been nominated by an approved Australian employer in regional Australia within six months before you apply (신청전 6개월안에 지방에서 사업하는 사업장으로 부터 지명될 것)
• are under the age of 45 years at the time of application (신청시점에서 45세 미만)  (TRT Stream 의 경우 45-50세미만 가능)
• at time of application lodgement, have the required skills and qualifications for the position you have been nominated for – you must hold any mandatory registration, license or professional membership, or you must already be fully assessed as suitable by the relevant body (라이센스 소지 또는 기술심사 통과)
• at time of application lodgement, have appropriate English language skills (영어성적 IELTS 6.0 x 4 또는 이에 상응하는 점수)
• meet health and character requirements (신체검사 및 신원조회 만족)
• meet the requirements of the stream in which you apply. (본인이 선택한 비자신청방법에 해당 다른 기타 조건을 만족)

현재 이비자의 처리 시간은 아래와 같습니다.

신체검사: 12개월 유효 (가족 구성원 모두; 호주에 이민하든 하지 않든)

신원조회: 12개월 유효

배우자영어성적: IELTS 4.5 (과락인정)

경력인정 관련하여 매우 중요한 내용 정리해 드립니다. 

187 비자를 신청하기 전에 경력을 최소 3년 경력을 쌓아야 하며 이 경력은 Full-time (최소 주당 35시간)이어야 합니다. (이 경력 수준은  at the level of skill required for the occupation 라고 하여 해당 직업군을 위해서 요구하는 기술수준에 맞아야 한다는 점이 중요한 key point) 

At the time of application the applicant must have been employed for at least 3 years in the occupation on a full time basis and at the level of skill required for the occupation for which they have been nominated.

The applicant must have worked full-time for at least 3 years before the date of application. Policy intends for the work experience to be recent (최근경력요구), however the period of work does not have to be continuous, or be immediately before the visa application was made. In order for the work to qualify as full-time, the applicant should have worked for at least 35 hours per week.

그리고 해당 경력은 일정 수준의 학력과 기술 수준을 쌓은 후의 경력을 의미 합니다. 즉 학과과정의 코스의 일부였거나 또는 기술심사를 통과를 하기 위한 경력은 인정하지 않게 됩니다.

Clauses 187.234(b)(vii) and 187.234(c)(iii) refer. Applicants need to demonstrate that they have been employed at the level of skill required for the occupation. That is, the applicant must have been employed and actively performing the duties of the nominated occupation for a period of at least 3 years after obtaining any qualifications that would allow them to work without restriction in the occupation. (해당 직업군에 어떤 제약도 없이 일을 할 수 있는 qualification을 소유한 다음에 쌓은 경력 최소 3년) 

They must have been fully skilled to perform the duties specified for the occupation. Any periods of work performed in any occupational training capacity (for example, an apprentice, trainee or assistant) do not count towards the 3 year full-time work experience. (코스 과정의 일은 인정하지 않음) 

만약 6년을 파트타임을 일을 한 경우 예를들어 주당 20시간씩 6년간 일을 했다면 3년 full-time을 인정을 해 줍니다.

RSMS recognises that, in addition to full-time work, there now exists a range of variable employment arrangements. Citizens of numerous countries depend on multiple income earning strategies to make a living. In Australia, part-time work arrangements and variable working hours are increasingly common. This will impact on how work experience is calculated. If work experience is to be expressed in full-time terms, for part-time workers this can be calculated pro-rata. For example, if the requirement is for 3 years of relevant full-time work experience, if part-time work is at 50% of a full-time load, the applicant must be able to demonstrate they have worked in that occupation on a part-time basis for 6 years
