인터뷰도 없이 그리고 시민권 시험도 없이 바로 시민권 신청서 승인이 나옵니다.

제 경우 신청후  3개월 이내의 고객님이 계시고요.

시민권 시험은 당연히 없었고 인터뷰 요청도 없었습니다.

바로 승인이 나오신 경우인데요.

NZ 시민권자들은 호주에 입국을 하면 SCV (444) 비자를 받습니다.

이비자를 받고 1년이 지나면 호주 시민권 신청 자격이 됩니다.

2022년 7월 1일 이전에 입국을 한 NZ 시민은 2023년 7월 1일 부터 시민권을 신청할 수 있습니다.

 

The purpose of this Determination is to extend permanent residency to all NZ citizens holding Subclass 444, Special Category Visas (SCV) and in specific circumstances, to backdate the general twelve-month permanent residency requirement for eligibility to apply for Australian citizenship. Under this determination, some NZ citizens will be eligible to apply for Australian citizenship from as early as 1 July 2023.

Where an SCV holder satisfies subsection 5(2) of the Citizenship Act, that person is taken to have become an Australian permanent resident, when:

2023년 7월 1일부터 2022년 7월 1일 또는 그 이후로 호주에서 태어난 SCV 비자 소지한 아이들은 호주 시민권을 자동으로 얻게 되며 2023년 7월 1일부터 호주 여권을 신청할 수 있습니다.

The backdating of permanent residence for SCV holders will also impact children born to SCV holders. From 1 July 2023, any child born in Australia on or after 1 July 2022 to an SCV holder may automatically acquire Australian citizenship at birth. From 1 July 2023, children who meet these circumstances can apply for​ evidence of citizenship.

5개월이 지나서 2023년 5월 25일에 189 비자 초대가 7353건이 있었고 대부분이 보건의료 분야의 종사자들을 대거 초대한 것이 눈에 띕니다.

Vetassess에서 제공하는 내용으로 기술심사 (전문직) 시 에 실수하는 7가지 내용입니다.

1. Not including the relevant qualification documents
(이것 말이 되나 싶었는데요 China, Europe, the Philippines and Lebanon 나라 출신들은 추가적인 자료를 제출해야 하거든요. 한국에 있는 대학 출신자들은 물론 해당이 없음) 

2. Submitting an incomplete application
(학교 성적표 및 학위 증명서 모두 제출하지 않는 경우도 있고 경력 관련 서류를 충분히 제출하지 못하는 경우) 

3. Assuming an occupation is assessed by occupation title only

(직무 타이틀 그자체로는 기술심사를 하지 않음에 유의. 직무 타이틀은 나라마다 다르고 호주와 매우 다른 경우도 있으니 신청이 한 일이 호주에서 요구하는 일 유형 및 수준에 맞아야 함)

4. Not having sufficient employment duration
(신청하는 시점에서 과거 만 5년 경력안에 있는 경력이어야 함)

5. Lodging a Priority Processing application for a second or subsequent application.

(우선 처리 신청은 아래 항목에 해당하는 경우에만)

  • If they have not previously received a negative outcome for the occupation nominated (기술심사 떨어진 적이 없는 경우)
  • They wish to renew an application that has previously been assessed positively for both the employment and qualifications (학력과 경력 기술심사 통과후 기술심사 만기 되어 연장하고자 할 경우)
  • They are applying for reassessment for a new occupation. (새로운 직업군을 위해서 재평가를 신청하는 경우)

6. Not providing the applicant’s contact details

( 신청서 제출시 연락처 및 이메일이 누락되는 경우 -> 이런 일이 있기도 하나 싶은데요) 제출된 서류에 대해서 질문 또는 문의를 해야 할 경우 연락처가 없다면 매우 오랜 시간이 소요될 수 있다고. 개인적으로 이런 적은 없었지만 어떻게 신청하면서 연락처 및 이메일을 제출하지 않을 수 있는지 그것이 더 궁금함.

7. Not supplying original language and/or English translation documents

(영어로 된 서류가 아닌 서류를 제출한 경우; 호주인들은 영어 아닌 것은 반드시 번역공증을 해야 함. 한국에서 번역 공증을 하는 것이 저렴함)

이와 같이 7가지 실수를 하지 않으면 제출한 신청서가 보다 신속하게 처리되고 전체적으로 Vetassess 처리 시간이 모두를 위해서 도움이 되겠다는 사실. 이런 사소한 실수를 줄일 수만 있다면 불필요하게 모든 사람들이 backlog에 놓여 모두에게 영향을 주지 않을 수 있다면서 실수를 피해달라고 Vetassess는 강조합니다.

개인적으로 저는 2002년 2월 부터 늘 하던 업무이기 때문에 이런 실수는 없었고 그로 인해 처리 시간이 더 소요되는 일은 없었음을 밝혀 둡니다.

Labour 정부가 들어와서 그나마 가족 비자 (기여 부모 비자 및 일반 부모비자)의 그란트 숫자가 증가된 것을 볼 수 있습니다.

 

Contributory Parent, Parent and Other Family visa allocation 2022-23

Migration (Granting of contributory parent visas, parent visas and other family visas in financial year 2022/2023) Instrument – LIN 23/016 – F2023L00609, specifies the allocation of the number of places to these visa classes.

Contributory Parent visas

A maximum of 6,800 visas may be granted for the 2022-2023 financial year, up from 3,600 in the previous year. (작년 3600건에서 금년 최대 6800 승인될 듯)

Of the maximum number of Contributory Parent visas, a maximum of 112 visas may be granted to applicants for the Contributory Parent Visa Migrant, Class CA who hold or who last held SC 405 Investor Retirement or SC 410 Retirement visas and who are seeking to satisfy either:

  • the primary criteria in Sch 2, Clause 143.214, or
  • the secondary criteria Sch 2, Clause 143.313.

Parent Visas

A maximum of 1,700 Parent visas may be granted in the 2022- 2023 financial year, up from 900 in the previous year. (작년 최고 900에서 금년 최대 1700 부모비자 승인 될 듯)

Of the maximum number of Parent visas, a maximum of 13 visas may be granted to applicants for the Parent (Migrant) (Class AX) visa who hold or who last held C 405 Investor Retirement or SC 410 Retirement visas and are seeking to satisfy either:

  • the primary criteria set out in Sch 2, Clause 143.214, or
  • the secondary criteria set out in Sch 2, Clause 143.313.

Other Family visas

A maximum of 500 Other Family visas may be granted in the 2022-2023 financial year, the same number as in the previous year. (다른 가족의 경우 전대대비 동일하게 최대 500 건승인이 될 것으로)

This Instrument repeals LIN 22/006 and will sunset on 1 July 2023.  (2023 년 7월 1일 정해진 할당량은 종료될 것임)

Section 48 이라고 해서 호주에서 비자 거절이 된 경우

코비드 비자를 신청할때 일반적으로

  1. 현재 소지한 비자 90 일 이내 또는
  2. 현재 소지한 비자 만기 28일 안에

코비드 비자를 신청할 수 있습니다.

 

그러나 호주에 입국후 어떤 비자를 거절된 경우에는

2번 항목의 경우 Section 48이 적용되니

반드시 현재 소지한 비자가 유효할 때 코비드 비자를 신청해야 section 48가 적용되지 않습니다.

 

관련된 법이 아래와 같습니다.

 

MIGRATION ACT 1958 – SECT 48

Non-citizen refused a visa or whose visa cancelled may only apply for particular visas

             (1)  A non-citizen in the migration zone who:

                     (a)  does not hold a substantive visa; and

                     (b)  after last entering Australia:

                              (i)  was refused a visa, other than a refusal of a bridging visa or a refusal under section 501, 501A or 501B, for which the non-citizen had applied (whether or not the application has been finally determined); or

언제나 비자는 비자법을 전문으로 다루는 곳에 연락을 하셔서 사전에 상담을 받아 작은 실수가 발생하는 가능성을 줄이는 것이 때로는 필요한 것 같습니다.

PS 새로운 비자를 신청할 때 항상 비자 만기전에 신청을 해야 이런 법을 몰라도 자연스럽게 넘어갑니다. 불필요하게 비자 만기후 신청할 이유가 없음입니다.

Q) 오늘 한 분이 제게 전화를 하셔서 이런 질문을 하십니다.
1. 이전에 영주비자 연장을 위해서 구 여권으로  RRV를 받았음.

2. 새로운 여권을 이민성에 보냄

3. 그런데 비자 그란트 레터에 구 여권 번호가 그대로 있음

4. VEVO를 확인하면 구 & 신 여권으로 확인이 됨

이게 맞는지 여쭤 보시더군요.

3번의 내용은 한번 그란트된 다음에 발행된 grant letter는 신여권으로 변경을 하더라도 이 grant letter는 바뀌지 않습니다. 따라서, 구여권이 당연히 남아 있고요.

4번의 경우는 뭔가 그 분이 오해를 했거나 또는 시스템 상의 오류입니다. 반드시 구 / 신 여권중에 하나로 VEVO 조회가 이뤄져야 합니다. 신여권이 제대로 변경이 이뤄졌다면 (하루 / 이틀 시차는 있을 수 있어도) 두 개의 여권으로 조회가 되어서는 안됩니다. 만약에 100% 되고 있다면 이것은 사용자의 문제는 아닌 시스템상의 문제로 131 881 에 전화하셔서 이런 현상을 알려 줘야 합니다.

 

제대로 변동이 되었다면 반드시 신여권으로만 조회가 되어야 합니다.

TSS 비자 소지후 만 2년 경력을 쌓은 경우 (기존의 3년 경력에서)

ENS (186) 비자 TRT stream으로 신청이 가능할 것이라고 이민법무사 협회에서 알려 온 내용을 공유합니다.

 

Sponsored visa holders will be eligible for ENS TRT after two years (down from three years) of sponsorship on a TSS by their employer

 

따라서, 현재 TSS 비자를 소지한 분들에게는 매우 좋은 소식이 아닐 수 없겠습니다.

 

물론 TSS 비자를 신청했을 때 해당 직업군으로 꾸준히 일하고 있어야 합니다.)

TSMIT (7만불) 인상 업데이트

TSMIT increase update 

 

TSMIT 이 2023년 7월 1일 부터 53,000불에서 7만불로 상향 조정됩니다. (이전에 공지한 내용 참고)

하여 2023년 7월 1일부터 또는 그 이후로  신청되는 스폰서쉽 비자 (482 / 186) 노미네이션을 위한 TSMIT는 7만불 또는 마켓 급여 (어떤 것이 높 더 높은 것으로) 만족을 해야 합니다.

다만 2023년 7월 1일 이전에 접수된 것은 기존 53,900불을 만족하면 된다고 MIA 협회에서 온 내용을 공유해 드립니다.

2023년 5월 30일 TSMIT 관련 업데이트입니다. 

  • TSMIT will be treated as a time of application criteria during the transition to the increased rate. (인상된 TSMIT의 만족은 신청서 접수시점에서 만족해야 함)
  • Nominations lodged before 1 July 2023 with a TSMIT of $53,900 will not be affected by the TSMIT increase, even where the application is decided after 1 July 2023. (53,900불의 TSMIT 조건으로 2023년 7월 1일 이전에 접수된 노미네이션은 2023년 7월 1일 이후로 결정되는 신청서일 지라도 TSMIT 인상에 의해 영향을 받지 않을 것임)
  • Visa applications lodged in association with approved $53,900 TSMIT nominations will not be affected by the TSMIT increase, even if the visa application is lodged after 1 July 2023. (기존 53,900불 TSMIT 노미네이션 승인된 것으로 비자신청이 된 경우 2023년 7월 1일 이후로  비자신청이 될 지라도 TSMIT 인상에 의해 영향을 받지 않을 것임)
  • 결론적으로, 2023년 7월 1일 이전에 Nomination을 접수하여 그 날짜 이후로 승인되거나 또는 2023년 7월 1일 이전에 승인된 노미네이션인 경우 인상되는  TSMIT 에 의한 영향을 받지 않는다는 내용입니다.

유학생이 일할 수 있는 시간이 2주당 48시간을 바뀜 – 2023년 7월 1일부터

2023년 7월 1일 부터 유학생들의 일할 수 있는 시간이 다시 무제한에서 제한적인 시간으로 돌아갑니다.

대신 2023년 7월 1일부터 예전의 2주당 40시간에서 2주당 48시간을 8시간이 늘어납니다.

유학생 비자를 소지한 분들의 주 목적은 공부이지만 스스로 자신의 생활비 정도는 벌 수 있는 기회를 제공하기 위해서 학생비자 소지한 분들이 일도 할 수 있도록 하고 있습니다.

그런데 간혹 고용주의 임금착취가 있을 수 있는데요

예를들어서 2주당 40시간 이상을 함으로서 불법적으로 일을 한 경우 임금이 원래 최저임금을 받아야 하는데 받지 못하거나 또는 주당 20시간 합법적으로 일을 하면서도 영어를 못한다고 최저임금이 안되는 시급을 줄 경우 유학생들의 권리를 보호하기 위해서 Fair Work Ombudsman 이라고 무료로 고용착취당한 분들의 애로점을 해결해주는 무료정부기관이 있습니다. 이곳에 연락을 하세요. 비록 비자조건을 어기면서 일을 했더라도 일하면서 임금착취나 노동착취 등을 더 중요시 여기기 때문에 그런 분들이 보호를 받게 됩니다. 비자 취소되지 않습니다. 

 

그리고 비자는 고용주가 피고용주의 비자를 취소시키지 못합니다. 이런 협박아닌 협박으로 고용주가 피 고용주를 임금착취하는 경우가 있습니다. 이에 겁먹지 마시고 Fair Work Ombudsman에 신고하면 자신의 권리를 보장 받게 됩니다. 호주 이민성에서는 거듭 이야기를 하지만 신고자가 비록 비자법을 어기면서 일을 했더라도 이렇게 신고를 한 경우 비자 취소되지 않음을 말하고 있습니다.

Allowable work hours cap for international students

Reinstating of the fortnightly work hour cap from 1 July 2023

Introduction

The allowable work hours cap for international students was relaxed during the pandemic to help meet workforce shortages.

The Government has announced that the cap will be reinstated on 1 July 2023 and will be raised from its previous level of 40 hours per fortnight to the new level of 48 hours per fortnight.

This revised cap will help international students to support themselves through their studies, while maintaining study as the primary purpose of their visa.

Safeguarding international students’ rights

The Government is committed to addressing exploitation of migrant workers in all sectors and is aware of the risks of exploitation that international students can face, where limited work hours are a condition of their visa.

The Government has agreed to the recommendations in the Post-Study Work Rights Report which address these risks:

  • ensuring the needs of student and graduate visa holders are considered when developing the package of reforms to address migrant worker exploitation expected in 2023.
  • ensuring information about the role of the Fair Work Ombudsman in securing workplace rights and protections for all workers in Australia is available to international students and graduates.

The Fair Work Ombudsman

If an international student is being exploited in the workplace, they should contact the Fair Work Ombudsman, who will be able to support them. The Assurance Protocol applies to temporary visas with work restrictions, including the Student visa (subclass 500). This allows international students to seek help from the Ombudsman without fear of visa cancellation, even if they have breached their visa conditions.

Why is the Government reinstating the cap on working hours?

The relaxation of the working hour cap was a temporary measure during the pandemic to allow students to bolster their income while helping to meet labour shortage. The primary purpose of a student visa is to study in Australia. The working hour cap is intended to balance international students’ need to support themselves and gain work experience in Australia with their main purpose, which is to study in Australia.

What should I do if my employer is threatening me with visa cancellation for working too many hours in a fortnight?

You should contact the Fair Work Ombudsman. Your employer cannot cancel your visa, and the Department of Home Affairs will not cancel your visa for reporting workplace exploitation to the Fair Work Ombudsman, even if you have worked more than the allowed number of hours in a fortnight.
