The Profession (이민법무사로서 일을 한다고 할 때 마음자세는?)

Working as a Registered Migration Agent (RMA) can mean assisting clients in making one of the most important decisions of their lives: helping them migrate to Australia.

Australia’s strong economy, world-class higher education system, multicultural society and stable governance makes it a highly attractive destination for migrants, and in an increasingly interconnected world, demand for the services provided by RMAs has never been higher.

The Migration Act 1958 and its associated Regulations govern Agents’ registration requirements and Code of Conduct, while the profession itself is regulated by the Office of the Migration Agents Registration Authority (OMARA).

Engineering and Building

Applications for engineering and building occupations will be temporarily closed from 16 October 2017 to 12 January 2018. Applicants who hold an offer of employment in Victoria in their nominated occupation or meet the streamlined PhD or 457 pathways are not affected by this closure and may apply for these engineering and building occupations during this time. See News and Events for more information.

Visa nomination for international PhD graduates

The Victorian Government offers a streamlined pathway to visa nomination for international PhD graduates. Applications will be processed within two weeks, compared to the average 12 week processing time. To be eligible, you will need either, a:

• completed PhD from a Victorian university:You may nominate any occupation that is eligible for the Skilled Nominated (subclass 190) visa on the Department of Immigration and Border Protection’s IMMI 17/072 Specification of Occupations and Assessing Authorities

• completed PhD of a recognised standard (as determined by the relevant skill assessing authority) from an overseas university or an Australian university outside of Victoria:In a field relating to an occupation on the Visa Nomination Occupations List for Victoria in the past five years.

(If you are not selected by the Victorian Government, you will not receive an email. Your EOI will continue to be considered for as long as it remains in DIBP’s SkillSelect system)

How to apply for Victorian visa nomination: ICT occupations

New application process for ICT occupations

Due to the high number of ICT applications that Victoria receives, we have changed our application process for ICT occupations. The aim of this is to reduce processing times and hopefully improve your experience with our program.  To apply for Victorian nomination (in ICT occupations), follow these steps:

1. Checkyou meet the Department of Immigration and Border Protection’s (DIBP) Skilled Nominated visa (subclass 190) requirements and Victoria’s minimum nomination requirements.

2. Submit an Expression of Interest (EOI)for the Skilled Nominated visa (subclass 190) in DIBP’s SkillSelect, and indicate your interest for Victorian nomination. You do not need to notify Victoria that you have submitted an EOI. Note that if you already have an EOI in the SkillSelect system (submitted before 1 July 2017), it will be considered for Victorian nomination. You will not need to resubmit it.

3. Regularly check your email(including your junk mail folder) to see if you have been selected by Victoria. There is no set timeframe to expect an invitation after submitting an EOI. Invitations are not guaranteed. If selected, an email invitation to apply for Victorian visa nomination will be sent to your email address used for the EOI.
4. Submit an online application for Victorian visa nomination within 14 daysof receiving the invitation. Note that you must be able to demonstrate that you still meet the claims that were in your EOI when you were invited. We recommend that you have all your supporting documents ready before you submit your EOI in SkillSelect, as the 14 days cannot be extended.
5. If you are successfully nominated by the Victorian Government, you will receive a SkillSelect invitation to apply for the Skilled Nominated visa (subclass 190).

6. Submit a visa application to DIBPwithin 60 days of being nominated by Victoria.

Selection considerations

The Victorian Government will review and select the top ranking ICT candidates from SkillSelect, who have indicated Victoria as their preferred state.  Candidates who are selected to apply are still required to meet Victoria’s minimum eligibility requirements, including demonstrating employability and commitment to Victoria, and are not guaranteed nomination.

If you are not selected by the Victorian Government, you will not receive an email. Your EOI will continue to be considered for as long as it remains in DIBP’s SkillSelect system.

Exemptions from this process

This application process is for ICT occupations only. However, if you are an ICT applicant and currently hold an offer of employment in your nominated occupation in Victoria, or meet the streamlined 457 or PhD pathway, you are exempt from this process and can lodge a Victorian visa nomination application directly without first being selected by Victoria.

Partner visa holders do not have to remain in an abusive relationship to stay in Australia

In Australia, domestic and family violence is not accepted.

A partner, family members or other people in the community cannot threaten your visa status.

If you hold a temporary Partner visa (subclass 300, 309 or 820) and experience family violence and your relationship ends, there are provisions in Australia’s migration laws to allow you to continue with your permanent Partner visa (subclass 100 or 801) application.

(1)  A person satisfies the Australian study requirement if the person satisfies the Minister that the person has completed 1 or more degrees, diplomas or trade qualifications for award by an Australian educational institution as a result of a course or courses:

(a)  that are registered courses; and

(b)  that were completed in a total of at least 16 calendar months; and  (최소 전체 16개월은 되어야 함)

(c)  that were completed as a result of a total of at least 2 academic years study; and (최소 학제가 2학년일 것.

(d)  for which all instruction was conducted in English; and  (영어로 수업 진행되어야 함)

(e)  that the applicant undertook while in Australia as the holder of a visa authorising the applicant to study.

Note:    Academic year is defined in regulation 1.03.

(2) completed, in relation to a degree, diploma or trade qualification, means having met the academic requirements for its award.

Note:   The academic requirements for the award of a degree, diploma or trade qualification do not include the formal conferral of the degree, diploma or trade qualification. Therefore, a person can complete a degree, diploma or trade qualification, for subregulation (2), before the award is formally conferred.

Academic year means a period that is specified by the Minister as an academic year in an instrument in writing for this definition.

DEFINITION OF ‘ACADEMIC YEAR’ (학년의 정의)

(REGULATION 1.03)

(a) 1 academic year is at least a total of 46 weeks, being the duration of a course or courses registered under s 9 of the Education Services for Overseas Students Act 2000;

(b) 2 academic years is at least a total of 92 weeks, being the duration of a course or courses registered under s 9 of the Education Services for Overseas Students Act 2000;

(c) 3 academic years is at least a total of 138 weeks, being the duration of a course or courses registered under s 9 of the Education Services for Overseas Students Act 2000;

trade qualification means:

(a)  an Australian trade qualification obtained as a result of the completion of:

(i)  an indentured apprenticeship; or

(ii)  a training contract;

that is required by State or Territory industrial training legislation or a relevant Federal, State or Territory industrial award and involves:

(iii)  part-time formal training at a technical college or a college of technical and further education; and

(iv)  employment within the meaning of:

(A)  an industrial award under a law of the Commonwealth or of a State or Territory; or

(B)  a law of a State or Territory dealing with commercial or industrial training; or

(b)  a qualification, under the Australian Qualifications Framework, of at least the Certificate III level for a skilled occupation in Major Group IV in the ASCO; or

(c)  a qualification, under the Australian Qualifications Framework, of at least the Certificate III level for a skilled occupation in Major Group 3 in ANZSCO.

Item 6D81 does not require the eligible Australian study being claimed to be relevant to the applicant’s nominated occupation. Nor is it relevant when the study was completed, provided the applicant met it at the time of invitation.

Consistent with regulation 2.27D, study undertaken in Australia for the purposes of meeting the Australian study requirement and being awarded points under 6D.8 will only be considered if, throughout the relevant period, the applicant held a substantive visa or an applicable bridging visa that allowed them to study, and they complied with the conditions of that visa.

Reg 2.27D    Study in Australia

In determining whether an applicant satisfies a criterion for the grant of a General Skilled Migration visa that the applicant has studied in Australia for a certain period, a period of study cannot be counted unless the applicant:

(a)  held:

(i)  a substantive visa; or (예를 들어 학생비자 또는)

(ii)  a Subclass 010 (Bridging A) visa; or (BVA 또는)

(iii)  a Subclass 020 (Bridging B) visa; (BVB)

authorising him or her to study during that period; and

(b)  complied with the conditions of that visa.

Group E

Skills Assessment Criteria: Qualification(s) assessed at AQF Diploma level with a highly relevant field of study and at least one year of postqualification highly relevant employment at an appropriate skill level in the last five years.

Temporary Graduate (subclass 485) visa

Work experience is not required for a Qualifications-only assessment to support a Temporary Graduate (subclass 485) visa. You will need to hold a qualification which is at the required educational level, in a highly relevant field of study to the nominated occupation. Find out more about the required educational level by searching your occupation.

After receiving sufficient work experience in their nominated occupation, subclass 485 visa holders can apply to VETASSESS for a Skills Assessment (qualifications and employment) to support an application to migrate permanently to Australia.

The Qualifications Assessment to support an application for a Temporary Skill Shortage (TSS) does not require an assessment of employment. It is a qualifications only assessment.

VETASSESS Skills Assessment applications require an assessment of both qualifications and employment against the criteria for your nominated occupation. Post secondary educational qualifications are mandatory in order to gain a positive skills assessment. Highly relevant employment cannot compensate for lack of qualification at the required educational level for the nominated occupation.

Vetassess

You are not required to provide evidence of English language proficiency for a skills assessment application with a nominated general professional occupation.

For the Skills Assessment, only paid employment within the last five years which is highly relevant to the nominated occupation and at an appropriate skill level for your nominated occupation will be considered. You may describe other employment in your CV/résumé. VETASSESS defines highly relevant employment to the nominated occupation as paid employment of at least 20 hours per week in which the major everyday tasks closely match the major tasks undertaken in the nominated occupation in Australia and are performed at an appropriate skill level for the nominated occupation in Australia. The employment must also match the lead statement in the Australian and New Zealand Standard Classification of Occupations (ANZSCO) for the nominated occupation.

Deeming date

VETASSESS will determine the date you met the entry level requirements for the nominated occupation based on closely related employment within the last ten years. VETASSESS will only count skilled employment post the Date Deemed Skilled as eligible for points test purpose. Please refer to our website for more information about ‘Date Deemed Skilled’.

English Language Test (영어시험 인정에 대한 내용)

From the 1st of November 2017, Engineers Australia will be accepting the Pearson’s Test of English (PTE) (Academic) for Migration Skills Assessment as well as for Membership assessment purposes. Applicants submitting their application after the 1st of November will be able to use either the IELTS, the TOEFL iBT or the PTE (Academic) to demonstrate their level of English in an assessment application.

Applicants must show a minimum score of 50 in each of the 4 modules (Listening, Writing, Reading and Speaking).

Pakistan, Full Signatory of the Washington Accord

In June 2017, Pakistan became the 19th full signatory of the Washington accord. This is a great achievement and a testimony to Pakistani Universities’ dedication to education standards and global engineering.

Applicants holding a qualification listed on the website of the Pakistan Engineering Council (PEC) under the Washington Accord list completed on or after 2017 can now apply via the accredited qualifications pathways.

Engineering Registration Overseas  (자국에서 엔지니어로서 일을 할 때 각 나라마다 다르기는 하지만 자국에서 엔지니어로서 등록이 되어야 엔지니어로 일을 할 수 있을 경우 관련 증빙서류를 기술심사에 제출해야 한다는 내용입니다.)

Engineering is a regulated profession in many countries. In some countries, only certain disciplines are regulated, like Civil or Electrical Engineering, and in others, any engineer must be registered to practice.
