The Skilled and Business Migration Program (SBMP) has made a number of program changes to its Skilled Nominated visa (subclass 190) nomination processes to strengthen targeting, streamline operations and improve customer experience.

The following changes came into effect on Monday 10 September 2018.

1. Streamlined pathway for 457 visa holders

The current 457 streamlined processing pathway has been removed.

Eligible 457 visa holders with occupations on the Victorian nomination occupation list may still be eligible to apply for Victorian visa nomination and retain existing alternate pathways to permanent residency.

2. Pathway for International PhD graduates

The current pathway for International PhD graduates will remain. However, there is now a change to processing times from the current fast-tracked two-week processing service to a new standard 12 week processing time.

The 12 week processing time applies to all skilled visa nomination applications, bringing this pathway in-line with the rest of the skilled migration program.

3. Expanded “Invitation Only” procedure

An “Invitation Only” application procedure applies across three industry groups: Information & Communication Technology, Building & Engineering and Nursing. 457 visa holders and applicants holding valid job offers are now subject to this procedure also.

SBMP will continue to periodically invite eligible, high calibre applicants in these industry groups.

Skill demand will continue to inform the number of invitations issued, which remain dependent on the number of available nomination places provisioned to Victoria by the Commonwealth under the General Skilled Migration Program.

Applicants who lodged their skilled visa nomination application prior to Monday 10 September, will be unaffected by these changes.

Applicants for Skilled Regional (Provisional) visa (subclass 489) nomination remain unaffected by the invitation only procedure and are able to apply as per the instructions outlined on the Skilled Regional (Provisional) visa (subclass 489) page.

For further information about these changes contact the skilled processing team on Telephone: + 61 3 9651 9756 or Email: skilled@liveinmelbourne.vic.gov.auexternal link

TSS visa (482)의 처리 순서 와 SAF(Skilling Australians Fund)에 대한 FAQ

Order of processing TSS visa applications (TSS

Ministerial Direction No. 77 – Order for processing applications lodged under the Temporary Skill Shortage (TSS) visa (subclass 482) sets the order of priority for considering such applications – that is:

1. applications lodged by accredited sponsors
2. applications lodged for positions that are located in a regional Australia
3. applications lodged under the Labour Agreement stream
4. all other applications (최하위 우선순위로 1,2,3이 아닌 나머지 신청서; 그러나 전세계 평균처리기준에 근거하여 처리됨)

If your client’s application does not fall into categories 1-3 above, it will receive the least priority as per the ministerial direction. Such an application should, however, be processed within the timeframes advertised at Global visa and citizenship processing times.

Agents are reminded of the opportunity to seek accreditation where they consider that their clients qualify, to ensure that these clients receive a priority service.

Cessation of the priority processing service

The current service of priority processing requests for TSS and Temporary Work (Skilled) visa (Subclass 457) visa applications will cease on 5 September 2018. That is, any priority processing email requests which are received on, or after, this date will no longer be acknowledged. This is because: (2018년 9월 5일 이후로 이 우선순위처리가 종료됨)

• the receipt of large volumes of requests continues to impact resources available to process visa applications
• the Subclass 457 visa pipeline is expected to be finalised by the end of the calendar year and the processing network are pro-actively prioritising the remaining caseload, including closely monitoring visa applications where the related nomination application is shortly to expire
• TSS processing times are much faster than for the Subclass 457 visa, with prioritisation arrangements already in place, as outlined above.

The TSS mailbox auto-response will be updated to reflect this. For priority processing requests already sent to the Department before this date:

• any applicant already advised that they will be accorded priority by the cut-off date will continue to receive priority for that specific application(s)
• any applicant pending a decision on the cut-off date will have that request declined and you will not receive written notification of this decision.

If your application is outside of these advertised timeframes, please refer to Compliments, complaints and suggestions to provide your feedback. Please do not send requests for priority to other contact channels (for example: program management mailboxes and/or individual officers), as they will not be responded to.

Other processing reminders

It is the responsibility of agents to ensure that their clients are aware of the:

• requirement to notify the department of any changes in circumstances, including those relating to newborns (both onshore and offshore)
  • concerns have been raised that some clients are not notifying the department of their newborns for almost one year after their birth – which is not acceptable
  • this is important, in particular, for large organisations with a large overseas workforce, where it is highly recommended that the Human Resources department of the sponsor sends such employees regular reminders about their immigration-related obligations as visa holders and / or visa applicants
• need to consider lodging a BVB application in advance as much as possible, otherwise a BVB may not be able to be issued in time for any urgent or unforeseen travel (BVB는 가능한 빨리 접수 그렇지 않으면 관련 비자 승인될 시간적 여유가 없을 수도 )
  • BVB processing times are included in the TSS mailbox auto-response which is updated regularly
• character requirements as per the recent update to the August 2018 Skilled Newsletter
  • in particular with regards to character calculations, certificates issued by private agencies and scans of penal clearances
• TSS mailbox auto-response information which is updated regularly
  • the auto-response provides information regarding what enquiries will be responded to, and the response times
  • this also provides the appropriate avenue for enquiries that will not receive a further response
  • agents are also reminded to refrain from sending multiple emails regarding the same case, or sending emails to multiple mailboxes, as this impacts on our ability to respond to the enquiries that require attention.

Automatic reminders now being sent to sponsors

As of 9 August 2018, automatic reminder messages are now being sent to:

• standard business sponsors to encourage them to renew their standard business sponsorship (SBS) before its expiry date*; and
• visa holders to remind them, if their sponsor has notified the Department that they have ceased employment, that they have 60 or 90 days of their employment cessation date (depending on when their visa was granted), to find themselves another current business sponsor who will nominate them or depart Australia.

*Note: Business sponsors who have already let their SBS expire will not be able to simply renew the expired sponsorship using the new shorter Sponsorship Renewal form in ImmiAccount. They will instead have to start all over again by completing a longer application form and having to provide all required documentary evidence again.

What is the SAF levy? (SAF

The SAF levy is a levy payable by employers nominating overseas skilled workers for any of the following visas:

• Temporary Skill Shortage (TSS) (subclass 482)
• Employer Nomination Scheme (ENS) (subclass 186)
• Regional Sponsored Migration Scheme (RSMS) (subclass 187)

The levy funds the SAF, which is managed by the Department of Education and Training (DET). The purpose of the SAF levy is to require employers who sponsor temporary and permanent overseas skilled workers to contribute to the broader skills development of Australians.

The SAF levy amount is payable in full when lodging a nomination application. The amount depends on the size of the sponsoring business and the proposed period of stay of the overseas worker in Australia. SAF levy payments are tax deductible.

Business size (매출이 천만불이상 또는 천만불 이하)	TSS visa (매년 지불)	ENS / RSMS visas (비자 신청할 때 한번)
Small (annual turnover less than $10 million)	AUD1200 per year or part thereof	AUD3000 one-off
Other business (annual turnover of $10 million or more)	AUD1800 per year or part thereof	AUD5000 one-off

Information provided in the online nomination application form is used to calculate the required SAF levy amount payable.

Example: a business with an annual turnover of more than AU$10M per year which wishes to nominate a TSS worker for a period of four years, would be liable to pay a SAF levy of AUD7200 (4 years x AUD1800).

Note:

• The nomination application form only allows sponsors to select one of the radio-button selections, being one, two, three or four year nomination period. The SAF levy payment is calculated based on the selected option.
• The SAF levy is payable at the time of lodging any nomination application. This includes where a nomination application is being lodged to allow a TSS visa holder to change employer or occupation.

When will the SAF levy payments commence? (SAF

The SAF levy will commence on 12 August 2018. The SAF levy only applies to TSS, ENS and RSMS nomination applications lodged on or after 12 August 2018. (2018

Are there any exemptions to the SAF levy? (SAF 기금)

There are no exemptions for the SAF levy, except for religious workers nominated under the Labour Agreement streams of the TSS or ENS visas. All other sponsors who are party to a Labour Agreement must also pay the SAF levy.

Can I ask my employee to pay the SAF levy?

No. Sponsors must not pass on the costs of the SAF levy to overseas skilled workers.

Can I request a refund of the SAF levy? (SAF

Refunds of the SAF levy are only available in any of the following scenarios:

• The sponsorship and visa applications are approved, but the overseas skilled worker (visa holder) does not arrive/commence employment with the employer.

• The employer’s sponsorship and nomination application for the overseas skilled worker is approved, but the associated visa application is refused on health or character grounds.(외국인 노동자를 위한 고용주의 스폰서쉽 및 노미네이션이 승인되었지만 신체검사 또는 신원조회로 거절이 해당 비자신청이 된 경우)

• A TSS visa holder leaves the sponsoring employer within the first 12 months of employment where the visa period was for more than 12 months. Refunds will only be available in this scenario for unused full years of the SAF levy. Note:This does not apply to ENS or RSMS holders who leave their employer within the first 12 months of employment.
• The nomination fee is refunded (for example where a concurrent sponsor application is refused).

What about the training benchmarks?

The training benchmarks will no longer apply from 12 August 2018.

For ENS and RSMS visas, the training benchmarks will only apply to nomination applications lodged before 12 August 2018. (2018

For TSS visas, the sponsorship obligation regarding the training benchmarks will only apply for the 12 month period ending on or before 12 August 2018.

Sponsorship accreditation (스폰서쉽 인증)

This page provides information regarding accreditation for standard business sponsors who sponsor overseas workers under the TSS visa.

Why apply for sponsorship accreditation

Sponsors who qualify for accredited status will receive priority processing of all TSS nomination and visa applications, with most applications processed in less than five days.(TSS 노미네이션 및 비자 신청을 위해서 우선 처리가 되고5일 안에 처리가됨)

Certain low risk TSS nomination applications lodged by sponsors granted accredited status after 1 July 2016 will receive streamlined processing.

How to apply for sponsorship accreditation (신청 방법)

You can apply for accredited status (using the same online forms) when you apply to become a standard business sponsor or when you renew your existing sponsorship.

If you do not meet the characteristics for accredited status, your application for standard business sponsorship will still proceed and be assessed in the usual way.

Who can apply for accreditation (신청 자격)

To be approved for accredited status, you must meet standard sponsorship requirements, as well as the additional characteristics for one of the four categories listed below at the time of application:

Important information if you already live in Australia

Before applying for Australia’s Northern Territory (NT) Government nomination you must have:

• lived in the NT for at least six months
• worked in your skilled occupation or closely related field in the NT for at least six months.

There are variations to these rules in certain cases.

• International student graduates and holders of Skilled Graduate (Subclass 485) visas who have not completed at least two years of study at a college or university in the Northern Territory
• Northern Territory graduates who have successfully completed at least two years of study at a college or university in the Northern Territory
• Working Holiday (Subclass 417) and Work and Holiday (Subclass 462) visa holders
• Temporary Work (Skilled) (Subclass 457) visa and Temporary Skill Shortage visa (Subclass 482)
• Training visa (Subclass 407)

International student graduates and holders of Skilled Graduate (Subclass 485) visas who have not completed at least two years of study at a college or university in the Northern Territory

Conditions also apply to: (NT

• international student graduates
• former international student graduates who have completed their eligible studies at a college or university that is not in the Northern Territory (NT).

If you are in this group the NT Government will consider applications only when you have done all of the following:

• completed the course of study for which your student visa was granted
• lived in the NT for at least six months (NT 거주 조건 6개월)
• worked full time in the nominated skilled occupation or a closely related skilled occupation for six months in the NT immediately before applying for NT nomination (NT 경력조건 6개월)
• been paid at the NT market rate for the skilled occupation in which you have been employed in the NT for six months (NT 급여조건)
• demonstrated a genuine intention to live and work in the NT for at least two years after your visa is granted.

These students will generally only be considered for Subclass 489 visa nomination however, the NT Government will decide on applications for Subclass 190 nominations on a case-by-case basis. Exceptions may be considered.

Northern Territory graduates who have successfully completed at least two years of study at a college or university in the Northern Territory (NT

The Northern Territory (NT) Government will accept applications from eligible NT graduates.

You must have successfully completed the study course for which you received your student visa.

The study period must have been full-time and over at least two years at any NT college or university.

You must provide:

• a letter showing your commitment to the NT
• six months of bank statements showing transactions as evidence of living in the NT.

“Arresting population decline and boosting economy”

The strategy mentions research conducted by the Charles Darwin University’s Northern Institute which found five years is the tipping point after which new residents are most likely to remain long-term.

Forecasts show the Territory’s population is likely to fall by 0.7 per cent this financial year.

This population plan aims to arrest that decline and return growth to its historical average of 1.4 per cent.

If this growth is achieved, Mr Gunner said it would add about 21,000 jobs and more than $10 billion to the economy over the next decade.

In addition, the Northern Territory Government will also negotiate a refreshed Designated Area Migration Agreement (DAMA II) with the Commonwealth Government to allow Territory employers to sponsor skilled and semi-skilled overseas workers in areas experiencing skill and labour shortages.
The Northern Territory wants more people to come and live up north and is offering cash incentives to families, couples and individuals willing to do so.

The government says it will invest $9.3 million to attract more people, including migrants, to the Territory with families being  offered more than $15,000 over five years to move to NT to work in “high priority jobs”.

This announcement is part of the Northern Territory Population Growth Strategy 2018-2028, where the government hopes to add 21,000 new jobs and $10.4 billion to the NT’s economy in the next decade.

• Section 137Q – RSMS

ENZC (Eligible New Zealand Citizen)

What is an eligible New Zealand citizen?

An Eligible New Zealand Citizen (ENZC) is a person who is defined as a ‘protected SCV’ holder under the Social Security Act 1991. Protected SCV holders are those who arrived in Australia on a New Zealand passport and were: (Protective SCV 비자는 NZ여권을 소지하고 호주에 살았던 사람들로 다음과 같은 조건을 만족해야 함)

• in Australia on 26 February 2001 (2001년 2월 26일에 호주에 거주하고 있던 NZ시민권자)
• in Australia for 12 months in the 2 years immediately before this date
• assessed as protected SCV holders before 26 February 2004.

An ENZC can sponsor family members for an Australian permanent visa.

How have changes over time affected New Zealand citizens in Australia?

Changes to travel arrangements

Reflecting our similar histories, the Australian and New Zealand Governments have had arrangements in place since at least the 1920s to assist a free flow of people between the two countries. The current arrangements have been in place since 1973.

1973

The Trans-Tasman Travel Arrangement was introduced. The joint report released by the Prime Ministers of Australia and New Zealand (The Hon E.G. Whitlam QC MP and the Hon N.E. Kirk MP) on 22 January 1973 stated: (

“The Prime Ministers agreed that citizens of each country and citizens of other Commonwealth countries who have resident status in either Australia or New Zealand should henceforth be able to travel between Australia and New Zealand, for permanent or temporary stay, without passports or visas.” (Productivity Commission 2012)

A series of ministerial-level agreements and understandings, dating from 1973 onwards, established a Trans-Tasman Travel Arrangement, which helped the entry of Australian and New Zealand citizens into one another’s country to visit, live and work without needing visas or permits.

1 July 1981

The Hon I.M. Macphee MP, Minister for Immigration and Ethnic Affairs, announced that all those entering Australia under the Trans-Tasman Travel Arrangement were required to carry a passport valid for travel from this date.

This change was introduced on 1 July 1981 and at the same time Australia ended the previous arrangement where New Zealand permanent residents, who were citizens of other Commonwealth countries, were included under the Trans-Tasman Travel Arrangement.

1 September 1994

This date represented the commencement of supporting regulations to the Migration Reform Act. Under transitional Regulation 17, any New Zealand citizen who was not granted another visa on that day (either through another transitional regulation or an Act-based visa) was granted a SCV. The Special Category visa (subclass 444) was introduced on this day as a temporary visa.

Before this date, a New Zealand citizen who was in Australia as an exempt non-citizen was considered a permanent resident under theMigration Act 1958.

Entitlements to services and benefits

Within most Australian Government legislation, New Zealand citizens who live in Australia are defined as Australian residents. This means you have access to many of the services and benefits that apply to Australian citizens and permanent residents, including Medicare and Commonwealth-funded education places. The following information is provided in relation to the most common issues raised with us by New Zealand citizens living in Australia.

Social Security

Until 1986, both countries provided unlimited access to all social security payments and public health systems for each other’s citizens. In response to the substantial increase in the number of New Zealand citizens living in Australia, however, Australia tightened access to social security at various times, with the New Zealand Government often partially matching these various limits. (Productivity Commission 2012).

New Zealand citizens living in Australia today might be eligible for a number of social security benefits and services, including:

• child-related social security (such as baby bonus, child care benefit, parental leave pay)
• family tax benefits
• concession cards
• Age pension (under the bilateral agreement)
• Disability support pension (under the bilateral agreement)
• Carer Payment (under the bilateral agreement)
In all cases, specific entitlement can only be confirmed by the Department of Human Services (DHS). Information or clarification on what is covered under the bilateral agreement can be obtained from DHS or NZ Work and Income (a part of the New Zealand Ministry of Social Development).

Information on the changes over time in Australia, (source: Productivity Commission 2012), with specific detail on the effect of the 2001 changes, is:

1986

A six-month waiting period was introduced for New Zealand citizens in 1986 for access to unemployment income support payments. At the time there was no waiting period that applied to holders of a permanent entry permit.

1996

The Newly Arrived Residents Waiting Period was introduced in 1996 for Australian permanent residents. This period was usually for two years and applied to all new permanent residents but was not extended to SCV holders.

2000

In 2000, a two-year waiting period was introduced for SCV holders to align the arrangements for New Zealand citizens with those that applied to new permanent residents.

On 26 February 2001, a new bilateral social security agreement between Australia and New Zealand was announced. This agreement set out arrangements for payment of age pension, disability support pension and carer payment (and their New Zealand equivalents) to the citizens of Australia and New Zealand when living in the other country. New Zealand citizens have access to these payments under the criteria set out in the bilateral agreement.

This bilateral agreement also recognised the right of each country to determine access to social security benefits not covered by the agreement, and to set related residence and citizenship rules according to the respective country’s national legislative and policy frameworks. In line with that principle, a number of supplementary changes were announced by Australia.

As a result, the Social Security Act 1991 requires New Zealand citizens who arrived in Australia after 26 February 2001, to apply for and be granted an Australian permanent visa if they wish to access certain social security payments (including income support payments) not covered by the bilateral agreement. To support this social security change, amendments were also made to citizenship and migration legislation to require New Zealand citizens to become permanent residents if they want to be eligible:

• for Australian citizenship, or
• to sponsor family members for a permanent visa.

Under transitional arrangements, these changes did not affect New Zealand citizens who:

• were in Australia on 26 February 2001 as Special Category visa (subclass 444) holders
• were outside Australia on 26 February 2001, but were in Australia as an SCV holder for a total of 12 months in the two years before that date, and subsequently returned to Australia
• had a certificate issued under the Social Security Act 1991, stating that they were living in Australia on a particular date. These certificates are no longer issued.

2016

On 19 February 2016, to acknowledge the special bilateral relationship between Australia and New Zealand, the Australian Government announced an additional pathway to permanent residence, for New Zealand citizens who are long-term residents in Australia in addition to those already available through our migration programme.

This additional visa pathway commenced on 1 July 2017 for New Zealand citizens who were usually resident in Australia on or before 19 February 2016 (the date of the announcement) had lived in Australia for the five years immediately prior to submitting their application, and shown a commitment and continuous contribution to Australia.

The pathway exists within the Skilled Independent category of the General Skilled Migration (GSM) component of Australia’s annual Migration Programme. It provides many New Zealanders an option to pursue permanent resident status, which will enable them to apply for Australian citizenship.

On 1 July 2017, this additional pathway became a new stream within the Skilled Independent (subclass 189) visa. The pathway is for New Zealand Special Category (subclass 444) visa (SCV) holders who were usually resident in Australia on or before 19 February 2016 and who, at the time of lodging an application, have resided in Australia for at least five years. These new arrangements will give many New Zealand citizens permanent residence status, if they meet certain criteria, including:

• contributing to Australia, demonstrated through income tax returns which show taxable income at least equivalent to the Temporary Skilled Migration Income Threshold (TSMIT) for the qualifying period; and
• meeting mandatory health, character and security checks.

New Zealand citizens who are granted this visa will be eligible to apply for Australian citizenship after a period of 12 months (in addition to the five years as an eligible New Zealand SCV holder).

2017

On 1 July 2017, the definition of eligible New Zealand Citizen (ENZC) was amended to align with Australian social security law. Refer to Eligible New Zealand Citizens (ENZC) further on this page.

The points table

Conditions apply

PY (Professional Year) In Australia

Part 6D.6    Australian professional year qualifications

Item	At the time of invitation to apply for the visa, the applicant had completed …	Number of points
6D61	a professional year in Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 12 months in the 48 months immediately before that time

Australian professional year (PY) factor

About the PY factor

Applicants are eligible for points under Part 6D.6 only if they have, in the relevant period, completed a professional year (PY).

The PY is a structured professional development program combining formal learning and workplace experience. As the focus is on developing skills that will assist applicants to secure employment, PY courses will not be specified without industry support.

There are currently three PY programs for which points can be awarded:

• Accounting
• Engineering and
• Computing.

If an applicant has claimed PY points and their details are not included in the relevant list of PY graduates, decision makers should email the Independent Skilled mailbox for further assistance.

Part 6D.11    Partner skill qualifications

Item	Qualification	Number of points
6D111	The spouse or de facto partner of the applicant (the primary applicant): (a)  is an applicant for the same subclass of visa as the primary applicant; and (b)  is not an Australian permanent resident or an Australian citizen; and (c)  was under 45 at the time the invitation to apply for the visa was issued to the primary applicant; and (d)  at the time of invitation to apply for the visa, nominated a skilled occupation, being an occupation specified by the Minister under paragraph 1.15I(1)(a) at that time; and (e)  at the time of invitation to apply for the visa, had been assessed by the relevant assessing authority for the nominated skilled occupation as having suitable skills for the occupation and the assessment was not for a Subclass 485 (Temporary Graduate) visa; and (f)  at the time of invitation to apply for the visa, had competent English	5

(at the time of invitation to apply for the visa 라고 명시되어 있죠.)

Part 6D.4    Australian employment experience qualifications

Item	At the time of invitation to apply for the visa, the applicant …	Number of points
6D41	had been employed in Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 12 months in the 10 years immediately before that time	5
6D42	had been employed in Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 36 months in the 10 years immediately before that time	10
6D43	had been employed in Australia in: (a) the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 60 months in the 10 years immediately before that time	15
6D44	had been employed in Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 96 months in the 10 years immediately before that time	20

Part 6D.3    Overseas employment experience qualifications

Item	At the time of invitation to apply for the visa, the applicant …	Number of points
6D31	had been employed outside Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 36 months in the 10 years immediately before that time	5
6D32	had been employed outside Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 60 months in the 10 years immediately before that time	10
6D33	had been employed outside Australia in: (a)  the applicant’s nominated skilled occupation; or (b)  a closely related skilled occupation; for a period totalling at least 96 months in the 10 years immediately before that time	15

6D.5 – Aggregating points for employment experience

Australian and overseas employment experience factors are assessed separately, subject to the maximum number of points that can be awarded for any combination of skilled employment experience being set at 20. This is consistent with the overall policy objectives of the points test settings being a mechanism for selecting applicants who present an optimal mix of attributes across a range of qualifications, and to ensure that disproportionate weight is not given to any one factor.

(이 내용이 any combination of skilled employment experience being set at 20 이랍니다.)

Remunerated at least 20 hours a week

Working for at least 20 hours a week means 20 hours each week generally. However, where employment contracts provide for variable distribution of hours of work that extend beyond a week such as some shift workers, “fly in fly out” workers and seafarers, decision makers can take this into consideration in determining whether a person has worked ‘at least 20 hours per week.’

How do I know that I can trust my migration agent?

The best way to make sure that the person you are seeking migration advice from is someone you can trust is to check that they are a migration agent listed on the Office of Migration Agents Registration Authority website.

Here is a list of things that illegal operators might say to you:

I can guarantee that you will get a visa to Australia

This is false (이 말은 거짓 말이다 왜?

• No-one can guarantee you will get a visa. Only our authorised officers can give you a visa and only when you have met all the visa requirements.
• Avoid internet sites and advertisements that say they can guarantee you will get a visa.

Pay now to register for the migration program

This is false (이 말도 거짓말이다. )

• You pay your visa application charge when you lodge your visa application. A list of all charges is available at Fees and Charges. If you are asked to pay money before you lodge your visa application, do not pay it.
• A list of fees that a registered migration agent might charge is available on the Office of the Migration Agents Registration Authority (이민법무사 컨설팅 비와 관련하여 일련의 비는 이민법무사 등록관리 기관인 Office of the Migration Agents Registration Authority사이트에 가면 볼 수 있다)

This is a ‘once in a lifetime opportunity’ or your ‘only’ chance to travel or migrate to Australia

This is false (이것도 거짓말이다.

• We do not telephone or email people offering ‘deals’. We will only contact you about your visa application after you have lodged it.
• You might have several visa options for coming to Australia.

Only I can pay the charges, give me your money and I will pay the charges for you

This is false (이 말도 순 거짓말이다.

• You can pay your own visa application charge.
• A registered migration agent is required to provide you with a statement of services which includes an estimate of fees to be paid.
• If you lodge your visa application in Australia, you can pay us directly. We will never ask you to pay into a personal bank account or transfer money through a private company.
• If you lodge your visa application outside of Australia and use one of our Service Delivery Partners, they could add an extra charge when you lodge your visa application. Go to the How to Paywebsite to make sure you are dealing with one of our Service Delivery Partners and to check how much you will need to pay them.
• Get a receipt for any money that you pay and check the receipt to see that is says what the money was paid for.

I have a special relationship with the Department of Home Affairs

This is false (이 말도 거짓말이다.

• No one has a special relationship with us. We treat all visa applications in a fair and impartial way.
• If someone tells you they are a ‘skilled migration service provider’ or they are ‘Australian Government registered’ or ‘department registered’ do not deal with this person.
• Look for the words ‘Migration Agent Registration Number’ or ‘MARN’ on your agent’s website, or in their advertising, to be sure you are dealing with a registered migration agent.

Don’t worry, the Department of Home Affairs is still processing your visa (걱정하지 마라!

Do not just accept this

• Ask for a copy of the confirmation letter. If your registered migration agent cannot give you a copy,  contact us directlyto check the progress of your visa application.
• If you lodge your visa application online, we will give you a Transaction Reference Number (TRN). To check the progress of your visa application, you will need to login to ImmiAccount. If you do not have an ImmiAccount you will need to create one and you can use your TRN to import your application.
• You are responsible for your visa application. You should know what documents you need to submit with your visa application and make sure you submit them. If your registered migration agent or our Service Delivery Partners or visa officials ask you for more documents, make sure you submit them on time.

I need to keep your original documents such as passport, birth certificate to give to the Department of Home Affairs

• We will sometimes want to see your original documents. If we want to see you original documents, one of our visa officers will ask you for them.
• Usually we want only certified copies of your original documents. Registered migration agents can certify the copies of your original documents that you are sending to us.
• If you lodge an online student visa application, your registered migration agent might ask to see your original documents. If they ask for your original documents, ask them to make a copy and give them back to you immediately.
• Prevent identify fraud – never leave your original documents with other people.
