2. X-ray

The ACT Government is contacting its previously nominated 190 visa holders to ensure they have complied with their commitment of living and working in the ACT for two years following visa grant.

The ACT Government may refer non-compliant visa holders to Home Affairs as part of its annual reporting.

ACT nominated 190 visa holders who have not complied with their commitment may receive notices of intention to consider cancellation from Home Affairs.

To assist DIBP, TRA will provide a ‘skilled date’ on your outcome letter as part of your assessment. Your skilled date is determined through an assessment of the employment evidence supplied with your application and how you obtained your qualification. This means if you have a qualification issued internationally or gained an Australian qualification by study, the ‘skilled date’ will be the date the qualification was issued. If you obtained an Australian qualification through RPL, your ‘skilled date’ is when you completed your first three years of verifiable, eligible employment in your nominated occupation. TRA considers the first three years as being an informal training period.

Fact Sheet: 2018-19 Migration Program planning levels

Migration Program planning ceilings

The Migration Program is designed to achieve a range of economic and social outcomes. The program is set annually, with the total places available capped at a ceiling of 190,000 for 2018-19, unchanged from 2017-18. The total program is broken down into the following streams:

• Skill– designed to improve the productive capacity of the economy and fill skill shortages in the labour market, including those in regional Australia. This represents most places offered (128,550 places in 2018-19).
• Family– is predominately made up of Partner visas, enabling Australians to reunite with family members from overseas, and provide them with pathways to citizenship (57,400 places in 2018-19).
Fact Sheet – Overview of family stream migration has more information.
• Special Eligibility– this covers visas for those in special circumstances that do not fit into the other streams. This can include permanent residents returning to the country after a period away, and is the smallest stream (565 places in 2018-19).
More information is available in Fact Sheet – Special Eligibility Stream.

At least 3,485 Child places will be available in 2018-19.

^* As a percentage of the Migration Program.

Program size and composition

The size and composition of the Migration Program is set each year through the Australian Government’s Budget process. It is informed following broad public consultations with stakeholders, including business and community groups from all states and territories. Community views, economic and labour force forecasts, international research, net overseas migration and economic and fiscal modelling are all taken into account when planning the program.

State nomination requirements

Applicants can be nominated through one of two streams.

1 The general stream; for applicants who meet the minimum requirements for State nomination and have an available occupation on the Western Australian skilled migration occupation list eligible for the intended visa subclass.
2 The graduate stream; for applicants who meet the minimum requirements for State nomination and additional requirements applicable to this stream, and have an available occupation on the Graduate occupation list eligible for the intended visa subclass. Additional requirements include having gained a higher education qualification in Western Australia, including at least two years of full time study in Western Australia at a Western Australian university.

Masters and PhD graduates will have access to all occupations on the Graduate occupation list. Bachelor and higher degree graduates will only be able to access some of the occupations on the Graduate occupation list. Check the Graduate occupation list to determine if your qualification type is eligible for your intending occupation. The university qualification you gain in Western Australia does not need to determine the occupation you wish to nominate from the Graduate occupation list for State nomination.

Overview of stream requirements

Table 1

*Higher degree refers to Bachelor Honours Degree, Graduate Certificate or Graduate Diploma
**PhD refers to a Doctor of Philosophy

State nomination minimum requirements for both streams

Meet Department of Home Affairs requirements for the intended visa subclass

You must meet the Department of Home Affairs’ eligibility requirements for your intended visa subclass, being:
• the Skilled Nominated visa (Subclass 190); or
• the Skilled Regional (Provisional) visa (Subclass 489).

Meet English requirements

You must demonstrate at least the minimum English language requirements applicable to your occupation and stream through an approved English test, listed below. If you have a passport from the United Kingdom, Canada, New Zealand, the United States of America or Ireland, you are not required to sit an English exam to be eligible for Western Australian State nomination.

Some assessing authorities require an English test result as part of the skills assessment process.

All applicants applying through the graduate stream, and applicants applying through the general stream who are nominating an ANZSCO Major Occupation Group 1 (Managers) or Group 2 (Professionals) occupation, must demonstrate a ‘Proficient’ level of English, outlined in the following table.

Table 2a

All other occupations for the general stream must demonstrate the minimum English requirement, outlined in the following table.

Table 2b

Demonstrated the minimum required work experience in nominated occupation

Be able to claim and give evidence of work experience in your Expression of Interest. This requirement can be met through: (경력조건)

• at least one year of Australian work experience in the nominated (or closely related) occupation** over the last 10 years; or (10년중 1년 경력 – 호주내)
• at least three years of overseas work experience in the nominated (or closely related) occupation over the last 10 years.

WA Migration Services will assess your work experience in line with the Department of Home Affairs requirement, which specifies work experience must be gained post-qualification and via paid employment. You must have worked at least 20 hours per week in the specified occupation. See the frequent questions about State nomination page for further information relating to work experience requirements.

If you are using the graduate stream and hold a Western Australian PhD or Masters Degree, the work experience requirement is waived for your Western Australian State nomination.

**WA Migration Services does not conduct work experience assessments and defers to the relevant assessing authority as to the suitability of work experience for points.

Provide a contract of employment

All applicants must have a contract of employment for full time employment for at least 12 months in Western Australia in the nominated (or closely related ) occupation. If you are intending to apply for a Subclass 489 visa, the contract must be for employment located in a regional area of Western Australia.

Your application must include a copy of a signed employment contract from your employer that includes:

• full names of both the employer and the employee;

• contract start date and end date (if permanent, only start date is required);

• job description of the work to be performed by the employee;

• the terms and conditions of employment (include the position’s salary, hours of work, leave entitlements, superannuation, among other things) that are no less favourable than those that would apply to an Australian citizen or permanent resident doing equivalent work;

• location of employment;

• a statement that work specified in the employment contract must be performed by the employee and not contracted out to a third party;

• a signed and dated employment contract by the employer and the employee and and provided as one document; and

• must be drafted by the employer and not by the employee.

Full time employment is defined as “on average at least 35 hours of work per week.

You may provide two employment contracts which equal at least 35 hours of work per week.

You can submit your contract of employment when you lodge your application for State nomination with WA Migration Services.

Demonstrated sufficient settlement funds

If you live outside of Western Australia, one of the conditions of State nomination is that you bring sufficient funds into the State to cover your settlement costs.
The minimum amount of funds required is: (최소 자금)

• for a single person – $20,000 (AUD);
• for a couple – $30,000 (AUD); and
• for every additional dependant – $5,000 (AUD).
You will be asked during the State nomination application process to show evidence of these funds through bank statements or asset valuations.

Additional requirements for graduate stream

Occupation on the Graduate occupation list
Your nominated occupation must be listed as available for the intended visa subclass on the Graduate occupation list and be eligible for your intended qualification type; being either:

• PhD and Masters graduates; or (석박사 학위)
• Bachelor and higher degree graduates.

To be eligible to be invited to apply for Western Australian State nomination you must have gained your qualification in Western Australia at a Western Australian university.
Western Australian study
You will be required to show proof of at least two academic years of full time study in Western Australia at a Western Australian university. You will need to provide your award certificate, along with transcripts clearly showing two years full time study in Western Australia. This will be requested as part of your State nomination application.
Full time study

Full time study is determined by the applicant’s educational institution.
Please note the onus is on the applicant to sufficiently demonstrate evidence of full time study.
Work experience
If the work experience requirement is applicable to your nominated occupation and qualification type, detailed work experience information is outlined above.

The work experience requirement is waived for applicants with a Western Australian Masters or PhD qualification applying for Western Australian State nomination.
English requirement

All applicants applying through the graduate stream must demonstrate proficient English skills outlined in Table 2a.

“So close, yet so far” is how Wei “Mira” Chen, a Chinese national describes her situation after failing to get a permanent Australian visa twice despite having been sponsored by a reputed employer.

The 29-year-old found a job as a junior chef at Jamie’s Italian restaurant in Sydney during her industry training and was later transferred to a restaurant in Perth that was short on experienced staff. In December 2015, the company sponsored her under the Regional Sponsored Migration Scheme (RSMS) for a permanent visa.

“I flew to Perth to start my new life in Perth just two weeks after my graduation,” she tells SBS Punjabi.

While her visa application was still under process, the Keystone Group that owned six Jamie’s Italian restaurants in Australia, went into voluntary administration in mid-2016 and was no longer able to guarantee her employment for two years as per her employment offer.

“The processing time for an RSMS visa was 13 months at that time and it had been just about six months since I started my job. My visa application was refused by the Immigration Department because my job wasn’t certain,” she said.

“What makes it worse, Perth had been removed from regional areas in March 2017, which means RSMS visa is no longer available in Perth metro area.”

While she continued to work at the Perth restaurant, the Australian chain was bought back by Jamie’s Italian Restaurant Group in 2017 and her new employer once again sponsored Ms Chen’s RSMS visa to work at the company’s restaurant in Canberra.

“My husband and I moved a long way from the east coast to the west coast, and back to the east coast again. We travelled six days driving from Perth to for this job and settled down in Canberra,” she said.

But she had another setback in April this year when Jamie’s Italian shutdown its Canberra restaurant before a decision on Ms Chen’s visa application was made. She says the staff weren’t given any notice before ending their employment.

“The company terminated our contract in an improper manner- I felt like being dumped as garbage when I was told over a phone call not to come to work,” Ms Chen says.

Her second application for a visa sponsorship while working at the same restaurant was refused last month. She is now fighting for compensation for her leave entitlement and mandatory notice period.

The Department of Home Affairs, in refusing her visa, acknowledged that Ms Chen had been “negatively impacted” by circumstances that were outside of her control.

“She has been negatively impacted by two businesses running the same restaurant group going into administration over a period of 2.5 years. However, these factors could not override the requirements of the nomination application,” a Department official said while refusing her visa nomination.

“I failed in my visa attempt twice in the same business where I had been working for three years, in three different cities, from east to west, and now I have ended up with a situation that I am forced to leave the country without any entitlements paid,” she rues.

Samuel Lau, a Malaysian national is also in the same situation. His June 2016 application for an RSMS visa was refused after a Perth restaurant that sponsored him decided to shut shop in March 2018 while his application was still being processed.

Thirty-seven-year-old Mr Lau, currently earning a living by driving for Uber, says the experience has left him fearful of such arrangements where everything depends on the employer.

“It’s so unfair. I did everything right and the employer just sells his business and I got caught up in the situation,” Mr Lau tells SBS Punjabi. “I can’t go through this again because another shifty employer may do the same.”

Mr Lau has appealed the decision in the Administrative Appeals Tribunal and also applied to the Immigration Minister for his intervention.

Jujhar Bajwa of Bajwa Immigration Consultants says the processing times for the visa have ballooned in recent years.

“Until four or five years ago, these visas were granted within a month. However, the Department has recently made us aware of its concerns about a high incidence of fraud in this category,” he says.

Mr Bajwa says employer nominated visas are “inherently risky”.

“In these visas, everything depends on the employer. We see many such cases where businesses are sold while nomination applications are still under process,” Mr Bajwa says.

He says refusal rates of RSMS applications are very high.

“Nearly seven out of ten RSMS applications are refused due to concerns about the company’s finances and the employers’ ability to pay an employee for two years on an on-going basis.”

Ms Chen says a long waiting period for visa processing is as much responsible for her situation as her employers shutting the business.

“The longer it takes the riskier it gets for applicants who have no control over the business. I did nothing wrong but ended up wasting my time, money, the hard work in vain and there is nothing I can do about it,” she says.

Australian Study Requirement (2 year full-time study 조건) 를 만족할 경우 5점을 추가로 줍니다.

The requirement that they are physically present in Australia when  undertaking their studies aims to ensure that visa applicants have the opportunity to forge links with communities, prospective employers and to become more familiar generally, with living in Australia.

Study in regional or low-population growth metropolitan Australia

The points awarded under 6D.10 for study in regional Australia or a low-population growth metropolitan area (LPGMA) recognise the important contribution migrants make to regional Australia. Awarding points for 6D.10 is intended to encourage permanent settlement in regional Australia and some metropolitan areas with low population growth rates.

Applicants are eligible for 5 points if they have met the Australian study requirement while living and studying at an Australian educational institution in a regional area or LPGMA, if none of the study constituted distance education – refer to PAM3: Div1.2/reg1.15F – Australian study requirement.
