Joint media release with Senator the Hon. Richard Colbeck – International students ready to fill critical staff shortages in aged care

The Hon Alan Tudge MP is currently acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs

Aged care providers will temporarily be able to offer more hours to international students to ensure the care of senior and vulnerable Australians, as part of the campaign to combat the impact of coronavirus.

Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge said international students would help fill critical staff shortages emerging in the sector.

“As more workers take leave to quarantine or because of health concerns, we need to make sure there are enough staff to look after our older Australians who are particularly vulnerable to coronavirus,” Mr Tudge said.

“Many international students already work in the aged care sector but are restricted to 40 hours a fortnight. We’re relaxing those limits to help fill the temporary staff shortages.

“This follows similar concessions to major supermarkets to keep shelves stocked with essential items.

“We will continue to listen to businesses as the coronavirus situation develops and may consider expanding these measures to assist other sectors if and when required. We will also consider providing flexibility with other temporary visas should the need arise.”

The measures will be administered by the Department of Home Affairs and are available to approved providers of Commonwealth-funded aged care services, only for existing employees.

Providers can register with the Department if they believe the changes will assist them.

Employers are still required to abide by all relevant Australian workplace laws.  Students have the same rights under Australian workplace law as all other employees.

Minister for Aged Care and Senior Australians Senator Richard Colbeck said COVID-19 affects older Australians more than others and this is putting a huge strain on many aged care providers and workers.

“Residential aged care providers are limiting visits to help prevent and control the spread of COVID-19,” he said.

“Further restrictions are being considered – but it’s critical we plan for a scenario where a large part of the aged care workforce is unable to come to work.

“Today’s announcement expands existing temporary arrangements relaxing visa work conditions to the aged care sector, applying to both residential and home care.

“Aged Care providers have told me that a relaxation of student visa work conditions would support their workforce continuity in the face of COVID-19 challenges.

“These are temporary measures and are solely designed to address staff shortages.

“The Government will continue to work closely with the sector to ensure we have strongest possible workforce in place as we deal with this extraordinary health challenge,” he said.

More information is available on the Department of Home Affairs website or the Global Service Centre on 131 881.

English language

Meet the English language requirements as specified on the Visa Nomination Occupation Lists.

All applicants must have an International English Language Testing System (IELTS) score of at least six in each band score. Certain occupations require a higher standard of English for the purpose of state nomination – these occupations are specified on the Visa Nomination Occupation Lists. Applicants who are currently working in their nominated occupation in Victoria and have been for at least six months, may be exempt from meeting higher English language requirements and should apply for nomination.

Alternative English language tests are accepted.  Applicants can obtain the IELTS equivalent in any of the following Department of Home Affairs’ accepted language tests: OET, TOEFL iBT, PTE Academic and Cambridge English: Advanced (CAE).

You must upload a scanned copy of your English language test result as part of the online nomination application. Please ensure that your English test result is valid for at least 12 weeks at the time of submitting a visa nomination application.

PTE is continuing to reopen our test center network in more countries and cities globally. Testing for PTE Academic for all Australian and New Zealand visas as well as PTE as a SELT (Secure English Language Test) for UK Visa & Immigration purposes is available in over 40 counties.

In Australia, we  reopened our national Pearson Professional Centre network of test centres  and saw the majority of our partner sites such as UNSW, UQ, RMIT and Navitas resume delivery of test sessions in June.

In addition to our existing network we have added more capacity to meet the high demand for testing through the opening of additional centres in Melbourne and Sydney.

All test centers have been opened in strict compliance with local authority requirements and with all necessary health and safety measures, in light of Covid-19.

Last update: 2020

PTE Academic COVID-19 update

As efforts to control the Coronavirus outbreak continue, Pearson’s primary focus is on ensuring the health and safety of PTE Academic test takers, our employees and test center administrators. We continue to monitor the global situation daily and are actively following advice from governments and healthcare authorities.

Suspension of Testing

We have suspended testing in a number of our locations. In other locations, we are restricting the number of test takers in each session in order to comply with official requirements and in the interests of protecting test takers and test center administrators. A full list of locations and information about testing is available here.

Free resources to help test takers prepare

As part of our efforts to support test takers during this difficult time, we are now providing increased access to digital preparation products. More details about available resources can be found below and regular updates can be found here.

To help test takers to prepare for their PTE Academic exam they can complete the MOOC Introduction to PTE Academic developed with E2Language. It provides guidance videos on each of the question types, advice on how to approach each question, and more free practice! Access it here.

They can also get 90 days free access to E2School to help with grammar, punctuation and general English! Learn more here.

Plus we have more free resources on offer here.

1.1.N.70 Newly arrived resident’s waiting period (NARWP)

Usage

The NARWP applies to the following payments and benefits:

• jobseeker payment
• youth allowance
• parenting payment
• special benefit
• austudy payment
• mobility allowance
• sickness allowance
• pensioner education supplement
• farm household allowance
• Commonwealth seniors health card
• low income health care card
• carer payment
• parental leave pay
• dad and partner pay
• carer allowance
• FTB Part A.

Definition

The NARWP is a period of time migrants must have been an Australian resident and in Australia before receiving certain payments or concession cards.

A 26 week waiting period was introduced from 1 January 1993 for selected payments. From 4 March 1997, it was extended to 104 weeks and a wider range of payments. From 1 January 2019, the NARWP was further extended to 208 weeks for various working age payments and concession cards; and new waiting periods of 208 weeks, 104 weeks and 52 weeks were introduced for a range of other payments.

From 1 January 2019: (2019

• a 4 year (208 week) NARWP applies to
  • jobseeker payment
  • youth allowance
  • parenting payment
  • special benefit
  • austudy payment
  • mobility allowance
  • sickness allowance
  • pensioner education supplement
  • farm household allowance
  • Commonwealth seniors health card
  • low income health care card
• a 2 year (104 week) NARWP applies to
  • carer payment
  • parental leave pay
  • dad and partner pay
• a 1 year (52 week) NARWP applies to
  • carer allowance
  • FTB Part A.

There is no NARWP for FTB Part B. (FTB 파트 B는 대기시간 없이 즉시 받을 수 있음)

Under social security law, a NARWP means:(사회복지법에 근거하여 각각 관련 법을 달아 둠)

• a CP NARWP under sections 201AA and 201AB, or
• a CA NARWP under sections 966 and 967, or
• a YA NARWP under section 549D, or
• an Austudy NARWP under section 575D, or
• a PES NARWP under section 1061PU, or
• a JSP NARWP under sections 623A and 623B, or
• an SA NARWP under sections 696B and 696C, or
• an SpB NARWP under sections 739A, or
• a MOB NARWP under sections 1039AA and 1039AB, or
• a CSHC NARWP under section 1061ZH, or
• a PP NARWP under section 500X and 500Y, or
• a HCC NARWP under section 1061ZQ.

See FA Guide and PPL Guide for details of NARWP for FTB Part A, PLP and DAPP.

Note: The NARWP also applies to the farm household allowance (FHA). FHA is paid under the Farm Household Support Act 2014 on behalf of the Department of Agriculture, Water and the Environment. The NARWP for FHA operates similarly to the NARWP for JSP. Please refer to JSP for policy guidance.

Note: A NARWP applies to PA under section 771GNA (3.3.1.10). However, as PA has been closed to new entrants since 20 September 2003, this information is for historical purposes only.

Note: A NARWP previously applied to NSA and BVA. These payments ceased from 20 March 2020 with the creation of the JSP.

There are a number of exemptions from the NARWP and situations where a NARWP does not apply. These exemptions are listed in 3.1.2.70 and 3.1.2.43.

You must apply for a new visa before your current visa expires. You may be eligible to be granted a bridging visa that will keep you lawful until a decision is made on your visa application. See what you need to do to stay longer.

No further stay condition (includes 8503, 8534 and 8535)

This means you can’t apply for most other visas until you leave Australia. If your visa has less than 2 months validity remaining you can request to waive this condition.

Condition 8558 (Non-resident cannot stay for more than 12 months in any 18 months period)

You will need to apply for a new visa that suits your new needs. Explore your visa options.

If your visa has expired, you need to apply for Bridging E visa (BVE) immediately in order to become lawful. A BVE keeps you lawful while you make arrangements to leave or finalise your immigration matter.

Complying with visa conditions

Can’t enter before required entry date

For temporary visa holders, you will need to apply for a new visa once the travel restrictions are lifted. Permanent visa holders should contact the departmental office which granted their visa, but only when they are able to travel.

Can’t provide additional information due to office closure (Health or Police clearances, Biometrics, English Language Testing)

You will be given additional time to complete checks and provide requested information. You do not need to contact us to ask for an extension while the relevant services are unavailable.

Can’t return to Australia before my visa expires and want to return

You will need to apply for a new visa once the travel restrictions are lifted.

Can’t return to Australia in time for my new visa which requires me to be in Australia at time of application or grant

You will need to apply for a new visa once the travel restrictions are lifted.

Can’t complete Australian Study Requirement or periods of stay under the regional initiatives for Temporary graduate visa holders

We are looking at possible concessions on a case-by-case basis.

Processing visa applications (비자 처리)

Applicants should be aware that some services relating to the visa application process may be impacted by COVID-19.

We are aware of issues accessing the VEVO system for certain visa holders. If you can’t use VEVO to check your visa status and conditions, you can still access your visa grant letter and visa conditions online using your ImmiAccount.

Visa cancellation (비자 취소)

We will notify you in writing if your visa has been cancelled in response to the temporary travel restrictions. This will include information on how to seek revocation of the visa cancellation decision.

Travel Bans

• The current travel bans for those arriving from Mainland China, Iran, South Korea and Italy remain in place.
• As of midnight tonight, 15 March 2020 all those arriving in Australia are required to self isolate for 14 days. Some states have already introduced heavy penalties for those who do not comply.
• International cruise ships are now also banned from arriving at Australian ports for the next 30 days.

Australian citizens and permanent residents are not prevented from entering Australia at this stage.

Those arriving in Australia will also be required to self isolate for 14 days.

Immediate family – spouses, minor dependants or legal guardians only – holding permanent visas may travel to Australia, however will be required to follow self isolation guidelines.

Partners and immediate families of Australian citizens and permanent residents holding temporary visas

Partners and immediate families of Australian citizens and permanent residents – spouses, minor dependants or legal guardians only – holding temporary visas are being dealt with on a case by case basis by the Department.

• Before attempting to travel contact should be made with the relevant post using the Australian Immigration Enquiry Form provided on the Department’s website.

No further stay

The Department has to announced that onshore visa holders wishing to extend their stay in Australia should apply for an ‘appropriate’ visa. In many cases this may be a visitor visa.

No Further Stay waiver conditions 8503, 8534 and 8535

The Department has also announced that extra resources have been diverted to the No Further Stay waiver section to deal with the increased volume of requests for waivers to allow onshore visa holders to extend their stay.

• A No Further Stay waiver may be made using Form 1447 and emailing to NoFurtherStayWaiverRequest@homeaffairs.gov.au

Visa holders offshore required to enter Australia by a specified date

Visa holders required to enter Australia by a specified date and prevented from doing so by the travel restrictions should contact the section of the Department that issued the visa and request an extension to the entry date.

• Details for Departmental contact mailboxes are listed on the MIA’s website under Member resources ‘Contacting the Department’. Members will need to log in using their password to access this section of the MIA site.

Bridging Visa B holders offshore (브리징비자B 를 가지고 호주 밖에 있는 경우)

• Bridging Visa B holders offshore unable to return before expiry date may consider applying for a visitor visa to return to Australia. Bridging Visas A should then be applied for again when onshore.

The Department will consider individual circumstances and assist where possible with extensions to return dates or delay in travel dates as appropriate.

Applicants required to be onshore for lodgement of visa

Applicants required to be onshore for the lodgement of visa will need to assess whether travel to Australia and 14 days self isolation onshore is viable to their specific situation.

Those wishing to travel from countries where Australia already has travel bans in place, will be required to spend at least 14 days in a third country where travel bans to Australia are not in place before proceeding to Australia.

(4) If the applicant is in Australia, the applicant must hold a substantive temporary visa (other than a  substantive temporary visa specified in an instrument under paragraph (5)(c)), or must satisfy the following paragraphs:

(a)  the applicant is not the holder of a substantive visa;(substantive visa 소유자가 아니어야 한다)

(b)  the last substantive visa held by the applicant was:

(i)  a student visa; or (학생비자였거나)

(ii)  a special purpose visa; or

(iii)  a Diplomatic (Temporary) (Class TF) visa granted to the holder as the spouse or de facto partner, or a dependent relative, of a diplomatic or consular representative of a foreign country;

(c)  the application is made within 28 days after:

(i)  the day when that last substantive visa ceased to be in effect; or

(ii)  if that last substantive visa was cancelled, and the Tribunal has made a decision to set aside and substitute the cancellation decision or the Minister’s decision not to revoke the cancellation—the later of:

(A)  the day when that last substantive visa ceased to be in effect; and

(B)  the day when the applicant is taken, under sections 368D and 379C of the Act, to have been notified of the Tribunal‘s decision;

(d)  the applicant has not previously been granted a visa based on an application made when the applicant did not hold a substantive visa.(유효한 비자를 가지고 있지 않으면서 비자신청이 이뤄지고 비자신청인이 그런 신청서에 의한 비자를 이전에 그란트 된적이 없다.

(4)(b)(ii) special purpose visa

Have ‘prescribed status’

To have prescribed status, you must:

Be an official guest of the Australian Government

You must be an official guest of the Australian Government or:

• their spouse

• the armed forces of a specified Asia-Pacific country, travelling to Australia or in Australia as part of your duty
• the armed forces of a Commonwealth country, travelling to Australia or in Australia as part of your duty

You are also eligible if you are their accompanying spouse, de facto partner or dependent relative.

Be declared by the Minister

The Minister may also declare a person or class of persons to hold a Special Purpose Visa.

Be a member of the Royal Family

You must be a member of the Queen’s immediate family or:

• their personal staff
• their media representative
• a person accompanying them as a member of their official party

Substantive temporary visa
