Q&A – 2020-21  Migration Program Planning and Delivery(이민프로그램 계획 및 전달 – 질문과 답변)

이민성에서 발표한 2020-21 금년 이민 프로그램에 대한 FAQ 에 대해 공유해 드립니다.

1.        What impact has COVID-19 had on the delivery of the Migration Program? (코로나바이러스가 주는 영향)

• Migration continues to make substantial contributions to Australia’s economic prosperity, national wellbeing and social cohesion.
• The Australian Government is closely monitoring migration and visa settings to ensure they are consistent with public health measures, are flexible and do not displace job opportunities for Australians so that Australia can deal with the immediate and post recovery impacts of COVID-19.
• COVID-19 has had significant impacts on the Department of Home Affairs’
  • Health restrictions implemented in Australia and many other countries have disrupted the Department’s visa processing services; and (보건 제약)

2.    What impact has COVID-19 had on Net Overseas Migration? (코로나바이러스가 이민에 무슨 영향을 줬는가?)

• To date, the Government has shown a commitment to protecting the health of Australians, supporting businesses and jobs, and securing food supply while we combat COVID-19.

4.    When will the Government announce the size and the composition for the 2020-21 Migration Program?

• The Australian Government is considering how best to shape the Migration Program to drive economic growth and support job creation during this post recovery

• Until otherwise advised, the existing 2019-20 Migration Program settings will continue to remain in place. This means the 2020-21 planning ceiling will be retained at 160,000 places, the level set for the 2019-20 Migration (아래와 같이 따로 결정하지 않는 이상 작년 이민프로그램이 유지될 것임. )
• This includes:

• 108,682 places for the Skill
• 47,732 places for the Family
• 236 places for the Special Eligibility
• 3,350 places for Child visas

5.    Will States and Territories be given any nominations in the 2020-21 Migration Program, or are the State/Territory skilled nominated programs and Business Innovation and Investment Program closed indefinitely?

• The State and Territory nominated visa programs will play an important part in Australia’s economic recovery and continue to be a part of the Migration (경제 회복에 중요한 역할을 하고 계속해서 이민프로그램의 일부를 차지 하고 있어 주정부스폰서쉽 비자는 남아 있을 예정)
• The Australian Government is considering how best to shape the Migration Program into the future to drive economic growth and support job

• Nominations will be made available to States and Territories in line with these considerations, in the following categories: (주정부 프로그램은 아래와 같이 3가지)
  • Skilled – Nominated (subclass 190).

• Skilled Employer Sponsored Regional (Provisional) (subclass 491).

• Business Innovation and Investment

6.    What invitation rounds for Skilled Independent (subclass 189) and Skilled Work Regional (Provisional) (Family Sponsored) (subclass 491) continue to be run each month?

• The Government is closely monitoring migration and visa settings to ensure they are consistent with public health measures, are flexible and do not displace job opportunities for Australians so that Australia can deal with the immediate and post recovery impacts of COVID-19.
• Targeted invitation rounds have continued each month and prioritise skills which are in critical need and will aid Australia’s economic (매월 호주의 경제 회복지원을 위한 필요한 숫자 및 직업군 등이 결정될 것임)

7.    What changes will be made to the Migration Program in 2020-21?

• Until otherwise advised, the existing 2019-20 Migration Program settings, including the program size and composition, will remain in (2020-21년도 이민프로그램은 현재기준 작년과 동일하게 그러나 변경 가능성 있음; 코비드-19에 직접적인 보건 및 경제 영향을 대처할 수 있도록)
• The Government’s current focus is dealing with the immediate health and economic impacts of COVID-19.

8.    Why did the Government decide to retain the 2019-20 Migration Program settings?

• The Migration Program is generally announced each year as part of the Federal Budget in
  • Due to the Government’s focus on responding to the unprecedented COVID-19 crisis, the 2020-21 Budget was deferred for consideration until October 2020 (2020년 10월전까지는 발표가 없을 듯)

9.    Will stakeholders be consulted ahead of any potential changes to the 2020-21 Migration Program?

• The Department plans to proceed with engagement with State and Territory governments regarding their nomination allocations for the 2020-21 Migration
• Relevant stakeholders will be advised if any further decisions are made regarding program settings for the 2020-21 Migration (주정부프로그램이 확정이 되면 각 주에 통보될 것이며 각 주는 발표할 것으로 예상)

(아시는 분들은 이미 아시겠습니다만) Australia 의 경우 주  수입원중 하나가 교육산업 (education industry)입니다. 특히 해외에서 유학생이 옴으로서 국가, 회사, 개인 수입 (income)원으로 이용되고 이런 사업을 하는 분들이 존재합니다.

작금의 COVID-19 때문에 호주에 유학생이 전혀 입국하지 못합니다.

그런 와중에 호주정부는 파일럿 프로젝트를 만들었습니다.

일명 외국인 유학생 350명을 위해서 ACT 에 있는 ANU와 Uni of Canberra 대학이 행할려고 했던  International student return pilot program 이 기약없이 연기되었습니다.

하루라도 빨리 유학생이 호주로 유입되도록 하기 위한 프로그램이었지만 지금 호주는 VICTORIA주에 제 2nd wave에 해당하는 코로나바이러스 확산으로 멜번을 전체 봉쇄하고 있고 다른 주들도 멜번 출신의 유입을 원하지 않고 있습니다. 즉, 호주내 코로나 바이러스 사태가 진정되는 듯 하다가 다시 고개를 들어서 이와 같은 프로그램을 하기에 여력이 없어 보입니다.

그래서 무기한 연장을 했습니다.

International student return pilot program postponed

The planned international student return pilot program for 350 students to be conducted by the Australian National University and University of Canberra, has been postponed due to the continued uncertainty over the global pandemic situation and until the situation in Australia becomes clearer.

The pilot program will be revisited at a later stage.

서두에도 이야기했지만 호주의 주수입원 중에 하나에 해당하는 교육산업을 위해서는 유학생을 받아 들여야 하나 아직은 시기상조인 것 같습니다.

몇일전 일입니다.  PM 스캇모리슨이 이야기 했습니다. 기자가 질문하길 언제쯤 외국인유학생이 호주입국이 가능해지겠는가?  이에 대해 그는 호주내 호주인 학생들이 자유롭게 대학에 갈 때 그리고 그 이후에 유학생이 호주유입이 되도록 할 것이라고 단호하게 이야기 했습니다.

다시 말해, 자국민 자녀들이 대학을 못하고 대면수업을 못하는데 외국인 유학생을 유입하는 것은 어불성설이니 맞는 말입니다.

누구든 이런 일이 발생하지 않길 진심으로 바라면서 공유합니다.

실사례입니다.

다른 이민법무사의 client 건으로서.

EOI 를 제출할 때 점수가 80점이었습니다.

EOI 초대를 받고 비자를 신청했습니다. (491 비자)

그런데 실제 알고 보니 75점이 전체 점수였습니다.

그리고 이민성 case officer는 비자를 거절 (refused) 했습니다.

사유는 이것입니다.

491.231 을 만족하지 못함.

이게 뭔 말이래?

491.213

The applicant was invited, in writing, by the Minister to apply for the visa.

이민법을 찾아 가보면 이렇게 명시되어 있습니다.

딱 한줄 이렇게 적혀 있습니다.

그래서 뭐 어쨌다는 것이냐?

저 한줄을 보고 해석이 안됩니다.

하여 case officer가 참고하는 PAM 을 들여다 보면 이렇게 명시되어 있답니다.

복잡하죠? ㅠ

7.1 Invitation

For clause 491.213 of Schedule 2 to the regulations, the applicant must have been invited, in writing by the Minister, to apply for the visa. The online application system – SkillSelect – requires an invitation code for a Subclass 491 application to be made. For more information, see SkillSelect – Expression of Interest for Skilled Migration.

The time of invitation date is critical for the assessment of whether an applicant satisfies the criteria for the grant of a Class PS visa. Client information advises intending migrants to update their EOI (expression of interest) in SkillSelect for any changes in circumstance or in points-tested factors. All of the requirements related to an applicant’s indicative points score at time of invitation require the applicant to have demonstrated that these requirements were met at time of invitation, even if this evidence is provided after the visa application is made.

Officers should examine the documents provided against the date of invitation to ensure that the documents were valid at the time of invitation – See SkillSelect – Expression of Interest for Skilled Migration.

Members of the family unit and subsequent entrant applicants do not require an invitation.

아래 한줄이 가장 중요합니다.

All of the requirements related to an applicant’s indicative points score at time of invitation require the applicant to have demonstrated that these requirements were met at time of invitation, even if this evidence is provided after the visa application is made.

즉, EOI 제출하고 나면 주정부에서 선택을 해 줄지 말지 결정을 하는데

결정하는 시점에서 해당 점수 (지금 사례는 80점) 이었고

이민성에 초대를 할때도 또한 80점이었잖아요.

그러면 이 점수가 반드시 증빙서류를 제출하여 80점을 만족해야 합니다.

그렇지 않으면?

491.231 법에 의하여 비자 거절이에요 ㅠ

아 뭐 좀 5점 깍여도 75점 통과점수 65점을 넘겼는데?

하는 식의 생각은 신청인(들)의 생각이고

법은 이렇게 명시되어 있습니다.

그럼으로 함부로 점수를 내 마음대로 EOI 초대 받기 위하여 올리면 절대 안됨.

EOI 제도가 만들어졌을 때부터 (2012년도) 늘 그랬습니다.

그런데 이상하잖아요?

agent 가 모를리 없을 텐데….

그가 몰랐던 것은 안타깝게도

해당 케이스는 PY (professional year) 점수가  claim 되어 있더라는 점이에요.

직업군은 RN (registered nurse)인데 ㅠ

왜죠?

RN은 PY 점수 해당하지 않아요.

이 부분을 실수로 클레임 되어 있다라는 점이에요.

신청인이 했는지

agent 가 했는지 그것은 안 알려져 있고 모릅니다만

agent가 신청전에 또는 그 업무를 받아서 처리할 때 이 부분을 미리 알았더라면 하는 아쉬움이 있긴 하지만

이미 신청된 것이라면 God 도 문제 해결 못합니다.

어쩌되었든 분명한 fact는
80점을 claim 했지만

실제 75점이더라.

하여 491 비자가 거절되었다

입니다.

안타깝지만 현실에서는 있을 수 있는 일이기도 합니다.

법은 법을 잘 아는 분에게 맡기시면 그나마 제일 안전한 것 같습니다.

SA 주정부에서 보내온 오늘자 (7월 27일 월요일 아침) 메일 안내입니다. 전에 말씀드린 것처럼 연방정부의 quota 할당을 기다리는 중이라고 하며 연방정부의 발표가 있기 전까지 SA 주정부의 이민프로그램은 임시중단된다는 내용입니다.

The South Australian Skilled and Business Migration programs are awaiting the Commonwealth Government’s allocation of state nomination places for program year 2020-21; therefore, these programs remain closed until further notice.

GSM 비자와 주정부 이민프로그램과 관련 업데이트 

2019/2020년 회계년도 GSM 기술이민 프로그램은 모두 마감되었습니다.

주정부 노미네이션 프로그램은 연방정부에서 2020/2021년 회계년도를 위해서 노미네이션 쿼타를 할당하기 전까지는 모두 일시적으로 중지됩니다. 따라서 일시적으로 190 비자 와 491 비자를 위한 노미네이션을 발행할 수 없게 될 것입니다.  사업비자 프로그램도 또한 모든 주정부에서 종료되었습니다. 어떤 주에서는 아직 오픈된 것처럼 되어 있지만 변경이 안된 경우로 이해하면 좋을 것 같습니다.

SA 주정부의 홈페이지에 2020년 8월 초에 오픈 될 것으로 공지되어 있지만 연방정부 이민성으로부터 확인된 것은 아닙니다.

현재 모든 주정부노미네이션 프로그램은 아래와 같고 한마디로 연방정부에서 쿼타가 할당될 때까지 중지될 것임을 암시하고 있습니다.

NT: Currently open. We are assuming that no nominations will be issued until the grant of new quota. New eligibility criteria in place for all applicants. Closed for offshore applicants.

WA: Currently open. No updates yet from state authority. We are assuming that no nominations will be issued until the grant of new quota.

NSW: Applications are open for 190 visa, closed for 491 visa. No nominations will be made until the allocation of new quota.

TAS: Application are open, but no nomination will be made until quota is received.

VIC: State nomination applications are temporarily closed. You can still lodge an EOI and then lodge the state nomination application once the new quota is allocated.

SA: Applications closed until early august. Will re-open subject to allocation of new quota.

ACT: Program to be temporarily closed until quota received from the DOHA

QLD: Currently closed. Will reopen upon allocation of new quota.

States & Territories migration programs

The General Skilled Migration (GSM) program for the 2019/20 financial year has now closed.

The State and Territories nomination program will remain temporarily CLOSED until the Commonwealth Government allocates state nomination places for 2020-21. State & Territory governments therefore have no ability to nominate applicants in visa subclass 190 & visa subclass 491.

Business visa program are also closed in all states, although WA has not confirmed this on its website.

While the Immigration SA website states that the allocation will be made to the States and Territories in early August 2020, this has not been confirmed by the Department.

그리고 연방정부의 예산이 코비드19 팬데믹 영향으로 인하여 2020년 10월 4일 전까지 연기됨. 따라서 모든 연방정부의 부서가 이 영향을 받게 됨. 이민성도 마찬가지입니다.

2020-21 Migration planning levels and allocations

As members will be aware the Federal Budget has been deferred until 4 October 2020 due to the impact of the COVID 19 pandemic. This has implications for all government departments dependent on the financial allocations made as part of the Budget decisions. An economic and fiscal update will be provided by the Treasurer on 23 July 2020.

It is expected that the Department will consider changes to the Migration Program Planning Levels for 2020-21 due to the COVID-19 situation and higher levels of unemployment within the Australian workforce. 코비드-19 상황과 호주인 노동인력에 높은 실직율에 따라 2020-2021년 회계년도를 위한 이민프로그램 계획수준들이 변경될 것으로 전망함

Migration numbers and state/territory nomination places have also been impacted, as well as the announcement of any changes to the occupation lists. 또한 이민자수 그리고 주정부노미네이션 할당수는 물론 직업군도 영향을 받을 것으로 전망함

In the interim, the Department has indicated that the 2019-20 Migration Program settings will remain in place until further notice and will also shortly announce how state/territory nominations will be managed in the lead up to the October Budget. 10월 예산이 발표되면 조금더 확실한 프로그램을 알 수 있을 것으로 예상함.

The Victorian Government’s state nomination program will remain temporarily closed while we await the Commonwealth Government’s allocation of state nomination places for 2020-21.

In the meantime, you will not be able to apply for the following state nomination visas:

• Skilled Work Regional (Provisional) (subclass 491) visa
• Skilled Nominated (subclass 190) visa
• Business Innovation stream (subclass 188A) (Provisional) visa
• Investor stream (subclass 188B) (Provisional) visa
• Significant Investor stream (subclass 188C) (Provisional) visa
• Entrepreneur stream (subclass 188E) (Provisional) visa
• Significant Business History  (subclass 132A) (Permanent) visa
• Venture Capital Entrepreneur (subclass 132B) (Permanent) visa

We will notify you when the 2020-21 Victorian state nomination program reopens after further advice from the Commonwealth Government.

You can still lodge your Expression of Interest (EOI) through the Commonwealth’s Department of Home Affairs SkillSelect system.  An EOI will be required before you can apply for a Victorian visa nomination.

현재 타스마니아 노미네이션 처리 시간이 무료 4-5개월이 소요된다고 합니다.

따라서, 현재 자신의 비자가 만기전에 다른 비자를 받을 수 있는 상황이 되어야 할 것 같습니다. 노미네이션 신청을 했다고 하여 브리징 비자를 받을 수 없으며 최소한 다른 비자를 신청해야 BVA/BVC를 받을 수 있게 됩니다.

남호주 2019/2020년 노미네이션 신청서는 2020년 6월 28일 일요일 9PM 에 마감합니다.

그리고 2020/2021년 노미네이션은 7월 1일 또는 그 이후로 공지될 것입니다.

South Australian state nomination applications for the 2019/2020 program year will close on Sunday 28 June 2020 at 9pm ACST.

Skilled migrants seeking state nomination will need to submit and pay for their application to Immigration SA by this time to be considered against the current state nomination requirements.

Any incomplete application remaining in the system past 9pm ACST on the Sunday 28 June 2020 will be deleted. This includes applications that have been “saved but not submitted” and applications that have been “submitted but are still awaiting payment.

Applications for 190/491 skilled migration for the 2020/2021 program year will be open at a date to be advised.

아래와 같이 오늘 발표가 되었네요. 그리고 계획대로라며 2020년 8월초에 2020/2021 년회계년도 GSM  관련 비자 노미네이션이 열릴 전망입니다.

South Australia’s General Skilled Migration (GSM) program for the 2019/20 financial year has closed. Immigration SA will no longer be accepting application for 190/491 state nomination visas. Applications received prior to program closure will continue to be processed.

The GSM 2020/21 program year is scheduled to re-open from early August.  Information relating to updated occupation lists, nomination requirements and criteria will be made available closer to program launch date. (직업군 목록, 노미네이션 요구조건 및 기준은 프로그램 발표가 가까워지면 업데이틀 될 것입니다)

오늘 아침 Fair Work Ombudsman 에서 아래 내용의 최저 임금에 대한 소식을 받았습니다.

내용인즉,

현재 시간당 최저 임금, $19.49 에서 1.75% 인상된  $19.84를

업종별로  2020년 7월 1일, 2020년 11월 1일 또는 2021년 2월 1일 로 인상될 것이라고 합니다.

왜 동시에 인상을 하지 않는지 그 이유는 모르겠고요.

업종별 궁금한 분들은 https://www.fairwork.gov.au/awards-and-agreements/awards/changes-to-awards-in-2020 에서 확인이 가능하게 될 것입니다.

The Fair Work Commission has announced a 1.75% increase to the National Minimum Wage (NMW) following its 2020 Annual Wage Review. (1.75% 인상을 발표함)

The increase applies to awards in 3 stages, which start from the first full pay period on or after: (아래와 같이 3단계로 적용됨)

• 1 July 2020
• 1 November 2020
• 1 February 2021.

For anyone not covered by an award or an enterprise agreement, the new national minimum wage will be $753.80 per week or $19.84 per hour. This applies from the first full pay period on or after 1 July 2020. (향후 새로운 호주 최저 임금은 2020년 7월 1일 부터 $19.84 (시간당) 이며 주38시간 $753.80 으로 before tax (세금 감면전) 입니다.

앞으로 취업을 하실 분들은 참고하셔서 최저임금을 받으실 수 있길 바랍니다.
