Dear Registered Migration Agent

Referring clients to managed fund products

The Australian Securities and Investments Commission (ASIC) has advised the Department of Home Affairs that it holds concerns arising from Significant Investor Visa (SIV) applicants being referred to particular managed fund products when being provided with immigration assistance.

In particular, ASIC is concerned that some conduct involved in these referrals may have contravened the financial services provisions of the Corporations Act 2001 (the Act). ASIC is concerned that, where a registered migration agent (RMA) or Australian legal practitioner refers a SIV applicant to a managed fund product, the referral might involve the RMA or Australian legal practitioner providing financial product advice (please refer to the next paragraph for the definition) under the Act.

Giving a recommendation or a statement of opinion, or a report of either of those things, constitutes financial product advice under section 766B of the Act, if it is intended to influence a person or persons in making a decision about a particular financial product or class of financial products, or an interest in a particular financial product or class of financial products, or could reasonably be regarded as being intended to have such an influence.

Unless an exemption applies, a person cannot provide financial product advice unless the person holds an Australian Financial Services (AFS) licence that authorises them to provide financial product advice. Referring a client to a person for the purposes of the person providing the client with financial product advice is itself providing financial product advice.

Permitted exceptions are set out in Regulation 7.6.01(1)(e) of the Corporations Regulations 2001 (the Regulations). ASIC advises that RMAs and Australian legal practitioners who refer a client to a financial adviser for the provision of a financial service may be exempt under Regulation 7.6.01(1)(e) of the Regulations from the requirement to hold an AFS licence. In order to rely on this exemption, you must:

• only refer SIV applicants to the fund manager and that referral consists only of:
  • informing your client that the fund manager, who must be an AFS licence holder, is able to provide a particular financial service; and
  • giving your client information about how to contact the fund manager
• avoid representations regarding the quality of the services the fund manager can provide
• disclose any benefits/commissions that you receive directly or indirectly from the fund manager for making the referral.

SIV applicants have been victims of serious financial fraud in Australia. ASIC recommends that you encourage SIV applicants to seek independent financial advice and, as far as possible, that you refer SIV applicants only to fund managers with robust risk and governance frameworks.

ASIC will continue to monitor compliance in this area and will take regulatory action where appropriate. Individuals who give unlicensed financial advice commit a criminal offence and can be subjected to a maximum of five years imprisonment and/or a fine of up to $133,200 (600 penalty units). For corporations the penalties are up to $1.33 million (6,000 penalty units). There are also civil penalties for carrying on an unlicensed financial services business: up to the greater of $1.11 million (5,000 penalty units) or three times the benefit obtained and detriment avoided for an individual; or the greater of $11.1 million (50,000 penalty units), three times the benefit obtained or detriment avoided, or 10% of annual turnover (capped at 2.5 million penalty units) for a body corporate.

You can report unlicensed financial activity to ASIC through https://asic.gov.au/complain

If you have any questions, you can contact ASIC on 1300 300 630 or by asking a question online.

The MIA has been receiving a number of queries from members regarding whether the period of 12 months of the program had to be within the 48 months prior to being invited. The Department has confirmed that in order to be awarded 5 points for completing a professional year, you must have started and completed the course within the 48 months prior to being invited. The Department has taken the view that the term “completed” is more than just the end of the program and is referring to all parts or elements of the course therefore, the full 12 months of the program needs to occur in the 48 months prior to invitation.

Professional year 라고 해서

Professional year programs

For the purposes of the definition of professional year in subregulation 2.26AC(6) of the Regulations, any of the following professional year programs are specified courses:

(a)      The Professional Year Program provided by the Australian Computer Society which is available to information technology graduates;

(b)     The Professional Year Program provided by Chartered Accountants Australia and New Zealand, the Certified Practising Accountants Australia and the Institute of Public Accounting which is available to accounting graduates;

(c)      The Professional Year Program provided by Engineers Australia which is available to engineering graduates.

• This is an application for review of a decision made by a delegate of the Minister for Immigration on 15 November 2017 to refuse to grant the visa applicant a Partner (Provisional) (Class UF) visa under s.65 of the Migration Act 1958 (the Act).

• The delegate refused to grant the visa on the basis that the visa applicant did not satisfy cl.309.211 because the delegate was not satisfied that the applicant is the spouse of the sponsor.

‘Spouse’ is defined in s.5F of the Act and provides that a person is the spouse of another where the two persons are in a married relationship. Persons in a married relationship must be married to each other under a marriage that is valid for the purposes of the Act, there must be a mutual commitment to a shared life as a married couple to the exclusion of all others, the relationship must be genuine and continuing, and the couple must live together, or not live separately and apart on a permanent basis: s.5F(2)(a)-(d). In forming an opinion about these matters, regard must be had to all the circumstances of the relationship. This includes evidence of the financial and social aspects and the nature of the visa applicant’s and review applicant’s household and their commitment to each other as set out in r.1.15A(3), which is extracted in the attachment to this decision.

• The Tribunal had the benefit of the applicant’s and the sponsor’s oral evidence and a witness (sponsor’s niece) at the hearing and found their evidence to be detailed, consistent and overall, credible. The Tribunal gave all the evidence provided by the parties at the Tribunal hearing and evidence provided by the applicant to the Department and the Tribunal file due regard. The applicant provided a significant amount of additional documentary and photographic evidence to the Tribunal.

Happy Ending

8501
The holder must maintain adequate arrangements for health insurance while the holder is in Australia.

If applicants are required to provide evidence of their health insurance arrangement(s), the following may be considered as acceptable, unless a particular visa subclass instruction requires other specific information:

• a copy of the insurance policy
• a written letter or cover note from an acceptable insurance provider (refer to 3.4 Health Insurance providers), certifying that the primary visa applicant and any accompanying family members immediately upon visa grant or their arrival in Australia, are, or will be, covered by insurance that is at least as comprehensive as the prescribed adequate level of cover (refer to 3.3.3. Adequate level of cover)
• evidence that the visa applicant has lawfully enrolled with Medicare (refer to 3.4.2. Reciprocal Health Care Agreements and Medicare)
• evidence that the primary visa applicant and any accompanying family members immediately upon visa grant or their arrival in Australia, are, or will be, covered by health insurance that is at least as comprehensive as the adequate level of cover required under policy (refer to 3.3.3. Adequate level of cover), with the understanding that the applicants will either enrol with Medicare under a RHCA or enrol in a private insurance arrangement after arrival or
• for citizens from the Republic of Ireland, evidence that they hold an Irish passport (refer to 3.4.2. Reciprocal Health Care Agreements and Medicare).

This permanent visa allows you to live and work in all areas of Australia.

To be eligible, you must meet the following Department of Home Affairs requirements:

• have a relevant skills assessment;
• be under 45 years old;
• be nominated by a State or Territory, such as Western Australia;
• be able to score 65 points or more on the Department of Home Affairs points test. State nomination for the subclass 190 visa gives you an extra 5 points towards the Department of Home Affairs points test, which is automatically incorporated into your EOI;
• have the required English level; and
• have an occupation on the relevant occupation list.

Visit the Home Affairs website for more information on the Skilled Nominated visa (subclass 190).

Western Australian State nomination

To be considered by Western Australia, you must first lodge an expression of interest (EOI) in the Department of Home Affairs SkillSelect database. WA Migration Services invites eligible EOIs on a monthly basis to apply for Western Australian State nomination based on a ranking system.

You can be invited through one of two streams:

• the general stream, and
• the graduate stream.

Overview of ranking system

Each month, a set number of eligible EOIs are selected in SkillSelect based on the below ranking system. Visit the invitation rounds page for further information.

1. Applicants eligible for the General stream will be ranked in accordance with the table below:  (WA유학후 비자를 고려하는 분이 아니라면 점수가 가장 높은 분들이 선택될 것이라는 내용입니다.

2. Applicants eligible for the Graduate streamwill be ranked in accordance with the table below: (WA

If you are invited to apply, that means your EOI has demonstrated you meet a series of initial requirements.

If you would like to accept your invitation to apply for WA State nomination, you will be required to provide further evidence to meet the State nomination requirements, as outlined below. This evidence is provided during the application process. For the full list of requirements, you can also view the State nomination migration program process and requirements.

If your application for State nomination is approved, you will be nominated by WA Migration Services in SkillSelect and automatically invited to apply for the Subclass 190 visa by the Department of Home Affairs.

Overview of State nomination requirements
