오늘 이민성 장관의 National Press Conference 를 갖으면서 기술이민 및 기타 이민프로그램에 변화가 있을 것이라는 내용을 발표했습니다.

우선 당장 확실한 것은 아래 2가지입니다.

1. Temporary Skilled Migration Income Threshold (TSMIT) 라고 해서 2023년 6월 30일 까지는 53,900불이지만 이후부터는 70,000불로 인상됨 – 2013년 이후로 TSMIT 이 인상되지 않았는데 10년이 지난 지금 고려를 할 때 7만불에 해당한다는 판단입니다. 그리고 호주 이민포그램하에 유입되는 정규직 종사자의 90%는 사실상 TSMIT 이상 받는다는 분석입니다.
2. TSS 비자의 short-term 에 해당하는 직업군에 종사하는 분들도 2023년 말까지 영주비자를 받을 수 있는 길이 열릴 것 같음 (The Albanese Government is also announcing that by the end of 2023, Temporary Skill Shortage (TSS) short stream visa holders will have a pathway to permanent residency within our existing capped permanent program.) 대신 기존에 발표된 이민자수에 한해서 영주비자를 발행할 것 이라고 합니다. 즉, 금년 배정된 인원이상으로 영주비자 발행은 아니라는 뜻.

NZ 시민권로서 호주에 거주하시고 계신 분들에게 매우 좋은 소식이 아닐 수 없습니다.

2022년 6월 호주 노동당 수상은 NZ 시민권자들도 호주에서 거주를 할 경우 투표권을 갖을 수 있도록 한다는 언급을 했었습니다.

이 뜻은 NZ 시민권자들이 보다 쉽게 호주시민권을 얻기 위한 길을 터주겄다는 암시였습니다.

그리고 지난 주 ABC 호주 뉴스에서 대략적인 윤곽이 나왔었고 기사화 되었습니다.

그리고 오늘 아침에는 보다 구체적으로 MIA 협회에서 회원 (RMA 이민법무사)들에게 정보를 제공해 왔습니다.

Direct Australian citizenship for NZ citizens

NZ 시민권자들은 호주 시민권을 바로 받을 수 있는 길이 열릴 것이다. (2001년 자유당이 NZ 시민권자들에게 주어진 것을 SCV 444 라는 비자를 만들고 이 비자를 소지하고 호주에서 영주권을 받고 시민권조건을 만족해야 호주 시민권을 신청할 수 있었습니다. 이 법이 2023년 6월 30일까지 유지가 되고 2023년 7월 1일 부터는 아래와 같이 매우 간단하게 SCV 비자 소지하고 4년간 거주하면 시민권을 신청하게 됨에 따라 영주권 신청 자격이 안되거나 되더라도 이런 과정이 없이 바로 호주시민권 신청이 예전처럼 됨에 따라 매우 간단해 진 것이 사실입니다)

The change will come into effect from 1 July 2023. (2023년 7월 1일부터 적용)

From 1 July 2023 (2023년 7월 1일부터 적용)

• Long term New Zealand citizens resident in Australia will have their period of permanent residence backdated for citizenship purposes 
• All New Zealand citizens holding an SCV will be considered permanent residents for citizenship purposes. (시민권 신청 목적에서 SCV 소지한 경우 영주한 사람으로 고려함)
• New Zealand citizens granted an SCV before 1 July 2022 will have their period of permanent residence for citizenship purposes backdated to 1 July 2022. (비자신청할 때 4년중 1년 영주권 소유해야 한다는 조건이 있고 이 조건을 SCV 비자 소지자는 임시비자일지라도 영주권자로 고려한다는 뜻) 
• New Zealand citizens granted an SCV for the first time on or after 1 July 2022 will be considered a permanent resident for citizenship purposes from the date of their SCV grant.
• Provisions will also apply to New Zealand citizens who are overseas, but held an SCV immediately before last leaving Australia.

Children of SCV holders (SCV 소지한 어린 자녀 특히 새로 태어나는 아이에게 매우 좋은 소식)

• From 1 July 2023, any child born in Australia on or after 1 July 2022 to an SCV holder may automatically acquire Australian citizenship at birth. (2023년 7월 1일부터 호주에서 태어나면 자동으로 시민권을 얻을 수 있음)
• From 1 July 2023, children who meet these circumstances can apply for​ evidence of citizenship. (2023년 7월 1일부터 아이들은 4년 거주 조건을 만족하면 됨) 

Australia citizenship applications until 1 July 2023

These provisions will not apply to citizenship applications submitted before 1 July 2023. Applications submitted before this date must meet the current requirements at that application before this date, and you do not meet the eligibility requirements. (2023년 7월 1일 이전에 호주 시민권을 신청하는 분들은 그전 법에적용)

2023년 4월 1일 부터 가정폭력 (family violence) 관련 법조항이 바뀜에 따라 구체적인 증거를 제출해야 합니다.

아래 내용은 관련 내용으로서 최소한 2가지 다른 유형의 증거를 제출해야 하며 letterhead 에 작성되어야 하며 아래 내용이 담겨야 합니다.

4  Types of evidence

(1) For the purposes of paragraph 1.24(b) of the Regulations, the types of evidence mentioned in Schedule 1 are specified.

(2) All items of evidence must be sufficiently detailed and include the required information as mentioned in Schedule 1.

(3) All items of evidence provided by a person, officer or provider mentioned in Schedule 1, must be in writing in English on their professional letterhead or the professional letterhead of their organisation, and include the following details:

(a) full name; (b) occupation; (c) signature; (d) date; (e) address; and (f) contact phone number.

Family Violence – Evidentiary requirements

Migration (Specification of evidentiary requirements—family violence) Instrument (LIN 23/026) 2023 – F2023L00382 repeals IMMI 12/116 and more clearly specifies the type of information and evidence required as evidence of family violence.

This Instrument also specifies new additional forms of acceptable evidence from the professional providing the evidence of family violence, in addition to the current forms of evidence.

Transitional arrangements – Anything done under the previous Instrument IMMI 12/116 continues to be in effect as if it was done under that Instrument.

This Instrument repeals IMMI 12/116 and commences on 31 March 2023 and sunsets on 1 April 2033.

많이 받는 질문이 있어 정리해 드립니다.

학생비자 / 워홀러 들도 ABN를 만들어 일을 할 수 있습니다. 

학생비자의 조건에 unlimited 라고 되어 있다면 ABN을 소지한 경우 unlimited로 일을 할 수 있고 주당 20시간 이라고 한다면 주당 20시간씩 ABN 소지하고 일을 해야 한다면 (비자조건을 만족한다는 가정하에) 무관합니다.

세금 신고는 (비자법과 대행은 이민법무사에게 상담 및 의뢰를 하는 것처럼) 회계사님께 상담 및 의뢰하시면 worry free (걱정무)가 될 수 있겠기에 저는 항상 전문가의 도움을 받으시라고 강추해요.

그리고 학생비자를 소지했어도 Two job가 아니라 three job도 아무런 문제가 없는데요. 주의할 점이 있다면 늘 학생비자 조건 (working hours)는 꼭 지켜야 합니다. 그것이 unlimted 라면 24시간 일해도 되고요. 그것이 주당 20시간이면 주당 20시간을 꼭 지켜야 하는 것이 유일무이한 학생비자 소지자의 주의할 점이라고 할 수 있겠습니다.

ABN으로 일을 하면 건당 일을 하는 경우도 있겠지만 주당 20시간 조건을 가진 분들의 경우  이것은 시간당으로 환산하여 갑으로 부터 비용을 청구하는 방법을 해야 나중에 문제가 없지 싶습니다.

혹자는 이런 질문을 하십니다 “ABN을 발급해서 일하면 나중에 비자 캔슬의 사유가 된다”  라고요. 아마도 ABN를 받아서 일하면 안되는 분들이 있는데 바로 고용주스폰서쉽을 통해 비자를 받은 분들이라고 이해하시면 될 것 같습니다. 이런 분들은 482 / ENS 비자를 소지한 분들의 경우인데요 이런 분들은  ABN을 만들어서 일하면 안 되며 이런 분들은 TFN 만 가지고 피고용이 되어야 하는 법때문에 그렇습니다.

안녕하세요.

멜번에도 사람들이 부족한 것은 아닌가 싶습니다.

멜번 시내에도 491 비자를 위해서 오픈했다는 소식을 받았기 때문입니다.

현재 멜번 시내에서 살고 있는 분들은 참고하세요.

기존에 190 비자를 신청하고 아직 초대를 받지 못하신 분들도 신청을 할 수 있다고 밑에 QandA가 있습니다만 대신 기존 190을 철회 (withdraw)하고 신청할 자격이 있다고 하오니 이점은 숙고해야 할 것 같습니다.

491비자는 임시비자이기는 하나 어짜피 애가 없는 경우라든지 싱글 / 커플이 호주 멜번에서 거주하는 것을 원하고 일하고 살경우 고려대상이 된다고 봅니다.

기존에 점수가 부족해서 190을 신청하지 못하고 멜번 시내에서 떠나지 못하는 분들에게도 좋은 기회가 아닐까 싶습니다

지주 질문 받는 것 중에 189 / 190 / 491 비자 그란트 되기 전에 결혼 및 de facto 관계인 경우 single 점수를 위해서 이민성에 통보를 하지 않거나 하면 이래도 괜찮냐고 묻는데요. 

RMA 로서는 당연히 안된다는 답을 얻게 됩니다만 본인 DIY로 직접 non-compliance 를 하게 되며 어떻게 될까요? Section 109 이민법에 따라 이민성에서 발견하면 해당 비자는 cancelation 될 것입니다.

따라서 이것과 관련하여 매우 신중하고 바르게 접수를 해야 함을 거듭 거듭 강조드립니다.

전체 Pandemic 기간동안 호주에 머물고 TGV (임시 졸업생 비자 485)를 소지한 분들 그리고 485 비자가 2022년 9월 1일부터 2023년 7월 1일 사이에 비자 만기가 되는 분들의 경우   코비드비자인 408 비자를 2년짜리로 신청할 자격이 있을 수 있습니다. 

Transitional arrangements – Two year SC 408 visas

Temporary Graduate Visa (TGV) holders whose visas expire/d between 1 September 2022 and 1 July 2023 may apply for an extension of their work rights using a Temporary Activity SC 408 COVID-19 Pandemic event visa with two years validity.

Temporary Graduate Visa holders who were in Australia throughout the pandemic period and are therefore not eligible for the TGV Replacement stream, may also be eligible for the SC 408 visa with two years validity.

학사 또는 그 이상의 학위을 공부하는 분들에게 어쩌면 희소식이 될 수 있습니다 이수하는 전공과 학위에 따라!

2023년 7월 1일 부터 485 비자 (졸업비자)를 신청하는 분들 중에

아래 목록에 해당하는 학위와 전공을 공부한 분들은 아래와 조건에 따라 2/3/4 에서 

• Bachelor’s Degree: 2 year visa period;
• Bachelor’s Degree with Honours: 2 year visa period;
• Master’s Degree by Coursework: 2 year visa period;
• Master’s Degree (extended): 2 year visa period;
• Master’s Degree by Research: 3 year visa period;
• Doctorate Degree: 4 year visa period.

2023년 7월 1일부터는 4/5/6년으로 변경됩니다.

• two years to four years for select Bachelor degrees
• three years to five years for select Masters degrees
• four years to six years for all Doctoral degrees.

아래 학위와 전공을 보시고 향후 공부를 하더라도 job 전망도 있고 좋은 선택을 할 수 있길 바랍니다.

참고로 현재 공부를 하는 유학생들에게도 적용이 됩니다. 따라서, 가능하다면 2023년 7월 1일 또는 그 이후로 485 비자를 신청해야 이 법을 소급받게 됩니다. 2023년 6월 30일 또는 그 전에  접수를 하게 되면 이 법적용이 안됨을 숙지하세요. 

Extended Post-Study Work Rights: Eligible Occupations and Qualifications

The Government has extended post-study work rights to give eligible international higher education graduates with select qualifications an additional two years on their Temporary Graduate visa (subclass 485).

Post-study work rights for select degrees in areas of verified skill shortages will be increased from:

• Two years to four years for select Bachelor degrees
• Three years to five years for select Masters degrees
• Four years to six years for all doctoral qualifications.

To implement the extension, lists of occupations in demand and related qualifications were developed through a mapping process undertaken by Jobs and Skills Australia and the Department of Education.

This document comprises:

• A list of identified occupations from the 2022 Skills Priority List, and
• A summary list of eligible qualifications by occupational category.

All doctoral studies are considered eligible for the measure, regardless of field of study and so are not listed individually.

The qualifications listed in this document are a summary of the eligible qualifications. A comprehensive list mapped to CRICOS course codes will be released by the Department of Education before implementation on 1 July 2023. Students will need to refer to the comprehensive list, when published, to confirm the eligibility of their particular course at their provider.

The implementation and on-going management of the extension to Post-Study Work Rights will be supported through monitoring and an annual review process. This approach means the lists and the implementation will be flexible in response to changes in the labor market and able to address any risks that may emerge.

Identified occupations from the 2022 Skills Priority List

List of occupations requiring Skill Level 1 qualifications in strong and moderate demand according to the 2022 Skills Priority List, adjusted by a manual validation process.
 A Labour Market rating of ‘S’ represents an identified skills shortage at a national level, whereas a rating of ‘R’ specifies a shortage specific to regional areas only.

The acronym ‘nec’ refers to occupations ‘not elsewhere classified’ which allows occupations that do not fit into detailed categorisation in the classification to still be included. All occupations which are not separately identified in the ANZSCO classification structure are included in the ‘nec’ category of the unit group to which they relate.

Indicative list of eligible qualifications, listed by occupational category

The qualifications listed in this table are a summary of the eligible qualifications. A comprehensive list mapped to CRICOS course codes will be released by the Department of Education before implementation on 1 July 2023. Students will need to refer to the comprehensive list, when published, to confirm the eligibility of their particular course at their provider.

The qualifications were generated by mapping to the occupations in skills shortage (the above list). The mapping process included both automated and manual steps.

These qualifications are eligible for extended post-study work rights.

In addition to the qualifications listed below, all doctoral graduates (AQF level 10) are eligible for an additional period of stay.

Courses differ between education providers, including as to duration, and this may affect eligibility of individual courses at individual providers. The Commonwealth Register of Institutions and Courses for Overseas Students (CRICOS) will be updated to inform decision making by students, providers and employers.

두번째 485 비자를 신청할 때 아래와 같이 거주조건을 만족해야 함

As the holder of a first Temporary Graduate visa in the post-study work stream, or a Temporary Graduate visa in the replacement stream, you must have lived only in a designated regional area for at least 2 years immediately before applying for the second Temporary Graduate post-study work stream visa. To do this, show us evidence that in the last 2 years, you resided in a designated regional area.

Designated regional areas are divided into two categories:

Category 2 “Cities and Major Regional Centres” and

Category 3 “Regional Centres and Other Regional Areas”.

If you have lived only in a Category 2 area, you can only be granted an additional 1 year visa.

If you have lived only in a Category 3 area, you can only be granted an additional 2 year visa.

If you have moved between categories you will be considered for the shorter visa.

If you have been away from your usual residence for a holiday or short work trip, it will not change the way we assess your usual residence.

The table below provides a guide on the residence and study requirements for the second Temporary Graduate post-study work stream visa.

호주에서 신청하시는 분들만 10% GST 라는 신청비 + 10% 세금 (GST)를 지불하게 됩니다.

신청인이 호주 밖에 계시고 호주내 에이전트 (저 같은 이민법무사)를 통해서 대행을 하시더라도 10% GST는 지불하지 않습니다.

• Applicants who are living in Australia MUST pay 10% GST on the application fee

• Applicants living overseas, who lodge their application from overseas, are NOT required to pay the GST

• Applicants living overseas, who lodge an application for assessment through an agent in Australia (Migration Agent, relative or friend living in Australia) are NOT required to pay the GST

결론적으로 신청인이 호주에 있는지 아닌지에 따라 GST를 지불해야 하는지가 결정되는 것임을 참고하세요.

영주권을 위한 기술심사를 위해서 학사 학위를 마치고 경력 1년이 필요합니다. 

이때 이 경력도 경력점수 호주내 1년 경력을 인정이되어 5점을 받을 수 있다는 내용입니다. 

The skill level requirement date for the Post Australian Study pathway will be noted as the completion date of the relevant Australian degree.

• Suitable employment completed after the completion date of the relevant Australian degree will be eligible for points under the skilled migration points test. •
• Relevant work experience can be overseas experience or experience in Australia for the Post Australian Study pathway but must be completed after the relevant Australian degree.
