2023년 4월 1일 부터 가정폭력 (family violence) 관련 법조항이 바뀜에 따라 구체적인 증거를 제출해야 합니다.

아래 내용은 관련 내용으로서 최소한 2가지 다른 유형의 증거를 제출해야 하며 letterhead 에 작성되어야 하며 아래 내용이 담겨야 합니다.

4  Types of evidence

(1) For the purposes of paragraph 1.24(b) of the Regulations, the types of evidence mentioned in Schedule 1 are specified.

(2) All items of evidence must be sufficiently detailed and include the required information as mentioned in Schedule 1.

(3) All items of evidence provided by a person, officer or provider mentioned in Schedule 1, must be in writing in English on their professional letterhead or the professional letterhead of their organisation, and include the following details:

(a) full name; (b) occupation; (c) signature; (d) date; (e) address; and (f) contact phone number.

Family Violence – Evidentiary requirements

Migration (Specification of evidentiary requirements—family violence) Instrument (LIN 23/026) 2023 – F2023L00382 repeals IMMI 12/116 and more clearly specifies the type of information and evidence required as evidence of family violence.

This Instrument also specifies new additional forms of acceptable evidence from the professional providing the evidence of family violence, in addition to the current forms of evidence.

Transitional arrangements – Anything done under the previous Instrument IMMI 12/116 continues to be in effect as if it was done under that Instrument.

This Instrument repeals IMMI 12/116 and commences on 31 March 2023 and sunsets on 1 April 2033.
