학생비자거절된 후 AAT 재심을 신청하지만 학생의 손을 들어주진 않은 실제 케이스 (물론 제 케이스는 아님)

그 이유는 공부를 할 목적이 아니고 거주의 목적이라고 재심관은 판단함.

처음 호주에 훠킹할러데이 비자를 소지하고 왔고.  그후 워홀비자 한번 더 그란트됨.

그후 학생비자를 계속 신청하면서 호주에 거주를 함.

1. Certificate III in Business;
2. Certificate IV in Business;
3. Diploma of Management;
4. General English;
5. Certificate IV in Marketing;
6. Diploma of Marketing;
7. Advanced Diploma of Marketing;
8. Certificate IV in Leadership and Management;
9. Diploma of Leadership and Management; and
10. Advanced Diploma of Leadership and Management.

문제는 Cert III & IV 조차도 마치진 못함.

영어 능력 부족으로 학업을 중단후 영어코스로 바꿈.

그후 Cert III & IV in Marketing 를 마침

또한 an Advanced Diploma of Leadership and Management 도 마침.

그리고 2011년 과 2022년 동안 다시 원래 코스를 듣기 위한 학생비자를 신청하지만

이미 39살이 된 그가 2014/2015년도에 등록하고 마친 코스를 Advanced Diploma of Business 를 공부하겠다고 하는 것에 대해 이민성과 재심관은 호주에 이미 10년이나 거주했는데 더 거주를 하려는 목적이라고 보고 비자 거절 + 비저 거절한 것을 인정하는 판결을 내림.

63. I do not make adverse findings regarding the remaining factors relating to the applicant’s immigration history. There is nothing to indicate that the applicant has not complied with the conditions of his visas in Australia. There is nothing to indicate that he has an adverse visa or migration history to any other country. There is nothing to suggest that he has previously been refused a visa application or had a visa cancelled or considered for cancellation. There is nothing to indicate that he has any other applications for a different class of visa which are yet to be finally determined. However, for the reasons provided above, I have concerns that the Student visa may be used primarily for maintaining ongoing residence. I give weight to the applicant’s circumstances that indicate that the Student visa is intended primarily for maintaining residence in Australia.
