호주에서 공부를 하려고 한다면 학생비자를 신청해야 합니다.

GTE 라고 해서 Genuine Temporay Entry라는 항목을 만족을 해야 합니다.

관광을 할 목적으로 호주에 올때는 한국인들은 ETA 라는 관광비자를 받고 입국합니다. 호주에서 와서 짧은 기간에 자신의 career를 깊이 생각하고 코스 및 공부를 할 계획으로 바뀌어 학생비자를 신청한다고 할때 상식적으로 이게 이해가 될까요? WHM 비자를 받고 와서 1/2/3년을 지내다가 공부를 하고자 학생비자를 신청하는 것은 훨씬 타당할 수 있겠지만 잠시 여행을 목적으로 왔다가 학생비자를 신청할 경우 과연 어떤 결과가 나올까요?

이민성에서 비자가 거절되고 AAT 재심을 신청하지만 이민성의 손을 들어 줍니다.

바로 이런 내용으로 (즉, 관광하러 왔다가 그 짧은 기간에 모든 공부와 생활 옵션을 즉각적으로 연구하고 2년간의 공부를 하기 위해서 호주에 남기로 결정했다?) 믿기 어렵다고 재심관은 봅니다. 

The Tribunal is troubled by the way in which the applicant arrived onshore (being on a tourist visa and only then, once onshore, applying for a student visa). It is difficult for the Tribunal to accept that the applicant, in such a short space of time after their arrival onshore as a tourist, could have then promptly researched all study and living options and decided to remain onshore for a further two year period. The Tribunal accepts that it is possible that an applicant may seek a change in plans or to further their skills for employment reasons and remuneration opportunities, but the Tribunal is puzzled when an applicant arrives on a visitor visa and then makes sudden changes to their plans within a short period of time after arriving. It seems unlikely to the Tribunal that a person travelling as a tourist would make such a significant change from their initial intentions to visit. Such a significant change would necessarily include a greater level of planning and preparation before arriving in Australia considering the length of time (two years) that the applicant proposed to spend in Australia; 짧은 기간에 자신의 유학결정을 하는 것은 상식적이지 않다고 보는 것입니다. 그 코스를 공부를 하면 향후 급여나 취업에 도움이 된다는 것은 인정한다고 하면서도. 즉 코스 연구 자체가 잘못된 것은 아니라는 점. 그러나 그런 결정을 관광비자로 와서 그 짧은 시간에 2년동안 호주에 남아 공부를 하겠다고 결정한다? 좀 믿기 어렵다는 결론입니다.

때로는 상식에서 벗어나면 안된다는 케이스로 결국 관광비자로 와서 학생비자를 신청할 때 학생비자 거절될 Risk 가 있음 내지는 높다고 할 수 있겠습니다.
