Ms S* Kim Mr J* Kim 호주에서 2년 넘게 공부를 하고 485 비자를 신청했지만 불행하게도 비자 거절되고 또한 그 이후로 AAT 어필을 했지만 AAT에서도 손을 들어주지 않고 이민성에서 결정한 거절을 확정지었습니다. 그 케이스를 공유합니다. 2018년 4월 18일 – 485 비자 신청함 두사람 중에 한 사람이 주신청자로서 485 비자를 만족해야 함 (그란트 되기 위해서) 2020년 11월 19일 – 첫번째 청문회 열림 (신청인 참가함) 2020년 12월 4일 – 두번째 청문회 열림 (신청인 참가하지 못함; 코비드때문; 전화로 대체함) 아래와 같이 공부를 했습니다. Certificate IV in Commercial Cookery commenced 13 July 2015 and completed on 18 November 2016. Diploma of Hospitality commenced 31 January 2017 and completed on 16 June 2017. Diploma of Business Commenced 4 September 2017 and Completed on 25 March 2018. 그런데 어쩐 일인지 1번과 2번 코스만 마치고 485 비자를 신청했어야 하는데 3번 코스까지 공부를 했어요. (주석: 신청인이 어쩌면 영어 성적 확보가 안되어서 시간을 충분히 갖고 영어 성적을 확보하려고 했나? 하는 추측을 해 봄) 그러나 3번 코스를 함에 따라 예상하지 못한 문제 (issue)가 야기 됩니다. 일명 “closely related” 이라고 하여 신청하려는 직업군은 Chef 인데 Chef가 되는 과정의 코스와 관련이 없기 때문에 나중에 아래와 같이 비자가 거절되는 사태가 발생 ㅠ The delegate refused to grant the visas because the first named applicant (the applicant) did not satisfy cl.485.222 of Schedule 2 to the Regulations because the Diploma in Business (the Diploma) was not closely related to the applicant’s nominated occupation of Chef ANZSCO code 351311. 신청인이 공부를 했다는 마지막 코스의 내용은 아래와 같습니다. In her submission, the applicant provided the Tribunal with the Units of Competence of the Diploma course from the Australian College of Technologies and Business Pty Ltd. The Diploma set out those units detailed below: Interpret market trends and developments. Design and develop an integrating marketing communication plan. Manage people performance Manage recruitment, selection and induction process. Lead and manage team effectiveness. Manage meetings. Undertake project work. Manage risk. 해당 과목들은 그녀가 선택한 Chef와는 거리가 멀다고 판단을 합니다. The Tribunal is not satisfied that the Diploma of Business is closely related to the occupation of chef, for the reasons above. As the applicant’s Diploma qualification is not closely related to the nominated skilled occupation, the applicant does not meet cl.485.222. Based on the above findings, the applicant does not satisfy the criteria for the grant of a Subclass 485 visa. As this is the only relevant subclass in this case, the decision under review will be affirmed. 그래서 결국 case officer의 거절을 확정짓게 되었습니다. 지피지기이면 백전백승인데 이점은 (As the applicant’s Diploma qualification is not closely related to the nominated skilled occupation, the applicant does not meet cl.485.222.) 몰랐던 것 같습니다. 현재 cookery 공부를 하시는 분들은 가능한 영어 성적을 미리 확보해 두세요. 시간이 없다고 아무 코스나 연장하면 안됩니다. 관련 있는 코스를 선택해야 합니다. Last update: 2021년 6월 15일 PS 특이 사항: 케이스를 읽어 보면 알 수 있지만 신청인은 2018년 12월 20일 일을 마치고 귀가하는 중에 몇몇 사람들도 부터 폭행을 당해서 이로 인해 병원치료 및 trauma 치료등 AAT 재심이 늦어지는 사태는 있었지만 그렇다고 애초에 문제가 된 Diploma of Business 관련 Chef라는 코스와 “Closely related” 라는 것은 문제해결이 전혀 도움이 안되었음. 왜냐하면 폭행과 폭행전의 코스 이수한 것은 서로 상관관계가 없기 때문. 물맑은 호주이민닷컴 이민법무사 (0208335) 신순철

호주에서 2년 넘게 공부를 하고 485 비자를 신청했지만 불행하게도 비자 거절되고 또한 그 이후로 AAT 어필을 했지만 AAT에서도 손을 들어주지 않고 이민성에서 결정한 거절을 확정지었습니다.

2018년 4월 18일 – 485 비자 신청함

두사람 중에 한 사람이 주신청자로서 485 비자를 만족해야 함 (그란트 되기 위해서)

2020년 11월 19일 – 첫번째 청문회 열림 (신청인 참가함)

2020년 12월 4일 – 두번째 청문회 열림 (신청인 참가하지 못함; 코비드때문; 전화로 대체함)

아래와 같이 공부를 했습니다.

Certificate IV in Commercial Cookery commenced 13 July 2015 and completed on 18 November 2016.

그런데 어쩐 일인지 1번과 2번 코스만 마치고 485 비자를 신청했어야 하는데

3번 코스까지 공부를 했어요. (주석: 신청인이 어쩌면 영어 성적 확보가 안되어서 시간을 충분히 갖고 영어 성적을 확보하려고 했나? 하는 추측을 해 봄)

그러나 3번 코스를 함에 따라 예상하지 못한 문제 (issue)가 야기 됩니다.

일명 “closely related” 이라고 하여 신청하려는 직업군은 Chef 인데 Chef가 되는 과정의 코스와 관련이 없기 때문에 나중에 아래와 같이 비자가 거절되는 사태가 발생 ㅠ

신청인이 공부를 했다는 마지막 코스의 내용은 아래와 같습니다.

The Tribunal is not satisfied that the Diploma of Business is closely related to the occupation of chef, for the reasons above.
As the applicant’s Diploma qualification is not closely related to the nominated skilled occupation, the applicant does not meet cl.485.222.
Based on the above findings, the applicant does not satisfy the criteria for the grant of a Subclass 485 visa. As this is the only relevant subclass in this case, the decision under review will be affirmed.

그래서 결국 case officer의 거절을 확정짓게 되었습니다.
