사람이 살다 보면 평생을 함께 할지 단 수개월을 함께 할지 모르는 인간관계가 있다면 아마도 부부관계 / 사실혼 관계일 것입니다. 결혼을 하고도 얼마후 이혼을 하는 경우도 있고요. official de facto관계에 있다가도 헤어지고 다른 파트너를 찾아 official de facto관계로 들어 가는 경우도 있습니다.

여기서 한가지 고려되는 부분은 official de facto 관계를 예를들어 VIC주에서 했는데 상대 파트너와 헤어지고 다른 파트너와 NSW주에 사실혼 관계를 등록 (일면 relationship registration)을 하고자 할때 VIC주에 서 완전히 등록이 해제된 다음에 NSW BDM기관에서 등록을 해 준다는 점입니다.

그 내용을 제가 문의하여 확인한 내용을 오늘 답변을 받았고 그 내용을 공유합니다.

Thank you for your enquiry.

As per our policy on who can apply:

To apply to register your relationship in NSW both partners must be:

• over 18 years of age
• not married to each other or anyone else
• not already in a registered relationship under this Act or in another state or territory in Australia
• not in a relationship with another person
• not related by family

They cannot apply to register a relationship in NSW until the relationship registered in Victoria has been revoked and finalised. (제가 확답을 원했던 내용입니다)

Once we have received the application and everything is complete and correct, there is a cooling off period of 28 days before the relationship is registered and certificate issued.

현재 de facto관계에 계신분들이 파트너비자를 고려하는 분들이 있다면 참고하시고요. 언제든지 상담 환영입니다.

PS Relationship Registration이 합법적으로 된 경우 12개월 de facto 관계에서 그 12개월을 면제 (waiver) 받을 수 있습니다. 그럼에도 불구하고 genuine relationship / on-going relationship을 waiver 받는 것은 아님에 꼭 잊지 마세요. (Very important)
