189 / 190 / 491 비자를 위해서 주신청자는 나이 조건이 45세로 되어 있습니다.
정확히 맞는 말씀이고요.
그러나 그 주신청자의 배우자나 함께 거주하며 주신청자가 모시는 부모님이 계신 경우 45세가 넘을 수 있겠죠? 예를들어 주신청자는 39세인데 남편이 45세가 되었고 함께 거주하시는 부모님이 70세가 넘었다 할지라도 190 / 189 / 491 비자를 위해서 남편과 자신의 부모님을 함께 비자 신청에 포함을 할 수 있습니다. (참고로 부모님이라고 해서 다 포함시킬 수 있는 것은 아닙니다. 부모님이 같은 집에 내가 부모님을 모시고 계신 경우 이런 경우 가족 구성원으로 인정되어 비자를 함께 신청할 수 있어요. 마치 자녀 포함하는 것과 같은 논리입니다)

따라서, 45세 또는 그 이상의 신청인, 다른 말로 secondary applicant는 45세 조건과 아무런 관계가 없다. 즉 45세 넘든 넘지 않든 무관하고 그외 직업군 / 기술심사 통과여부 / 노미네이션 승인 여부와 무관한 것과 같은 논리로 45세 라는 나이 조건은 secondary applicant에 해당이 되는 배우자 (남편이든 부인이든) 부모님이든 그들은 위의 1-5번 조건을 만족할 필요가 없다! 입니다.
그런데 만약에 배우자의 경우 배우자가 학력, 경력, 직업군, 영어 능력이 있어서 10점을 파트너점수를 받고자 할때는??? 이때는 배우자도 나이가 45세 이내이어야 합니다.
(관련 이민법 6D.11의 6D111 이란 아이템에 명확하게 명시되어 있음.)

결론적으로 정리하면, 주신청자는 어떤 경우라도 45세 이내라는 나이 제한이 있다.
배우자/ 부모님의 경우는 45세 조건과 무관하다.
그러나 배우자의 경우 배우자 점수 10점을 얻고자 할 때는 나이 제한 45세가 적용된다는 점이 특이 사항입니다.
