호주 이민법에는 비자를 신청할 때의 신청인의 위치 (호주 내 / 외) 그리고 그란트 될 때 신청인의 위치 (호주 내 / 외) 가 잘못된 경우 비자가 거절될 수 있습니다.

Where the applicant must be to be granted a visa

Usually – see regulation 2.04 and Schedule 2 clause 4 – the Regulations specify where the applicant must be (that is, in or outside Australia) to be granted their visa. (Even for combined visa applications, the requirement applies to each applicant.) An applicant who is in the wrong location at the time of decision must be refused their visa.

Delegates should check local records (for example, movements data base for applications made in Australia) to verify the whereabouts of the applicant at the time a decision is to be made.

Applicants who:

• applied for their visa in Australia (호주에서 비자를 신청하고)
• leave and are outside Australia at the time of decision and (비자 결정될 때 호주 밖에 있을 경우)
• are refused the visa as a result of being “in the wrong place” when the decision is being made  (비자 결정될 때 잘못된 위치에 있음에 따라 비자가 거절됨)

are ineligible for merits review of the decision to refuse unless they return to Australia (for example, on a BVB, if held) within the period for making a review application. In other words, although the decision to refuse in these circumstances might be merits reviewable, the applicant is unable to make a valid review application unless they are in the migration zone. (이렇게 거절된 경우 BVB를 소지하고 돌아 오지 못할 경우 AAT 재심 신청이 불가능함)

In this situation, the s65 delegate should:

• in order to comply with the requirements of s66(2)(d) of the Act, notify the applicant that the decision to refuse is merits-reviewable but
• clarify that the applicant must be in the migration zone to make a valid application for merits review.  (재심을 신청하기 위해서는 호주 땅에 거주하고 있어야 함)

485 비자의 경우 주신청자와 가족의 비자 그란트는 아래와 같은 위치에 있어야 합니다.

As provided by:

• 485.411(1) and 485.411(2) – the primary applicant and each applicant who made a combined application with the primary applicant must be in Australia to be granted their visa (주신청자와 동반 비자 신청인, 배우자 그리고 / 또는 자녀가 주신청자와 함께 신청한 경우 비자 확정시점에 신청인들 모두 반드시 호주에 있어야 함)
• 485.411(3) – family unit members who are subsequent entrants may be in or outside Australia at the time of visa grant. (주신청인이 이미 485 비자가 그란트 된 다음에 가족 구성원이 485 비자를 신청하는 경우는 비자가 결정될 시점에 신청인이 호주내 또는 호주 밖에 있어도 됩니다.)
