필리핀에서 2008년 호주로 와서 다양한 코스를 공부한 한 필리핀 여성
그러나 2017년도 학생비자를 신청하지만 거절된다.
그리고 AAT 에 재심을 신청하지만
AAT 심사관은 주요하게 아래 내용을 언급하면서
그녀의 코스가 그녀가 필리핀에서 공부했던 것과 상황
그리고 호주에서 공부하려고 했던것과 상황 및 향후 공부하여 필리핀으로 돌아가 어린이집운영을 하겠다는 것에 대한 판단을 하게 된다.

한마디로 AAT 심사관도 아래의 내용을 검토하고 또한 직접 답변 기회를 두번이나 제공하지만 신청인의 말과 제출된 서류가 비현실적이며 일관성이 없다고 판단 이민성의 최종결정에 손을 들어 준다.

학생비자를 신청할 때 반드시 GTE 라고 하여 Genuine Temporary Entrant를 꼭 만족해야 한다. 학생비자의 신청 또는 연장이 호주에서 거주의 목적이나 영주하려고 하는 의도가 있거나 하면 이처럼 비자가 거절되고 결국 호주를 떠나야 한다.

1. 1. 32. Under Direction No.53, I must have regard to the applicant’s circumstances in her home country and her potential circumstances in Australia. (신청인이 자국에서 상황 호주에서 상황을 고려해야 한다)
      33. In considering the applicant’s circumstances in her home country, I must have regard to whether the applicant has sound reasons for not undertaking the study in the Philippines, the applicant’s personal ties to the Philippines and whether this would serve as a significant incentive to return and whether there are significant incentives for the applicant not to return home, such as economic circumstances, military service commitments or political and civil unrest. (필리핀에서 공부하지 않은 이유가 타당한지 검토한다. 필리핀으로 돌아가면 아주 큰 도움이 되는지 아니면 돌아 갈 수 없는 상황인지도 검토)
      34. In considering the applicant’s circumstances in Australia, I must have regard to the following factors, which are relevant to her case: (호주내 상황도 검토)
          (1) whether the applicant has ties with Australia that would present a strong incentive for her to remain;

(2) evidence that the visa program is being used to circumvent the intentions of the program;

1. (3) whether the program is being used to maintain ongoing residence; and

(4) the applicant’s knowledge of living in Australia and her intended course of study.

35. Under Direction No.53, I must also have regard to the value of the proposed course to the applicant’s future. In particular, I must have regard to whether the course the applicant is undertaking is consistent with her current level of education and whether this course will assist her to obtain employment in the Philippines, the relevance of the course to the applicant’s past and future employment in the Philippines or another country and the remuneration the applicant could expect to receive in the Philippines compared with Australia using the qualifications gained. (현재 학업수준에 도움이 되고 향후 자국으로 갔을 때 고용에 도움이 되는지도 고려)

36. Direction No.53 provides that I must have regard to the applicant’s immigration history, including previous visa applications for Australia or other countries, previous travel to Australia or other countries, including, relevant to the facts in this case, the amount of time the applicant has spent in Australia and whether the visa may be used for maintaining ongoing residence. (신청인이 가지고 있는 비자기록도 보게 된다)

학생비자를 신청하기전에 충분히 위의 조항에 만족하는지 여부 그리고 관련 서류 준비가 철저히 되어야 학생비자 그란트라는 결과가 도래할 것입니다.
