Australian study requirement (호주 유학을 마치면 얻는 5점을 얻기 위해서) 반드시 아래 조건을 만족해야 합니다.

하일라이트 해 놓은 부분의 link를 클릭하면 아래와 같은 자세한 내용을 볼 수가 있습니다. (해당 내용은 저같은 이민법무사들이 참고하는 이민법임) 보시면 아시겠지만  관련 이민법에 아주 자세하게  문장하나 하나 그리고 단어 하나하나에 부연 설명이 있습니다. 이렇게 법을 늘~~ 검토하고 상담해 드려야 합니다. 호주에서 단순하게 2년 공부하면 5점을 받느냐에 대한 질문은 간단하지만 이민법무사의 답변은 쉽지 않아요.  관련 법 아래와 같이 공유하면서 comment 드리오니 유학생들은 참고하세요.

(1)  A person satisfies the Australian study requirement if the person satisfies the Minister that the person has completed 1 or more degrees, diplomas or trade qualifications for award by an Australian educational institution as a result of a course or courses:  (신청이 한 개 또는 여러 개의 결과물로서 호주 교육기관이 부여한 수료증으로 아래의 조건을 만족하는 코스의 한 개 또는 여러 개의 degree, diploma 또는 trade qualifications를 마친 경우)

(a)  that are registered courses; and (호주기관에 등록된 코스일 것)

(b)  that were completed in a total of at least 16 calendar months; and  (최소 전체 16개월은 되어야 함)

(c)  that were completed as a result of a total of at least 2 academic years study; and (최소 학제가 2학년일 것. 최소 92주; 밑에 관련 내용 참고)

(d)  for which all instruction was conducted in English; and  (영어로 수업 진행되어야 함)

(e)  that the applicant undertook while in Australia as the holder of a visa authorising the applicant to study. (신청인이 합법적인 비자를 소지하고 호주에서 공부했어야 함)

Note:    Academic year is defined in regulation 1.03. (Academic year라는 정의는 아래와 같이 이민법 1.03 에 정의되어 있음)

(2) completed, in relation to a degree, diploma or trade qualification, means having met the academic requirements for its award. (degree, diploma 또는 trade qualification 와 관련하여 ‘마치다’ 라는 뜻은 수료증을 위해서 학업조건을 만족했음을 의미함)

Note:   The academic requirements for the award of a degree, diploma or trade qualification do not include the formal conferral of the degree, diploma or trade qualification. Therefore, a person can complete a degree, diploma or trade qualification, for subregulation (2), before the award is formally conferred. (degree, diploma 또는 trade qualification의 수료를 위해서 학업조건은 해당 수료증의 공식적인 수여식을 포함하지 않음에 유의. 즉 졸업식까지 기다릴 필요는 없고 마지막 학기의 마지막 수업을 마치면 학업조건을 만족하게 됨의 의미)

Academic year means a period that is specified by the Minister as an academic year in an instrument in writing for this definition. (academic year란 아래와 같이 이민성 장관이 기술한 내용을 의미함)

DEFINITION OF ‘ACADEMIC YEAR’ (학년의 정의)

(REGULATION 1.03)

(a) 1 academic year is at least a total of 46 weeks, being the duration of a course or courses registered under s 9 of the Education Services for Overseas Students Act 2000; (1 학년은 코스/코스들의 기간이 최소 전체 48주임)

(b) 2 academic years is at least a total of 92 weeks, being the duration of a course or courses registered under s 9 of the Education Services for Overseas Students Act 2000; (2 학년은 코스/코스들의 기간이 최소 전체 92주임)

(c) 3 academic years is at least a total of 138 weeks, being the duration of a course or courses registered under s 9 of the Education Services for Overseas Students Act 2000; (3 학년은 코스/코스들의 기간이 최소 전체 138주임)

기능직에 해당하는 코스의 경우 반드시 최소 Cert III 는 되어야 함에 유의

trade qualification means:

(a)  an Australian trade qualification obtained as a result of the completion of:

(i)  an indentured apprenticeship; or

(ii)  a training contract;

that is required by State or Territory industrial training legislation or a relevant Federal, State or Territory industrial award and involves:

(iii)  part-time formal training at a technical college or a college of technical and further education; and

(iv)  employment within the meaning of:

(A)  an industrial award under a law of the Commonwealth or of a State or Territory; or

(B)  a law of a State or Territory dealing with commercial or industrial training; or

(b)  a qualification, under the Australian Qualifications Framework, of at least the Certificate III level for a skilled occupation in Major Group IV in the ASCO; or

(c)  a qualification, under the Australian Qualifications Framework, of at least the Certificate III level for a skilled occupation in Major Group 3 in ANZSCO.

참고로 이 호주내 2년 full-time 공부를 통해 얻는 5점은 신청인이 지정한 직업군과 관련되어야 한다는 요구조건은 없다는 점. 예를 들어, 단순히 2년 유학을 함으로서 추가 점수를 얻고자 한다면 이런 경우는 즉, 신청인이 향후 mechanical engineer / IT 직업군으로 신청하려고 한다면 공부는 마케팅이나 또는 다른 분야의 공부를 해도 된다는 의미.

Item 6D81 does not require the eligible Australian study being claimed to be relevant to the applicant’s nominated occupation. Nor is it relevant when the study was completed, provided the applicant met it at the time of invitation.

한가지 더 주의할 점은 유학할 때 비자는 반드시 관련된 학생비자, BVA 또는 BVB를 소지한 상태에서 공부한 경우에 해당이 되며 그 외의 비자를 소지한 상태에서 공부한 경우는 Australian study 조건을 만족하지 못함에 유의.

Consistent with regulation 2.27D, study undertaken in Australia for the purposes of meeting the Australian study requirement and being awarded points under 6D.8 will only be considered if, throughout the relevant period, the applicant held a substantive visa or an applicable bridging visa that allowed them to study, and they complied with the conditions of that visa.

해당 비자는 아래 이민법에 분명하게 명시되어 있음.

Reg 2.27D    Study in Australia

In determining whether an applicant satisfies a criterion for the grant of a General Skilled Migration visa that the applicant has studied in Australia for a certain period, a period of study cannot be counted unless the applicant:

(a)  held:

(i)  a substantive visa; or (예를 들어 학생비자 또는)

(ii)  a Subclass 010 (Bridging A) visa; or (BVA 또는)

(iii)  a Subclass 020 (Bridging B) visa; (BVB)

authorising him or her to study during that period; and (공부하는 기간 동안 세가지 유형중에 한가지의 비자를 소지하고)

(b)  complied with the conditions of that visa. (해당 비자의 비자 조건을 지켜야 함)
