먼저 408 비자에 어쩌면 8503 이라고 하여 No further stay (호주내 비자 연장 불가) 조건이 붙을 수도 있습니다 (may be imposed) 만 반드시 비자 조건이 할당될 것이라는 보장 (guarantee)는 없습니다.

(a) the visa is subject to condition 8303; and
(b) conditions 8106, 8301, 8501, 8502, 8503, 8516, 8522, 8525 and 8526 may be imposed.
그럼에도 불구하고 질문자의 조건이 과연 408 비자의 이번 COVID-19에 의하여 신청자격이 될까?

지금 너나 할 것 없이 비자 신청에 약간씩 문제를 야기하고 있습니다.
직장을 잃어서 조건을 맞추는데 어려운 분들도 계시고
On-shore 비자 신청을 해야 하는데 해외 밖에 있어서 입국 못해 신청 못하는 분들도 계십니다.
질문자의 조건은 제가 볼 때 큰 문제는 아니라고 보여 집니다.
조건을 일단 만들어야 합니다. (즉 밑에 조건 (3B.(c)) 에 해당하는 것임) 을 만들어 둬야 합니다.
그리고 비자는 호주 안에서 또는 호주 밖에서 신청이 가능합니다. (대한민국 아니어도 됨)
(3A) If the applicant is not, and has not previously been, in Australia as the holder of a Subclass 417 (Working Holiday) visa, the applicant: (참고로 한번도 WHM 비자를 소지 않은 분의 경우는 반드시 호주 밖에서 신청해야 합니다. ) (3A(a)이 조항이 바로 그런 내용을 언급하는 것임)
(a) is outside Australia; and
(b) holds a working holiday eligible passport.
(3B) If the applicant is, or has previously been, in Australia as the holder of a Subclass 417 (Working Holiday) visa: (두번째 워홀러 비자를 신청하는 분들에게 적용되는 법임)
(a) the applicant may be in or outside Australia, but not in immigration clearance; and
(c) if the applicant has held only one Subclass 417 (Working Holiday) visa— the application must be accompanied by a declaration by the applicant that he or she has carried out specified work in regional Australia for a total period of at least 3 months as the holder of that visa; and
(ca) if the applicant has held 2 Subclass 417 (Working Holiday) visas in Australia—the application must be accompanied by a declaration by the applicant that: (세번째 워홀러 비자를 신청하는 사람에게 적용되는 법문임)
(i) the applicant has carried out specified work in regional Australia for a total period of at least 6 months; and
(ii) all of that work was carried out while the applicant held the second Subclass 417 (Working Holiday) visa or while the applicant held a bridging visa that was in effect and was granted on the basis of the application for the second Subclass 417 (Working Holiday) visa (made at a time when the applicant held the first Subclass 417 (Working Holiday) visa); and
(iii) all of that work was carried out on or after 1 July 2019; and
(d) the applicant has not held more than 2 Subclass 417 (Working Holiday) visas in Australia (including any Subclass 417 (Working Holiday) visa held by the applicant at the time of application); and
(e) the applicant holds a working holiday eligible passport; and
(f) if the applicant is in Australia, the applicant must:
(i) hold a substantive visa; or (만약 408 비자를 가지고 있었고 8503No further stay 조건이 없을 경우 호주내에서 비자 신청이 가능함)
(ii) have held a substantive visa at any time in the period of 28 days immediately before making the application.
결론적으로
1. 일단 이 조건 a total of 3 month work experience in regional area(s) 을 꼭 만족해야 합니다.
2. 408 비자 신청을 할 수 있다고 스스로 판단하면 신청해도 됩니다.
3. 1번 조건을 만족해 둔 상태에서 나중에 2nd WHM visa를 신청할 수 있습니다. (참고로 신체검사는 신청할 때 필수가 아닌 비자결정할 때 필수임 즉, 만기전에 2nd visa 신청후 신체검사결과를 받아도 됨; 대신 신체검사 부킹을 한 것은 제출하는 것이 better off)
4. 2번이 불가하며 417비자를 호주 / 호주에서 자신의 여건에 따라 신청할 수 있습니다.
5. 뭘 어떻게 결정을 못하겠다고 생각하시면 55불 지불하고 상담을 받아 볼 수도 있다. (It’s up to you!)
