[AAT재심 케이스연구] 파트너비자 820 거절 12개월 관계 vs Relationship Registered – 실제케이스

아래 내용은 파트너비자 820를 신청한  분이 이민성에서는 거절당하고 그 후 AAT 어필하여 인정된 케이스입니다.

 

Time frame 별로 정리하면 아래와 같습니다.

 

2015년 6월 18일: 호주시민권자와 de facto 관계 시작

2016년 1월 6일: 820 비자 신청

2016년 1월 20일: Relationship 등록후 certificate 제출

2017년 8월 24일: 비자거절 (사유 12개월 만족 하지 못함)

2019년 10월 30일: AAT hearing 행함

 

그런데 이 케이스가 이민성 Case officer 입장에서 봤을때는 12개월 de facto relationship을 만족하지 못한다고 봤고 (비록 relationship을 등록했음에도 불구하고) 이유는? 비자 신청시점에서 12개월 만족을 하던지 아니면 Relationship registration이 되었어야 한다 법에 근거하여 판단을 했다고 보여집니다.

A delegate of the Minister for Immigration refused to grant the applicant a Partner visa[1] on the basis of his relationship with his Australian citizen partner. The AAT remitted the application with the direction that the applicant met criteria for a Subclass 820 (Partner) (Temporary) visa.

The AAT examined the relationship between the applicant and his sponsor and considered whether they met the requirements for the granting of the visa. The aspects of the relationship considered by the AAT included the applicant and sponsor’s living and financial arrangements, employment, social activities, support from immediate family and future intentions, among others.  At the hearing, the AAT was satisfied that the applicant and sponsor provided candid and spontaneous responses about their relationship, which were also corroborated by their witnesses and documentary evidence. The AAT found that the parties had maintained a continuous relationship and lived together in an exclusive and committed relationship from the 15 June 2015 until the present.

The parties also had to show that they were in a de facto relationship for 12 months before the date of visa application[2]. This requirement does not apply in certain circumstances, including where a relationship has been registered under a State or Territory law.[3] Based on the evidence before it, the AAT found that the applicant and sponsor first met in person and commenced living together on 15 June 2015, before applying for a temporary partner visa on 6 January 2016. This meant that they were not in a de facto relationship for 12 months at the time of visa application. However, the parties had registered their relationship on 20 January 2016. Therefore, the additional criterion was satisfied even though the parties had been in a de facto relationship for less than 12 months at the time they applied for the visa.

여기서 가장 중요한 부분은 바로 아래내용이라고 보여집니다.

The AAT found that the parties had maintained a continuous relationship and lived together in an exclusive and committed relationship from the 15 June 2015 until the present.

즉, 신청인과 스폰서는 즉각적인 답변을 함으로서 자신들의 관계를 증명했고 2015년 6월 15일부터 현재 (당시 2019년 10월 30일 hearing 있는 날까지) 실제 함께 살고 그 관계가 계속 유지되어 있음을 보여줬고 지인들도 대동하여 증인으로 배석해 줬으며 다양한 자료를 보여 줌으로서 12개월 de facto relationship 을 보여주거나 또는 relationship registration을 한 것을 보여줘야 하는 법을 인정받은 것으로 해석됩니다.

 

실제 관련비자 정책에는 분명히 명시되어 있습니다.

 

Regulation 2.03A provides that, at time of application, if the partner visa applicant is claiming a de facto relationship with their Australian partner, they must both:

  • be at 18 years old – regulation03A(2)and
  • have been together in a de facto relationship for at least 12 months – regulation 03A(3).

 

따라서 이민성의 case officer도 잘못한 결정은 아닙니다.

정책 (policy)해석을 잘 했지만 AAT에서는 그 정책보다 더 우선하는 이민법 (Migration ACT)

아래법을 더 중요시했기 때문에 신청인의 손을 들어준 케이스라고 이해됩니다.

De facto partners

(1)  For the purposes of this Act, a person is the  de facto partner of another person (whether of the same sex or a different sex) if, under subsection (2), the person is in a de facto relationship with the other person.

De facto relationship

(2)  For the purposes of subsection (1), a person is in a  de facto relationship with another person if they are not in a married relationship (for the purposes of section 5F) with each other but:

(a)  they have a mutual commitment to a shared life to the exclusion of all others; and

(b)  the relationship between them is genuine and continuing; and

(c)  they:

(i)  live together; or

(ii)  do not live separately and apart on a permanent basis; and

(d)  they are not related by family (see subsection (4)).

(3)  The regulations may make provision in relation to the determination of whether one or more of the conditions in paragraphs (2)(a), (b), (c) and (d) exist. The regulations may make different provision in relation to the determination for different purposes whether one or more of those conditions exist.

Definition

(4)  For the purposes of paragraph (2)(d), 2 persons are related by family if:

(a)  one is the child (including an adopted child) of the other; or

(b)  one is another descendant of the other (even if the relationship between them is traced through an adoptive parent); or

(c)  they have a parent in common (who may be an adoptive parent of either or both of them).

For this purpose, disregard whether an adoption is declared void or has ceased to have effect.

 

향후 파트너비자를 신청하는 분들은 그렇다고 하여 이런 사례가 있다고 하여 de facto 12개월 조건 또는 relationship registration 을 등한시 하면 안되겠습니다.

왜냐하면 이렇게 AAT appeal 까지 해야 한다면 time frames 에서 보는 것처럼 마음 고생이 얼마나 심하겠어요. 이런 폭탄은 제거하는 것이 깔끔하게 grant 될 수 있는 지름길이 아닐 수 없습니다.
