아래 나열된 직업군이 RSMS  (direct entry stream에 의한) 비자를 위해서 반드시 기술심사가 필요한 직업군입니다.

만약에 아래의 직업군이라 할지라도 관련 학위를 호주공부하고 취득한 경우에는

기술심사 (skill assessment)대신에 RPL 이라는 것 (학위만으로)을 통해서 대체가 가능합니다.

If an applicant is nominated for a trade occupation as specified in the legislative instrument but they have relevant Australian qualifications, 187.234(b) does not apply and the applicant needs to be assessed against 187.234(c).

다시말해, 아래 직업군이면서 호주 밖에서 관련학위를 얻는 경우는 반드시 기술심사 (positive skill asserssment)가 필요하다.

If a person is nominated for a trade occupation specified in the legislative instrument but does not have a relevant Australian trade qualification, they must have a positive skills assessment from TRA or VETASSESS (as appropriate).

아래에 해당하는 경우는 (기술심사 없이) RPL로 대체가 가능한 경우

(i)  the applicant’s occupation was not specified by the Minister in an instrument in writing for subparagraph (b)(i), or the applicant obtained the necessary qualification in Australia; and (아래의 직업군에 속하지 않거나 또는 호주에서 필요한 학위를 얻은 경우) 그리고

(ii)  the applicant had the qualifications listed in ANZSCO as being necessary to perform the tasks of the occupation. (그 해당 직업군의 일을 수행하는데 필요한 ANZSCO에 나열된 자격을 가진 경우)

187.234  (관련 이민법)

At the time of application:

(a)  the applicant was a person in a class of persons specified by the Minister in an instrument in writing for this paragraph; or 

(b)  all of the following requirements were met:

(i)  the applicant’s occupation is specified by the Minister in an instrument in writing for this subparagraph;

(ii)  the applicant did not obtain the necessary qualification in Australia;

(iii)  the applicant’s skills had been assessed as suitable for the occupation by an assessing authority specified by the Minister in the instrument for subparagraph (i) as the assessing authority for the occupation;

(iv)  the assessment was not for a Subclass 485 (Temporary Graduate) visa;

(v)  if the assessment specified a period during which the assessment was valid, and the period did not end more than 3 years after the date of the assessment — the period had not ended;

(vi)  if subparagraph (v) did not apply — not more than 3 years had passed since the date of the assessment; or (또는)

(c)  both:

(i)  the applicant’s occupationccupationccupationoccupationoccupation was not specified by the Minister in an instrument in writing for subparagraph (b)(i), or the applicant obtained the necessary qualification in Australia; and

(ii)  the applicant had the qualifications listed in ANZSCO as being necessary to perform the tasks of the occupation.
