안녕하세요.
직업군 332211 PAINTING TRADES WORKER의 경우 아래와 같은 일을 위해서 공부를 하게 됩니다.
PAINTING TRADES WORKERS apply paint, varnish, wallpaper and other finishes to protect, maintain and decorate surfaces of buildings and structures.
Indicative Skill Level:
Most occupations in this unit group have a level of skill commensurate with the qualifications and experience outlined below.
In Australia: (호주에서 학위 수준은 Cert III + 2년 경력 (코스기간중) 또는 Cert IV를 얻어야 하지요)
AQF Certificate III including at least two years of on-the-job training, or AQF Certificate IV (ANZSCO Skill Level 3)
그러나 외국인 유학생의 경우 485 비자를 받아야 하는 경우라면
2 year full-time study 조건까지 만족을 하면서 332211 PAINTING TRADES WORKER 의 코스를 들어야 합니다.
지금까지 알려진 많은 case의 경우 불행히도 485 비자를 거절당했다는 것입니다.
a few clients who have got their 485 GWS Refused as they did not have CERT 4. They have following qualifications--
1. Cert 3 in Painting and Decorating
2. Diploma of Building and Construction management
Case officers are refusing on the basis on diploma studies stating " description of ANZSCO FOR Painting and Trades Worker does not refer to Building and Construction Mgt related units as benefiting this occupation".
으로는 485 비자를 만족하지 못한다.
그 이유는 아래와 같습니다.
1. Cert 3 in Painting and Decorating
2. Diploma of Building and Construction (management)
Same reason---- NOT ''CLOSELY RELATED' 즉 두 코스가 관련이 없다! 라는 것으로 485 비자 거절!
그래서 이민법무사 사이에 나오는 말이 아래와 같은 말입니다.
In my opinion, it's highly likely that if the student had studied anything in construction and building ( other than Mangement or business, which seems to be the case here) like Certificate IV in Building and Construction (Building) or Diploma in Building and Constructions ( Building) they would have more merits of being successful at their application
내용인 즉, Cert III를 마치고 Cert IV를 Building and Constructions ( Building) 분야로 공부를 하면 나을려나? 하는 내용입니다.
이런 말이 오고간 것이 작년 10월말경입니다.
그렇다면 아직 말씀하신 코스를 마치고 실제 기술심사 통과 + 489 (GW)를 통과한 사람이 아직은 없을 것이다.
과연 누가 먼저 마루타(?) 가 되어 볼까요.
모르면 약이라고 했던가요?
그냥 시작했더라면 그리고 아~ 통과 되네 내지는 아~~ 거절당했다 ㅠㅠ
라고 경험적으로 알 것입니다.
왜?
이민법무사라는 사람들이 코스를 만든 사람인가요? 아닙니다.
실제 그 코스 잘 몰라요. 관련이 있는지 없는지 솔직히 모릅니다.
그 코스를 가장 잘 아는 사람은 해당 학교 course coordinator 입니다.
이 사람이 그 코스가 'closely related' 인지 여부를 확인해 줘야 합니다.
그렇지 않다거나 그 사람들도 모르거나 (모른다면 non-sense; 제 입장에선) 한다면 'very high risk' 가 있는 것입니다.
그럼으로 1번 질문은 우리가 알 도리가 없다. 누가 가장 아는가? course coordinator 이다 입니다. 485 visa 가 잘 grant 되었다면 PR (영주권) 처리에 문제는 없다고 할 수 있음.
2. JRP step 1은 호주내 3년 기간에 쌓은 경력만 인정합니다. (claimed employment completed in Australia in the last three years)
3. Under clause 482.221 and 482.231, visa applicants are required to have worked in the nominated occupation, or a related field, for at least two years. 만족을 위해서 5년내 2년 경력은 기본적으로 Full-time work입니다. 2년 full-time에 동일한 시간의 파트타임일도 고려를 해 줄 수 있습니다. 즉, Full-time work이란 주당 38시간입니다.
Under policy, it is generally expected that the work experience should have been undertaken on a full-time basis in the last five years. This period does not, however, need to be continuous. Decision-makers may also consider work undertaken as a part-time employee that is equivalent to two years full-time, where they are confident that the applicant’s experience and skills are relevant and current.
Consistent with the National Employment Standards (NES), employment will be considered ‘full-time’ where the visa applicant worked 38 hours per week.
Work experience will, however, also be considered 'full-time' where the visa applicant worked for a period between 32 and 45 hours per week under an industry award or an agreement that was consistent with the NES where applicable.
따라서, 주당 20시간씩 일을 4년간 했다면 이는 TSS 비자의 2년 full-time 조건을 고려해 줄지 모릅니다. (고려해 준다라고 보장은 못함에 유의. Decision-makers may also consider work undertaken as a part-time employee that is equivalent to two years full-time 에서 may also consider 라는 것이 그런 뜻임)

근무하는 회사의 자격 요건도 정해져 있을까요? 직원수, 규모, 연 매출 등.... (for 졸업비자, TSS, ENS, RSMS) -> Yes or no! 이 내용 정리해 드릴려면 아마 몇시간이 걸리겠네요. sorry but you will have to study first and choose one of them depending on your circumstance. I can't tell you everything here. No time.
현재 남편이 회계 졸업하고, 통번역 학업 중에 있는데, 독립기술이민 쿼터도 줄고 지원 가능한 점수도 너무 많이 올라서 회계 이민이 쉽지 않아 제가(와이프) plan B로 페인팅을 시작하려 합니다 -> 소질이 있나요? 공부할 수 있을까요? 그저 비자 받는 용도인가요? 솔직히 전 아니라고 보기에 제 조카나 또는 나 자신은 이런 선택은 너무 무모하다 봅니다. 그래도 내가 좀 소질이 있어야 하지 싶군요. 소질이 있다면 모를까.
7. 요즘 학생비자 승인이 까다롭고 거절 사례도 많다고 들었습니다. -> visa 신청을 할 때는 해당 비자의 genuine 인지 여부를 가장 먼저 생각을 해야 합니다. GTE에서 소설을 쓰니 refuse될 수 밖에 없어요. 유학원은 학생들이 CoE를 받고 학생비자를 신청해야 돈을 벌죠. 저는 늘 이야기 해 드리지만 그 무슨 코스가 되었든 좀 연구좀 하고 선택을 해라. 정말 내가 이 코스를 안하면 안되겠다는 하는 소신. 그래서 refuse되면 난 넘 어울하다. AAT로 가서라도 appeal 해야 속이 시원하겠다 뭐 식으로 해야 Student Visa의 refuse rate이 낮을 것입니다. 그렇지 않으면 앞으로 점점 더 refuse rate은 높아질 가능성이 있죠.
