다수 비자관련 Migration Law 의 변경이 뒤 따를 듯

안녕하세요.

 

그동안 이민법무사 사이에서 많이 기다렸던 소식을 MIA 협회에서 백장에 달하는 자료를 정성껏 요약한 내용을 보내왔습니다. 그 내용을 제가 간단히 토를 달면서 또한 고객님들과 공유합니다.

 

기술이민비자 관련하여 손보지 않는 곳이 없을 정도로 아래 8가지 주요 내용이 있다고 합니다.

The strategy based on 8 key actions:

  1. Targeting temporary skilled migration to address skills needs and promote worker mobility (임시기술비자)
    2. Reshaping permanent skilled migration to drive long-term prosperity (기술이민영주비자)
    3. Strengthening the integrity and quality of international education (학생비자)
    4. Tackling worker exploitation and the misuse of the visa system (노동자착취및 오용관련 대처)
    5. Planning migration to get the right skills in the right places (필요한 곳에 필요한 기술할당)
    6. Tailoring regional visas and the Working Holiday Maker program to support regional Australia and its workers (지방 임시비자 변경 가능)
    7. Deepening our people-to-people ties in the Indo-Pacific
    8. Simplifying the migration system to improve the experience for migrants and employers (이민시스템 간소화)

Certain parts of the strategy are still to be finalised after further consultation as recommended by the Parkinson review. (아직 고려할 대상도 있음)

The key announcements include: (좀더 자세한 내용)

 

Migration Program Planning

The government will extend migration planning beyond the current 12 month planning cycle to fill critical skills shortages and ensure better collaboration with the states and territories. (현재 12개월 마다 세우는 이민프로그램이 변경될 듯)

Net overseas migration numbers are expected to fall from 510,000 in the 2022-23 financial year to 375,000 next financial year and 250,000 in 2024-25. The numbers are predicted to stabilise at this lower level from that time on. (향후 점점 이민자 줄일 전략)

International student numbers grew to 270,000 in 2022-23 up from 170,000 in 2028-19 prior to COVID, which also saw a return to Australia of students who had been forced to study online and offshore during the pandemic. (학생비자 숫자가 이미 Pandemic 전보다 훨씬 넘음)

Temporary visa holders, ie Temporary Skilled, Working Holidays Maker and COVID pandemic event visas, accounted for 180,000 places in 2022-23, up from 100,000 in 2018-19. (임시비자소지자도 이미 넘음)

 

Skilled temporary visas  (기술 임시비자)

A new three tiered system of visa pathways to replace the TSS SC 482.  The ‘essential skills’ visa for those earning under $70,000, the ‘core skills’ visa for the $70-135,000 cohort and the ‘specialist skills‘ visa for those earning over $135,000 per year. (TSS 비자 3가지 분야 vs 급여 변경 예고 –

  • The specialist skills visa pathway will not have an occupational list and a processing turnaround of 7 daysTrades occupations, machinery operators, drivers and labourers will be excluded from this visa class. There will be 3,000 places allocated per year. (급여 135,000불을 받은 특별한 직업군들)
  • The core skills visas pathway are expected to provide the majority of visa for the program.  trades workers will be required to apply under this visa based on a revised ‘skills in demand list‘ developed by Jobs and Skills Australia. (482 비자의 메인에 해당할 듯; 기능직 종사자 여기에 포함될 듯)
  • The details of the essential skills visa pathway are yet to be finally determined. This visa will involve union oversight, be capped and be restricted to specific sectors.  To date the aged care and disability sectors have been mentioned. (아직 결정된 것 없음)

The visas will be granted for up to 4 years and visa holders will be able to change employers more easily and provide clear pathways to permanent residency.  The ‘TSMIT’ will be indexed annually and a public register of employer sponsors to allow more ease with moving between employers. (고용주 변경도 좀더 쉽게 될 것 같음)

Points tests (포인트 제도 기술이민 – 점수제 새로운 점수제로 변경 가능성)

The points test will be reviewed. Further consultation will occur on a new points test, with the development of a new analysis-based points test to identify more effectively the independent migrants who will make the greatest contribution to the country.   This pathway will have a faster pathway to permanent residence for graduates working in skilled jobs. (호주에 큰 기여를 할 수 있는 독립기술이민자를 위해서 바른 처리도 예고한다는데 지켜 봐야 할 듯)

Temporary Graduate Visas (임시 졸업비자 485)

There will be considerable change to these visas as they become more targeted towards international graduates with skills required by Australian employers, including:

  • reducing the length of stay for these international graduates (비자 기간 줄이겠다고? ㅠ)
  • preventing holders of the new graduate visas from moving back onto student visas (학생비자로 돌아가는 것을 봉쇄)
  • preventing the stay of International graduates without skills in demand from remaining in Australia. (호주에 기술없이 거주하는 유학생 봉쇄?)
  • reducing the age eligibility from 50 to 35 years of age (나이 제한 무려 15년 감축)
  • increased English language levels for temporary graduate visas (영어성적은 올리고)

 (전체적으로 유학생들이 불리해지는 상황이 발생할 것이 예고되는 내용임) 

 

Student visas (학생비자) – 학생비자 할당된 숫자가 비록 다 차지 않더라도 향후 큰 변화 예고

There will be significant changes to the student visa program, although the number of places will not be capped.  Instead other migration levers will be used to control numbers, including;

  • higher English language levels for student visa applicants (영어성적 상향)
  • reducing the types of courses eligible for student visas with the focus on retaining tertiary university courses (코스 제한)
  • preventing course swapping (코스 변경 예방 예고)
  • increased funding for visa integrity and to identify the ‘genuine student test’. (genuine 학생인지 여부를 감별할 자금 보유력 증가)

Education Agents (유학원도 이민법무사 처럼 법에 따라 등록제 예고?)

Regulation of education agents through an expansion of the Office of the Migration Agents Registration Authority will be investigated.

Regional migration (지방 이민)

The government has acknowledged the lack of success of current regional migration strategies in attracting migrants to those locations.  The government will work closely with the state and territories to provided better targeting of regional population needs.  Regional visa applications will also be fast tracked.  (이민성에서 이미 숙지하고 있음 현 지방 이민전략이 제대로 작동하지 않고 있음을. 예를들어 주를 바꾼다든지 하는 것이 잦음 따라서 변경 예고)

Regional migration settings and the Working Holiday Maker program will be reviewed to ensure migration supports development objectives in regional Australia and does not contribute to the exploitation of migrant workers. (지방에 필요한 인력을 담보하기 위해서 관련법 변경될 듯)

Working Holiday Makers

No changes at this stage to the WHM program although the length of stay and the 88 day rules are under consideration. (현재 변동 사항 없음)

Global Talent and Business Skills 

The Global Talent program will be more sharply focused on a relatively small number of migrants who can make outsized contributions to Australia.  There will be consideration of a new ‘talent and innovation’ visa. (새로운 비자 전환될 듯 – 상대적으로 보다 적은 이민자를 할당할 듯)

The Business Innovation and Investment Program has seen over 80% of company directors invest in small retail or hospitality businesses, rather than in sectors that will drive Australia’s future innovation and productivity. The Significant Investor Visa program looks set to continue with some further adjustment.

이상 이민법 변경 예고 (내년 초에 더 예고될 것으로 보이며) 에 대한 정리한 내용을 함께 공유합니다.

참고로 호주이민법은 늘 크고 작게 변경하고 있습니다. 제가 22년을 이 길을 걸어 왔습니다만 이번 변경예고는 아마도 큰 변경이 될 것으로 전망합니다.

법은 발표해야 하는 것으로 현재 공부 또는 향후 공부하시는 분들은 말 그대로 genuine student가 되어야 할 것 같고 호주외에서 공부하고 일하는 분들도 꾸준히 그 길을 가시면 좋은 소식이 있을 것으로 봅니다. 언제나 비자는 준비된 분딜이 (상대적으로 쉽게) 얻게 된다는 점을 강조드리고요. 특히 기술가진 분들이 언어 능력이 그 수준에 맞게 갖고 있을 때 영주비자를 얻는데 좋은 것은 두말하면 잔소리가 되는 것 같습니다.

아무튼 내년에 있을 어떤 변경이 있을 지라도 지금 현재 하시는 일에 만족하시면 행복한 생활을 하시면 좋을 듯 합니다.
