485 비자를 신청할 때 AFP는 필수 서류 입니다.

이로 인해서 비자거절 – AAT 에서 패소 된 케이스를 두번 공유한 것이 있습니다.

그런데 한국인으로서 한국경찰청 신원조회 (criminal records) 를 제출하지 않아서 비자가 거절한 케이스가 있네요

MIGRATION – Skilled (Provisional) (Class VC) visa– Subclass 485 (Temporary Graduate)) visa – copy of a National Police Certificate provided – no disclosable outcomes recorded against the applicant – decision under review remitted

이렇게 진행이 되었다고 합니다.

The applicant applied for the visa on 26 February 2020 (비자 접수)

This is an application for review of a decision made by a delegate of the Minister for Home Affairs on 21 September 2021 to refuse to grant the applicant a Skilled (Provisional) (Class VC) visa  (비자 거절)

2020년 2월 26일 비자 접수 후  코비드로 한창 나라가 어수선할 때 무려 1년 7개월 동안 한국신원조회를 제출하지 않았던 모양입니다. 이런 경우 보통은 제출하라고 통보를 해주거나 하는데 그런 것이 없었는지 모르겠습니다만 이민법무사는 1년 7개월 사이에 이 신청자의 한국신원조회를 미리 감치 제출했어야 합니다. 그렇지 않아서 이 비자는 거절을 일단 당합니다. (신청인은 매우 놀랐겠죠? ㅠ) 

On 6 January 2022, the Tribunal received a National Police Certificate dated 9 December 2021 certifying that there are no disclosable Court outcomes.  (한국 신원조회 받음)

날짜를 잘 보면 2021년 12월 9일 한국신원조회 결과나 나온 것을 알 수 있고 이는 비자가 거절된 다음 (2021년 9월 21일 거절됨) 에 황급히 신청을 한 것이 눈에 보입니다. 거절후 약 2개월 반 만에 결과를 받아서 AAT에 제출합니다.

On 6 January 2022, the Tribunal received a National Police Certificate dated 9 December 2021 certifying that there are no disclosable Court outcomes. The Tribunal also received a Background Check (Criminal Records) Certificate from the Korean National Police Agency dated 1 December 2021 certifying no criminal records. (한국 경찰 신원조회에 이상이 없고) 

The applicant has now provided a statement from an appropriate authority in the country in which he resides and therefore meets reg 2.03AA(2)(a). From this statement, the Tribunal is satisfied that there is nothing to indicate that the applicant would fail to satisfy the Minister that the applicant passes the character test: PIC 4001(b). (PIC 4001 (b) 에 관련하여 범죄경력이 없어 만족하고)

On the basis of the above findings, the Tribunal is satisfied that reg 2.03AA(2) and PIC 4001 is met. Accordingly, the Tribunal finds that the applicant satisfies cl 485.216(1). (이렇게 만족함에 따라) 

The Tribunal remits the application for a Skilled (Provisional) (Class VC) visa for reconsideration, with the direction that the applicant meets the following criteria for a Subclass 485 visa: (이민성에 제고하라고 돌려 보냅니다) 

결국 happy ending으로 마치지만 1년 7개월간 한국신원조회를 제출하지 않아서 이런 불편(?)과 불안 초조함을 신청인이 얻지는 않았을까 싶습니다. 

때로는 이렇게 간단한 것 하나를 간과 (overlook) 해서 결과는 참담할 수 있습니다. 비자는 늘 돌다리도 두들겨 가면서 처리하는 습관이 필요한 것 같습니다.
