아래 내용은 파트너 비자 820 비자를 2015년 5월에 신청했는데 case officer가 결혼신고까지 한 케이스를 최종판단할 때 스폰서의 배우자가 아니라고 보고 거절한 내용입니다. 그래서 파트너비자는 당연히 appeal 을 했으며 2020년 3월 다행히 재심에서 신청인에게 손을 들어준 케이스 내용입니다.

The delegate refused to grant the visa on the basis that the visa applicant did not satisfy cl.820.211 because the delegate was not satisfied the applicant was the spouse of the sponsor. The applicant seeks review of the delegate’s decision.

신청인이 제출했었던 목록들입니다. (물론 내용은 알 수 없습니다만 목록만 보면 잘 준비한 것 같은데…)

• Statutory declarations from the applicant and sponsor;

• Joint bank account statements;

• Transaction history statements for money transfers to the applicant’s daughter;
• Last will and testament;

• Tenancy agreement/rent ledger/receipts;

• Correspondence from real estate agent;

• Form 888 statements;

• Various photographs;

• Evidence of travel;

• Church reference/letter of support;

• Receipts for household purchases;

• Correspondence from CBA addressed to the applicant and sponsor individually;

• Car insurance/registration;

• Utility bills;

• Applicant’s and sponsor’s passports;

• Tenancy agreement;

• Bupa health insurance receipts/tax invoice/health insurance statements; and

• Marriage certificate.

그럼에도 불구하고 Case Officer가 거절했다는 점이 흥미롭습니다.

왜 그랬을까?

아쉽게도 그 이유는 밑에 한줄입니다.

이 한줄만 이유와 관련하여 언급되어 있습니다.

Refusal letter나 관련 내용을 AAT 심사 내용에 공개되어 있지 않기 때문에 저도 정확히 알수는 없었습니다.

파트너 비자 신청인이 스폰서 (이 경우 남편이었음)의 배우자라고 만족되지 못했기 때문에 820 비자의 820.211 항목을 만족하지 못해 거절되었다. 

이민법무사로서 그리고 저도 제 고객님들의 파트너 비자를 대행하는 자로서 관심이 많지 않을 수 없습니다만 어떻게 신청을 했는데 이런 결과가 나왔는지 그저 궁금할 뿐입니다.
