6  Specification of classes of persons

(1)     This section applies in relation to an application by a person seeking to satisfy the primary criteria for the grant of a Subclass 482 (Temporary Skill Shortage) visa. (이 내용은 TSS비자 그란트를 위해 주신청자 조건을 만족하기 위한 신청인의 신청서와 관련되어 있다)

(2)     For the purposes of subparagraph 1240(3)(g)(iii) of Schedule 1 to the Regulations, the class of persons mentioned in column 2 of an item of the following table is specified for the occupation mentioned in column 1 of that item. (아래 표의 어떤 항목 하나의  컬럼 2에 명시된 사람들의 구룹이 해당 항목의  컬럼 1에 명시된 직업군과 정확히 명시되어 있다 (iii) 내용은 (iii) the applicant is in a class of persons specified in the legislative instrument for the occupation 임)

(b) who are not exempt applicants for the occupation.

8 diesel motor mechanic Persons:

(a) who hold a passport issued by Fiji, Hong Kong, India, Macau, Philippines, South Africa, Thailand, Vietnam or Zimbabwe; 이고

(b) who are not exempt applicants for the occupation.

9 electrician (general) Persons:

(a) who hold a passport issued by Fiji, Hong Kong, India, Macau, Philippines, South Africa or Vietnam; 이고

(a) who hold a passport issued by Brazil, China, Fiji, Hong Kong, India, Macau, Papua New Guinea, Philippines, South Africa, Thailand, Vietnam or Zimbabwe; 이고

21 program or project administrator All persons other than exempt applicants for the occupation.

(b) who are not exempt applicants for the occupation.

25 welder (first class) Persons:

(a) who hold a passport issued by Brazil, China, Fiji, Hong Kong, India, Macau, Philippines, South Africa, Thailand, Vietnam or Zimbabwe; 이고

(b) who are not exempt applicants for the occupation.

7  Exempt applicant for an occupation

(1)     A person who has applied for a Subclass 482 (Temporary Skill Shortage) visa is an exempt applicant for an occupation mentioned in column 1 of an item of the table in section 6 if:

(a)     all of the following apply in relation to the person:

(i)      the person holds a Subclass 457 (Temporary Work (Skilled)) visa or Subclass 482 (Temporary Skill Shortage) visa; (457 /482 비자 소지자)

(ii)     the person satisfied the primary criteria for the grant of that visa; (비자 그란트를 위해서 주신청자 조건을 만족하는자)

(iii)    the person is employed in Australia in the nominated occupation to which the application relates; or

(b)     both of the following apply in relation to the person:

(i)      the person is employed by a company operating an established business overseas in the same occupation as, or a similar occupation to, the nominated occupation to which the application relates;

(ii)     the person is nominated by a standard business sponsor who is that company or an associated entity of that company.

(2)     A person who has applied for a Subclass 482 (Temporary Skill Shortage) visa is an exempt applicant for an occupation mentioned in column 1 of an item of the table (other than item 21 or 23) in section 6 if: (항목 21 또는 23를 제외한 직업군을 신청한 경우)

(a)     both of the following apply in relation to the person:

(i)      the person holds a relevant qualification for the nominated occupation to which the application relates that is commensurate with the qualification specified for the occupation in ANZSCO; (ANZSCO에 있는 직업군에 명시된 학위와 비슷한 직업군의 관련 학위소지)하고

(ii)     the qualification was obtained as a result of the successful completion of a course of study or training in Australia or a permitted country for the occupation; (호주에서 해당 국가에서 공부를 마친 경우)or 또는

(b)     both of the following apply in relation to the person:

(i)      the nominated occupation to which the application relates requires the person to hold a licence, registration or membership to perform the occupation; (자격증요구를 하는 직업군에 대해 자격증을 소지하고 있고)

(ii)     the person has been granted that license, registration or membership; (자격증 그란트 된 경우)or 또는

(c)     the person has met the standards set by TRA under the Offshore Skills Assessment Program for the nominated occupation to which the application relates. (OSAP 기술심사기준을 만족하는 경우)

(3)     A permitted foreign country for an occupation mentioned in column 1 of an item of the table in section 6 is a foreign country, or a Special Administrative Region of a foreign country, that is not mentioned in column 2 of that item. (컬럼2에 국가 이름이 없는 경우)

(4)     A person who has applied for a Subclass 482 (Temporary Skill Shortage) visa is an exempt applicant for an occupation mentioned in item 21 or 23 of column 1 of the table in section 6 if: (컬럼 21 과 23의 직업군관련)

(a)     the person holds a relevant qualification for the nominated occupation to which the application relates that is commensurate with the qualification specified for the occupation in ANZSCO; and (관련학위를 가지고 있고)

(b)     the person will receive annual earnings of at least AUD180,000; and (최소 년봉 18만불이고)

(c)     the person is nominated by a standard business sponsor who has been given accredited status by the Department. (스폰서쉽 자격이 Accredited 등급을 가지고 있는 회사가 지명한 경우)

따라서, 결론적으로 대한민국 (South Korea)는 어떤 직업군에도 포함되어 있지 않습니다. 이 법규를 근거로 볼때는 Skill Assessment가 한국인들에게 필수 (Mandatory)는 아닙니다. 그럼에도 불구하고 아래 법규에 의하면 이민성 케이스 오피스 Case Officer의 자유재량에 의하여 기술심사가 요구될 수 있다고 명시되어 있습니다.

4.5.6 Skills assessments

In accordance with paragraph 1240​(3)(g), some TSS visa applicants are required to commence a skills assessment prior to lodging their application as outlined at section 4.3.8 Mandatory skills assessments.

As outlined above, in accordance with sub-clause 482.212​(4), discretionary skills assessments can also be requested where considered necessary to assess whether a visa applicant has the required skills, qualifications and experience to perform the nominated occupation. (지명된 직업군을 수행하기 위해 필요한 기술, 학위 그리고 경험을 가지고 있는지 평가하기 위해서 필요한 기술심사를 재량에 따라 요구될 수 있음)

Note: as a general principle, discretionary skills assessments should only be requested where considered absolutely necessary in consultation with Program Management. (그럼에도 불구하고 이민성 케이스오피스가 기술심사를 요청할 때는 반드시 필요하다고 고려될 때만 요구된다는 점)
