호주 비자를 신청할 때 항상 사실에 근거한 문서와 사실에 근거한 정보를 제출해야 합니다.

경우에 따라서 그렇지 못한 경우는 자신은 물론 가족구성원에게도 안 좋은 결과를 낳을 수 있습니다.

호주이민법에 항상 genuine 문서와 정보를 제공하도록 하는 법규가 있기에 함께 공유합니다.

아래와 같이 모든 기술이민비자, 사업비자, 임시비자, 학생비자, 가족비자 공익기준 4020 (PIC 4020) 조건을 반드시 만족을 해야 합니다. 이 PIC 4020 법규는 만약 신청인이 신청된 비자와 관련하여 가짜 서류나 거짓 또는 호도하는 정보를 제출한 경우 비자 거절이 되도록 하는 법적 조항입니다.

Public Interest Criterion 4020

PIC 4020 enables refusal of a visa if an applicant provides a bogus document or information that is false or misleading in relation to their application, or if the Minister is not satisfied of an applicant’s identity.

If PIC 4020 is part of the criteria for the particular visa you have applied for you must satisfy PIC 4020 in order to be granted your visa. (PIC 4020를 만족시킬 때 비자가 그란트되며 신청한 비자의 조건들 중에 하나로 반드시 만족해야 할 법규입니다.)

Visas affected by PIC 4020

If you have applied for any of the following visas, you must satisfy PIC 4020: (밑에 나열된 비자 카테고리에 해당하는 모든 비자에 적용됨)

• skilled migration visas
• business visas
• temporary visas
• student visas
• family visas.

Identity requirement

PIC 4020 requires that you satisfy us of your identity to be granted a visa (where that visa includes PIC 4020 as part of the criteria). (이민성에서 신청인이 누구인지 만족을 할 때 신청된 비자는 그란트됩니다.)

If we are not satisfied of your identity your visa may be refused. (신청인의 신분증이 없고 이민성에서 누구인지 만족하지 못하면 비자는 거절됩니다.)

This requirement applies to visa applications lodged on or after 22 March 2014 and all visa applications made, but not finally determined before 22 March 2014. (2014년 3월 22일부터 적용되었고 그전까지 비자 결정이 안된 모든 케이스에 적용됩니다.)

Non-grant period (비자그란트 제외기간)

If your visa is refused under PIC 4020 because you did not satisfy us of your identity, you may not be granted a visa for a period of ten years (where that visa includes PIC 4020 as part of the criteria). (이전에 신청한 비자가 신분확인이 안 되는 경우로 PIC 4020하에 거절되었다면 PIC 4020가 비자 만족 조건의 일부로서 포함된 비자는 10년간 비자그란트가 되지 않습니다.)

Waiver (면제 규정)

There is no waiver available for the identity requirement or the ten year non-grant period. (해당 10년 비자그란트 제외기간은에 대한 면제 규정은 없다)

Members of your family unit (가족 구성원)

If your visa is refused because you did not satisfy us of your identity, anyone who has you listed as a member of their family unit will also be refused. These family members will also be prevented from being granted another visa (where that visa includes PIC 4020 as part of the criteria) for ten years. (가족 구성원도 10년간 비자그란트 제외기간이 적용됨)

Bogus documents or information that is false or misleading (가짜 문서 또는 거짓 또는 오해를 야기하는 정보)

Visa applicants must not provide bogus documents or information that is false or misleading in a material particular with their visa application. (비자 신청인은 이와 같은 가짜 문서나 가짜 또는 오해를 사는 정보는 제공해서는 안 된다)

Your visa application might be refused, if you or any of the members of your family unit: (신청인 또는 신청인의 가족 구성원이 아래와 같은 조건에 있을 경우 신청한 비자는 거절될 수 있다)

• provide a bogus document or information that is false or misleading as part of your current visa application (현재 신청한 비자신청서와 관련 가짜 문서 또는 거짓 또는 그에 준하는 오해를 사는 정보를 제공한 경우)
  or
• previously provided a bogus document or information that is false or misleading in relation to a visa that you held in the 12 months before making your current application. (현재 신청서를 제출하기 전 12개월내에 소지했던 비자와 관련하여 가짜 문서 또는 가짜 또는 오해를 사는 정보를 이전에 제공한 경우)

Non-grant period (비자그란트 제외기간)

If your visa application is refused because you or any of the members of your family unit provide bogus documents or information that is false or misleading in a material particular, you might be prevented from being granted a visa for three years. (가짜 문서 및 정보를 제출한 경우 3년간 비자그란트 제외기간이 적용됨)

Waiver (면제 규정)

If we are considering refusing your visa because we believe you have provided bogus documents or false or misleading information or (where that visa includes PIC 4020 as part of the criteria), you must provide reasons why the visa should be granted. These reasons must be either: (아래와 같은 사항이 될 때 신청인은 새로 신청하는 비자가 반드시 그란트되어야 하는 이유를 제출해야 한다)

• compelling circumstances affecting Australia (호주에 영향을 주는 불가항력적인 어떤 여건)
  or (또는)
• compelling or compassionate reasons affecting an Australian citizen, permanent resident or eligible New Zealand citizen. (호주시민권자, 영주권 또는 뉴질랜드시민권자에게 영향을 주는 불가항력적인 또는 연민의 이유)

This also applies if you have been refused a visa for providing a bogus document or information that is false or misleading in the last three years and you apply for a new visa. (지난 3년내에 거짓 또는 오도하는 가짜 문서 및 정보를 제공하여 비자가 거절되었고 새로운 비자를 신청할때 적용가능)

Members of your family unit (가족 구성원)

If your visa is refused because you provided a bogus document or information that is false or misleading, anyone in your application who has you as a member of their family unit might also be refused. These family members might also be prevented from being granted another visa for three years. (가족 구성원도 3년간의 비자그란트 제외 규정을 얻게 됨)

Chance to comment

If you are unable to satisfy us of your identity, or your application includes a bogus document or false or misleading information, we will notify you and ask you to provide comments within a specified time period. (신청된 비자가 거절될 경우 일정시간 안에 신청인에게 비자가 거절되지 않아야 하는 사유를 물어 온다)

Review rights

If your visa application is refused, you might have the right to have the decision reviewed by the Administrative Appeals Tribunal. We will advise you what review rights are available to you if your visa application is refused. (비자가 거절된 경우 AAT에 의해 재심될 수 있는 권한을 갖게 될 수 있다.)

Future visa applications

If you are refused under PIC 4020, you can make a new visa application but the following conditions will apply:

• if you have not left Australia since your application was refused and you do not hold a valid visa, you can only apply for certain specified visas listed in Form 1026i Limitations on applications in Australia (48KB PDF) (비자가 거절되고 유효한 비자를 가지고 있지 않은 다음에도 호주를 떠나지 않으면서 신청할 수 있는 비자들은 아래와 같다.
  – Special Eligibility (residence) – Child (residence) – Partner (temporary)1 – Partner (residence)1 – Protection (see next column) – Medical treatment (visitor)2 – Territorial asylum (residence) – Border (temporary)3 – Special category (temporary)4 – Bridging A – Bridging B – Bridging C – Bridging D – Bridging E

• if you are in Australia or outside Australia and hold another visa (besides a Bridging visa) you can make a new visa application. (호주에 있거나 또는 호주 밖에 있으면서 브리징비자를 제외한 어떤 다른 비자를 가지고 있다면 새로운 비자를 신청할 수 있다. 즉 S48에 영향을 받지 않음)

If you have been refused a visa for providing a bogus document or information that is false or misleading in the last three years and you apply for a new visa (where that visa includes PIC 4020 as part of the criteria), you must provide reasons why the visa should be granted. These reasons must be either: (지난 3년 안에 가짜 문서 또는 거짓정보나 오해를 사는 정보를 제출하여 비자가 거절된 경우가 있으면서 (위에 언급한 PIC 4020 규정이 만족해야 하는) 새로운 비자를 신청하고자 할 때 신청인은 반드시 비자가 그란크되어야 하는 아래와 같은 이유를 제공해야 함 (면제 받기 위함)

• compelling circumstances affecting Australia (호주에 영향을 주는 불가항력적인 여건)
  or
• compelling or compassionate reasons affecting an Australian citizen, permanent resident or eligible New Zealand citizen. (호주시민권자, 영주권자 또는 뉴질랜드 시민권자에게 영향을 주는 불가항력적인 또는 연민의 이유)

아래 내용은 2018년 1월 5일 추가한 내용.

또한 비자를 신청할 때 이전에 어떤 비자가 되었든 거절 또는 취소된 적이 호주뿐만 아니라 타국에서 있었다면 알려야 한다. 심지어 함께 호주로 입국하려고 하지 않는 가족이 있다 할지라도. 타국에서는 비자 거절 또는 취소를 다른 언어로 묘사할지 모르니 주의 하라. 예를들어, 추방, 입국거부 또는 비자 취하 등. 만약 어떤 질문에 답변으로 제공된 정보가 부정확할 경우 PIC 4020 하에 비자가 거절될 수 있다.

Ensure applicants declare any previous visa refusals or cancellations from any country for themselves and family members, even if the family members are not intending to travel to Australia. Remember that a visa refusal may be called something different in other countries, like a rejection, denial or a visa declined. If information provided in response to this question is incorrect, it may lead to refusal under PIC 4020.

아래 내용은 2020년 4월 6일 추가한 자료 (457 비자를 신청한 한국인 가족이 일한 것과 관련하여 가짜 정보로 오해를 한 CO가 비자 거절 AAT 재심을 넣어 reconsider하라고 한 case의 실사례) 로서  PIC 4020 과 관련하여 재심사관이 검토한 이민법은 아래와 같음

CONSIDERATION OF CLAIMS AND EVIDENCE

6. The issue in this review is whether the visa applicant meets PIC 4020 as required by cl.457.224(1) for the grant of the visa. Broadly speaking, this requires that:
   • there is no evidence that the applicant has given, or caused to be given, to the Minister, an officer, the Tribunal, a relevant assessing authority, or Medical officer of the Commonwealth, a bogus document or information that is false or misleading in a material particular in relation to the application for the visa or a visa that the applicant held in the 12 months before the application was made: PIC 4020(1); and
   • the applicant and each member of the family unit has not been refused a visa because of a failure to satisfy PIC 4020(1) during the period starting three years before the application was made and ending when the visa is granted or refused, unless the applicant was under 18 at the time the application for the refused visa was made: PIC 4020(2) and (2AA); and
   • the applicant satisfies the Minister as to his or her identity: PIC 4020(2A); and
   • neither the applicant nor any family unit member has been refused a visa because of a failure to satisfy PIC 4020(2A) during the period starting 10 years before the application was made and ending when the visa is granted or refused, unless the applicant was under 18 at the time the application for the refused visa was made: PIC 4020(2B) and (2BA). (거절된 비자가 제출될 당시 가족구성원이 18세 미만인 경우예외)
7. The requirements in PIC 4020(1) and (2) can be waived if there are certain compelling or compassionate reasons justifying the granting of the visa: PIC 4020(4). However, this waiver does not apply to the identity requirements in PIC 4020(2A) and (2B). PIC 4020 is extracted in the attachment to this decision. (section 7번에 보면 신분증 가짜 자료 또는 정보를 제공하여 비자가 거절되면 10년간 신청이 불가하며 이런 경우는 면제조항에서 제외됨에 따라 신분증 조작은 최악의 결과를 초래하게 됨)
